Tues s day April 20th. ,1915.
Board melt in regular session at 10:00 A.I. All members present.
Chas. R. Jordon of Jordon Company appeared before the Board and asked
permission to close 1st. alley north of Washington Avenue _between :Lafayette Street
and lst. alley east of Lafayette Street, while constructing the Elmer Crockett
Office -building at this point. Permission was granted by the Board to Mr. Chas..R.
Jordon for Sixty (60) €days.
JBids were received and read for garbage wagons. Same was awarded to
the lowest bidder, The Winkler -Grimm Corporation, `-or garbage wagon far tAe sum of
$268.00. This to be according to spe iationsolrid blued prints submitted to them by. Mr.
D.C.Layton, Street Commissioner.
Bond and contract for Brick pavement on Division Street from Michigan:
Street to lst. alley east of Mi�_higan Street, under Improvement Resolution No. 361.
signed by H.N. Barnes, principal and London & Laneashire.Guarantee & Accident Co.
as sureties, was approved by the Board.
Bond and eontraA for constructing and repairing cement sidewalks, Curbs
and for filling and excavating for said sidewalks and curbs, under Improvemnt
Resolution too, 366, signed by H.N. Banres as priniipal and London & Lancashire
Guarantee &-Accident Company„ as sureties was approved by the Board.

Mr. Louis Hammersehmidt appeared before the Board in behalf of Stewart
Sheets Company, Contractors on the Bowman Creek Trunk sewer.
The followin property owners appeared before the Board, Samuel Krueger,
A.M. Russell Thomas Slicnd William a. Crabill, requesting the Board to ask toe
Street Car Company to repair the street whiff. was tarn up by them on North Michigan
Street north of t-ne bridge. Also the placing of some lights on North Shame Drive.

Board met in regular session at 7:45 P.M. A11 members present.
Mr. Goebel, Councilman from the Seventh Ward appeared before the
Board and presented a petition for the Widening of West Indiana Avenue from Prairie Ave
to 'Webster Street on the north side. The same was referred to the City Civil Engineer for
investigation.
Mr. Andrew Seifert, Councilman of the nth. lard' appeared, before the
Board and made complaint about condition of pavement on Eddy Stret:t north of South Bend
Avenue. The Board informed Mr. Seifert that they mould take trip out to see same.
Permission was grated to the West Side Lumber Company to close
thirty five (351) feet of sidewalk on Walnut Street end forty five (45') feet of sidewalk
/on Division Street for the sixty days, until a one story brick building at this point
was built.
Mr. Noland appeared before the Board and presented a petition for
f the Widening of Webster Street from Indiana Avenue to Prairie Avenue. The samewas
referred to. the City Engineer.
Deferred hearing had on Improvement Resolution NO* 367 for the
Trunk sewer on Michigan Street from La Salle Avenue to South Street, In the City of South
Bend, Indiana. A
Upon said hearing no remonstrators appeared and no further remon—
strance wasAfle:Andthe Board being fully advised in the premises decided that the
improvement�ou d be modified by leaving that part of the s werfr�omI��n�r,ie Street
to South Street. The Board finds that 11lie enefits to the�erty�l able" to be assessed

same is hereby in all things ratified, confirmed and approved.
Resolved further, that notices be published on the 23rd. day of
Apri1,1915 and on the the 30th. day of April,1915 in a newspaper of general circulation
in said City, stating that this Board will receive bids for the construction of said ,in—
provements up to 10:00 A.M. on the 15th., clay of Ifa,y,1915. The Board reserves the right
to reject any add all bids.
In regard to deferred hearing on Division Street pipe sewer from
JMeade Street to Olive Street, under Improvemett Resolution No.. 355, The Board decided
that City Civil Engineer Wm. S. Moore made a report at next meeting whether the condition
at Singers Mfg. Compny is releaved.
Deferred Nearing given on roll of damages . and. assessments of benefits
in the matter of Widening of Terrace Avenue tNow:: Angella Avenue) ®en feet on the west
side from Portage Avenue to Woodward. Avenue, Qnder Codemnation Resolution No. 34. In the
City of South Bend, Indiana.
In the above matter no remonstrators appeared and no further remon—
strances were filed.' The Board approved the above roll as follows: —

Land Company gives Ten 101) feet off of and from the east part of Lot Nos. 144,145-146-1
147 and 148 in ennsideration of their not being assessed benefits for said irlprovement.
it is therefore ordered that said assessment of t150*00 should be assessed against real
estate adjacent to and belonging to the City of ouch Bendy And said roll is hereby in
all things ratified, confirmed and approved and all action under Condemnation Resolution
No. 34 is hereby concluded.
Petition presented to the Board for water on Miner Street from
Notre Dame Avenue to St. Peter Street. The same was referred .to the Water'Department.
Petition for grade, curb and walk on Leeper Avenue from'Angella
Avenue to Howard Street. The same was read and'referred to the City Civil Engineer
for investigation.
Petition for ,p.ipe sewer on Corby Street from St. Louis Street to
✓ was read and referred to the City Engineer for investigation.

Regarding tie attached petition for,pavement on Franklin Street �I beg
jro report a total of 92 resident freeholders by counting joint deed as two. Counting
joint deed one there are 58 resident freeholders. The petition has 31 free holders
residing on the street.

Regarding the attached petition for sewer on Olive Street. I beg to
report that I have investigated the matter and find that the petition is not strong
enough to warrant the passage of a resolution. I would recommend that it be referred
back for more signatures.

as -surety was approved by the oard.
JStreet Commissioner reported that Mrs. Robertson promises to
repair the walk on Wayne Street as soon as she unloads a ear of,coal
that is due.
Mr. Rankert reported that he would make the necessary repairs to
1 pavement n Pennsylvania Avenue as soon as he started his asphalt plant Vhich would be
about May 1st.21915.
Street Commissioner reported that. Mr. Bugbee v. ll repair cement
walk at corner of Main and Mayne Street.
Mr. Joseph Swzeda appeared before the Board and stated that walk at
toner of Huron and Pulaski Streets had craeked after first year. The sane was
referred to the City Civil Engineer.
• Tne Uity Engineer submitted the estimated cost of the Micaigan Street
Trunk sewer from La Salle Ave., to Renter of Monroe St. at P509000.00

(92 1/21) feet East of the East line of Fain Street and One Hundred and Eighteen (1191)
feet south of the south line of Washington St., thence vast twehty two (221) feet; thence

Local SEWER IMPROVFIAENT RESOLUTION NO. 376.
f Resolved by the Board of Public Works of trie City of South Bend,
County of St. Joseph, State of Indiana, That the construction of a local sewer, intended
and adapted only for local use by .the property holders nh.ose property abuts thereon,and
not intended or adapted for receiving sewerage From collateral drains be and the same is,
hereby ordered in and along Dale Avenue from Dubail Avenue to Dayton Street as follows,
t o--wit �-
Beginning at the center line of Dubail Avernie and Dale Avenue; thence south
along the center of Dale Avenue to apoint 20 feet south of the south line of the alley
south of Dubail Avenue with a 10 inch vitrified pipe sewer. Together with the neeessa
manholes, inlets, conduits and house connections to the curb line along the line of
said improvement. All as shown on the plans, and in accordance with profiles, detail
drawings and specifications on file in the office of the Department of Public Wors of the
City of South Be -id, Indianan and said sewer, with all its appurtenanees shall be constructed
in accordance with the profile and specifications now on file in the office of the depart-
nent of Public Works of said City. The cost of said improvement shall be ' apportioned
against and paid by the property holders whose property abuts thereonm and upon the City
of South Bend if the City it benefited by said improvement, all according to the method
and manner provided for in an Act of the General Assembly of the State of Indiana, entitled
"An Act Concernin:_; Municipal Corporations, approved March 611905. Assessments, if deferred
are to be paid in ten equal annual installments, with interest at the rate of Six per cent
per amium. A bond or bonds. shall be issued to the contractor in payr•. ent for such work.
_unless the property owners pay said assessments before said bond or bonds are issued. Under
no circumstances shall the City of South Bend be or be held responible for any sum or sums
due from said property owner or owners for said work, or for the collection of same,

No. 377,
f BE IT RES'1LVED BY THE BOARD OF PUBLIC WORKS. of the City of South Bend,
St. Joseph County, State of Indiana, that it is desired and deemed necessary to,im-
prove Fuerbri,nger Street from Cottage Grove Avenue to Sherman Avenue as follows,to-wi*
By grading and paving the roadway, also grading and paving the road-
way of all intersecting and entering streets and alleys; lying within said portion
of said Fuerbringer Street not included in the roadway, to be improved with ASPHALT
BITULITIJIC,ASPHALTIC CONCRETE: CREOSOTED WOODEN BLOCKS OR BRICK LAID on C. five (5)
inch Portland Cement Gravel Concrete Foundation. Or with Brick laid on a `six (6)
inched rolled Gravel Foundation. Plscing the necessary ma£sginal cement curb, curbng
the roadway with cement curb where same is not already constructed. Also the con-
struction of the necessary storm water inlets and conduits. All as shown on the plans
and in accordance with the profiles, detail drawings and specifications on file in
the office of the Department of Public Works of the City of South Bend, Indiana.
The cost of the improvement herein provided for, except street and
alley intersections, shall be paid by special assessment to be levied upon the pro-
perty specially benefitted, to the amount that the same may be legally assessed
therefor, in accordance with an Act of the General Assembly o the State of Indiana,
entitled "An Act Concerting Municipal Corporations," approved March 61,1905, and in
accordance with and pursuant to the provisions effi all acts amendatory and supplemntal
thereto,
The cost of all street and alley intersections., Including one-half
of the width of the improvement opposite street and alleys which run into, but do not
cross said roadway herein proposed to be improved -and that portion of such street or
alley abutting upon property belonging to said City, or upon property not subject to
such assessment , shall be paid by the City in cash out of its general fund, if able
too do so, or from a fund created by a special assessment to be levied under the pro-
visions of Seetion 109 of the above entitled Act.
Assessments of ten dollars and More against ea,chlot, if deferred,
are to be paid in ten equal annual installments, with interest at the rate of Six per
cent per annum. A bones or bonds will be issued to the contractor to the amount of
such deferred assess:rients in pro 17ata payment for such improvement.
Under no circumstances shall the City of South Bend be, or be
held responsible for any sum or sums due from said property owner or owners for said
work, or for the collection of the same, or for the pa:yrhent of any bond, bonds, certi-
ficate or certififeates, issued to said contractor in payment for such vo rk, except
for such moneys as shall have actually been received by the City fm m the assessments
for such improvement, or such moneys as said City is by said entitled Act and amen-
merits and supplements thereto required to pay.- All proceedings had, and work done
in the making of said improvement, assessment of property, collection of assess-
monts and issuanee of bands therefor, small be as provided for in said above entitled
Act and Acts amendatory thereof and supplemental thereto.
