The Board took up for consideration the letting; of the contract for the
construction of the M ehigan Street Trunk sewer and said Board found that one J.H.
Cahill vias the lowest and best birder, therefore ordered that said contract be let
to said J.H. Cahill. It was further ordered that the specification filed by MN J.H.
Cahill with is hid being the specifications of the Merriweather Lock Joint Pipe
Company which shows one and two ring reinforced concrete pipe and agreeable to the
specifications on which bids were received, the Board now finally adopts the two ring
reinforced concrete pipe as per specifications which were 'filed with the City Engineer
May 14th.11915 and the same are hereby ordered to be made as a part of th--- specifiea,�-.
tions for the construction of said sewer, which specifications are as follows -t a
SPECIFICATIONS 141OR REINFORCED CONCRETE PIPE.
FORMS.
The fo—ms shall consist of cast iron bottom and top rings shaped to form the
bell spigot ends of the pipe, and sheet steel inner and outer casings, lihich shall be
rolled to true cylinders. The inner and outer casings shall be truly concentric °iyhen
the forms are assembled. The forms shall be rigidly held together and -shall have no
cracks extending through either the inner or outer casings, which will allow the water
from the concrete to run through. Butt straps must cover the joints between the adja-
cent sheets of the casings.
COVtCPFsTF,.
The concrete used in the manufacture of the pipes shall consist of one part
of Portland Cement of quality speeified,� two parts of clean sharp sand and tour parts
of broken stone or clean gravel which will pass through a one inch ring.
CEMENT. The cement used shall be a well known brand Portland Cement, with an esta-
blished reputation and tested to meet the requirements'of the American Society of
Civil Engineers' or�Canaddan Society of Civil Engineers' specifications, as the
engineer may direct. All cement used in the work shall be protected from the weather
to the satisfaction of the engineer.
REINFORCEe TENT.
The reinforcement shall consist of American Steel and 'Mire Co.'s Triangular
Mesh or other wire mesL of the styles and weights spe-cified or shown on the drawings.
The reinforcing mesh shall extend into the bell of the pipe and out of the spiF'ot
portion of the pipe as shown on the drawings. When two adjacent sections of pipe are
placed together, the fabric extending out of the spigot shall overlap the fabric ex-
tending into the bell in an internal recess, as shown o the drawings.
- MOULDING PIPE AND MIXING CONCRj,TE.
All concrete sL&ll be mixed in a suitable batch mixer in a manner satis-
factory to the engineer. Means for measuring the several kinds of ingredients shall
be provided so that the concrete shall be an accurate 1-2-4 mix as specified under
CONCRETE A. The concrete shall be placed in the -forms in small, quantities and the
moulding of any one piece shall be eontinous from the placing of the first concrete
in the fo:-ris until the pipe section is corpleted. No retempered concrete will be used
under' any circumstances. Sifficient water shall be used in the concrete to make a
wet mix and the concrete shall be thoroughly sliced or spaded as,it is being placed
in the forms. After the removal of the forms, the pipe shall be kept moist by
frequent sprinkling for several days.
PIPE.
The pipe shall be made of concrete and reinforced as specified. The
pipe shall be manufactured by an established manufactueer of reinforced concrete
pipe, who shall have had previous experience in the manufacture of reinforced con-
crete pipe. The pipe shall be of the full bell and spigot type and. no pipe having
butt joints will be considered. The reinforcement shall be placed, n.nd of the weights
as specified or as shown on the d.rawincz. All pipes shall conform to the dimensions
and contain amount of reinforcement shown o-,. drawing and in table.
All pipes shall be marked with the date of their manufacture Lnd no pipe
shall be laid that it not fourteen (14) days old.

=LAYITIG. -
All pipes shall be laid true to grade arld. line with the spigot end extend-
ing toward the outf'all. The backfilling shall be thoroughly tamped under the invert of
the ripe in thin layers, and also around the sides and over the top of the pipe for at
least six inches before the backfill is ailoved to be thrown in the trench from the top
in large quantities.
JOINTS .
All joints shall be made of Portland: Cement mortar, mixed one part :Portland
Cement and two parts clean sharp sand. The mortar shall be thorou.b.ly troweled in the
recess in the interior of. the pipe lineup to the spring, making a continuous invert.
After this has been done steel f'orm6, especially designed for the purpose, shall be placed
over and around the entire joint, end the mortar for sewing the arch portion shall be grouted
or poured through an opening in the crown of the pipe.

CONTRACT FOR THE CONSTRUCTION OF SEWER.
THIS AGREEMENT made and er tere'd into in the City o f South Berid,St.
Josef County, and State of Indiana, by and between the City of South Bend,Indiana, by
and sell
its Board of Public Works, party of the first part, and J.H.Cahill of the
City o' `-Louisville, State of Kentucky, party of the second part,TTT'NESSETH:
That, Whereas, on the 16th. day of March,1915 the Boardof Public
Works of said City of South Bend adopted a Declaratory Resolution ,under Resolution
No. 367 and as modified April 20,1015 for the construction of a trunk sewer in. said City
known as the Michigan Street Trunk sewer, all in accordance with and by virtue of an Act
of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal
Corporations, approved March 6th,1905" and all amendatory and supplemental acts thereto;

Whereas, the said, J.H.Cahill was the lowest and best bidder for the
above mentioned work;
THERE1;'ORE, it is hereby agreed that the said party of the second part
shall do and perform all the work in the prosecution of the above described improvement
according to the terms and. conditions of said improvement Resolution NO- 367, and the
plans, profile and specifications on file in the Office of the Board of Public Works of
the Marty of the first par- , which resolution, profile, plans and specifications are made
.carts of this contract as filly and effectually as if copied herein at full length, and
to do all in a good and workmanlike manner and under the direction and control of the -
Civil Engineer of said City, and to the satisfaction and acce:,tance of said Engineer and
the Board of Public Works of said City.
It is agreed that the party of the second part shall not assign this
contract, or sub -let the work to be done thereunder, without the written consent of the
said party of the first part first obtained.
Said party of the second part agrees to pay for all labor or materials
used in the construction of said sewer or in the performancq of this contract, whether
done or furnished fore the party of the second part, or his agent -a or any sub —contractor;
and said party of the first part may reserve out of any allowance made on any estimate
in favor of the. said.party of the second part, or out of the amount due said party of the
second part upon the completion of said work, so much as may be necessary to pay argr
laborers or material men for amounts due them for work done or materials furnished in the
performance of said -contract and the construction of said work, and the City treasurer
of said city may require said party of tine second part to file receipts From such
laborers and material men for amounts so due them..
Said party of the second part agrees that in the prosecution of said.
wotk all proper skill and care will be exercised; that he via 11 properly and fully quard
and protect FL11 execavations,. dangerous places, wnd will use all due and proper pre—
caution to prevent .injury to any person of property, and will save and keep the party
of the first part harmless from any and all liability whatsoever growing out of any
injury or damage to persons or property because of any neglect or fault of said party of
the second part, its servants, agents, employees, assignees or sub --contractors, in the
perfoPmance of this contract or in any matter connected with or related thereto, and to
pay any judgement with costs whikh may be obtained against said City growing out of any such
in jurya or dsmage o
In consideration of the promises and agreements herein made, to be
kept and performed by s- id party of ,the second part, said party of the first part V ll

Said partir of the second part agrees to remove all rubbish and
unused material left on the completion of the work from the street alcg the line of said
sewer. '

And in as mi:1ch as said Michigan Street, in which said sewer_ is being laid, is
muc!� used by the general public for travel, it is deemed necessary that said work should
be per:."ormed and completed at the earliest possible time, in order that thefull use of
said street raay. be undisturbed for the shortest possible time.
THEREFORE, it is agreed by and between the parties that work may be commenced
upon the construction of said sewer at any time after .the signing, of these presents,
but that the same shall be in all things completed.on or before the 20th. day of
September,1915.
And upon failure to complete the same at said time, the said party of the
second part agrees to pay to the party of the first part as ligu dated dariages the sum
Of Fifty ( 50.00) Dollars p.tr day for each day that said work remains uncompleted after
the time fixed for the completion of the same.
Said liquidated damages, if any, so due said party of the First part shall
be deducted from the amount found to be due said party of the second part upon the final
completion df said work.
-The party of the first part further agrees that it will, promptly cause the
removal -of all lateral pipes, conduits and mains which in any wary interfer with the
construction of said sewer, and if there is any delay in the performance of this con—
tract because of the inability of the party of the first part to obtain the removal of
any such lateral pipes, conduits or rains, then the time for the performance of the
contract sha_ 1 be extended a: period equal to the time of such delay. However, the
above provision shall not ppply to the renovel or support of any cross pipes, conduits
or -mains which ray be in the line of said construction.
IN WITNESS WHEREOF, we, the foregoing named parties have hereunto set our.
hands and seals in duplicate this 19th. dfy,of May1915.

CHICAGO BONDING AND SURETY COMPANY as sureties, of the County of St. Joseph and State
of Indiana, are held and bound by the City of South Bend,Indiana, in the sum of
TWENTY —FIVE THOUSAND ( 25,OOO.00)DOLLARS for the payment of Ahich, well and truly to
be made, we jointly and sevetly bind ourselves firmly by these presents.
Tne conditions of the above obligations are such that if the above bound
J.H.CAHILL shall faithfully comply with the attached contract (and the drawings an.d
specifications therein referred to( made and entered into this 19th. day of May,1915
frith the City of South Bend, Indiana, for the construction of the .Michigan Street Trunk
sewer under Resolution No. 367, adopted March 16th.1915 and fulfill all the conditions
and stipulations therein contained, according to the true intent and meaning thereof
in all respects, then this obligation shall be void; otherwise to remain in full force
and virtue in law; and in the event said City shall extend the time for the completion
of said work or alter -said contract -in any respect, such extension or alteration shell
not in any way operates to release the sureties of this bond.
