I. -A11 members present. / Bids were received,opened and read for pipe sewer on Grant Street.. The same were referred to the City Engineer for tabulation to be reported orted back at 7.45 P.M. this 30th. day of Marchm1915. Complaint received from Chief of Police Kerr in regard to the condi— tion of the Attic of the City Hall. The janitor was instructed to clean sane. The fallowing excavation bonds for the sum of One Thousand Dollars ( $1,000.00)was approved by the Board. Fred P. Futter as principal and Southern. Surety Company of St. Louis Mo. as sureties. Henry De Vos, as principal and united States Fidelity & Guranty Co. of Balttmorq Maryland as sureties. Thos. williams, as principal and United States Fidelity & Guaranty J Co. of Balitmorem Aid. as sureties. Jacob M. Your Petitioner Gaylord H. Case says that he is the Secy. of the Farmer's Securtities C0.9 a corporation that Owns the tract of land,, 99 feet wide by 165 feet long at the corner of .South Main Street, and East Jefferson Boulevard in said City. That said Company is now engaged in building a modern office building upon said land. That in order to erect said building it will be necessary that said Com- pany use and blecade the alley in the rear of said property., That the said Company at this time is actively engaged in building said office building, and that if said alley is closed for,a reasonable length of,time, said company can erect s&id buuldinng , and 41.-at after said building is erected, said Company will leave said alley in as good a condition as it formerly was. Complaint was rece'I"ved from Ralph N. Hewson in regard to pales and _guy wires on, Woodward Avenue. The same was referred to Mr. Thus Beaning for investigation. Resolution ordered for pavement on Vassar Avenue from Woodward Ave to 1 Portage Avenue. Petition filed with the Board for a pavement on Franklin Street from fW. Sample Street to W. Calvert Street.. the same was referred to the City Engineer for investigation. Change of grade on Dubeil Avenue between High Street and Dale Avenue ✓ was approved by the Beard. By unanimous consent of the Board the resolution nor the improvement of IVAllen. Street fromOkk Street to Van Buren Street -is hereby reconsidered and all previous action rescinded, on account of majority of remonstrabee being; on file. Contract for pipe surer on Grant Street from Division Street to Huron, Street was awarded to He;lry De Ves. In. regard to the hearing on the assessment r;ill for thewir-erring of Terrace Avenue from Woodward Avenue to Portage, the Board decided to de.f'er all ,action on same until Tuesd4y April 6th.11915 at 7:45 P.I. The City Engineer made reprt regarding the complaint of Vincent Jastro :eski relative to defective sidewalk at the SE corner of Huron Street and Pulaski Sts, hat he finds two blacks defective. The Board instucte3d the Clerk to notify Joseph Szweda contractor on said work to make tie necessary repirs at once. JOSEPH COUNTY,STATE OF INDIANA, That it is desired and deemed necessary to improve the FIRST ALLEY EASE' OF ST. JOSEPH STREET FROM" WAYN'E STREET TO THE FIRST ALLEY SOUTH OF WAYNE STREET: as follows, to -wit: - By grading said First Alley east of St. Joseph Street from Wayne Street to the First Alley south of Mayne Street from property line to property line, and paving siad Alley its full width, *ithASPHALT,ASPHALTIC ONCRETE,. BE IT FURTHER RESOLVED. LOCAL SEVER IMPROVEMENT RESOLUTION NO. 369. / Resolved by the Board of Public Works of the City of South Bend, County of St. Joseph, State `of, Indiana. That the eonstruct-ion of a local suer, .intended and adopted only for kcal, use by the property holders whose property abutsthereon, and not intended , &3r adapted for receiving sewerage from collateral drains, be and the same is. hereby ordered in and along Fellows Street from Dubaii ,Avenue to the First Alley south of Dubail Avenue as follows,to—wit:t Beginning at the center of Dubeil Avenue and Fellows Street thence south _along the center line of Fellows Street to the north line of the First Alley south of Dubai:l .Avenue with a 10 inch vitrified pipe serer. Together with the `'neces— sary manholes, inlets,. conduits and house connections to the . eurb line along the lie line of said improvement. All as showa on the plans, and in accordance with the profiles, detail drawings and specifications on file in the office of the Departrent of Public WorKs of the City. of South Be>Id, Indiana. And such improvement is now ordered and said sewer, with all its apur— tenances s1gall be. constructed in accordance with the profile and specifications now on file in the office of the Department. of Public ®Forks of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is bene— fited by said improvement, all according to the method and manner provided for in Act of the General Assembly" -.of the State of Indiana, entitled,"An. Act Concerning Municipal Corporations," approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual imstallments, with interest at the rate of Six per cent per annum. A bond or bonds shill be issued to the contractor in payment for such work unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from paid property owner or owners for. said work;., or for the collection of samep or for the payment of any bond or bonds, certificate or certi— ficates issued to said contractor in payment for such work, exopt fornsueh moneys as shall have been actually received by the City from the assessments for stch improvement, or such moneys as said City is by said above entitled "Act required to pay. All proceedings had, and work done in the making of said improvement, assess— ment of property, collections of assessments and issuance of bonds theeefor, shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the 5th day of April 1915 and on the 12th, day of April,1915 in the South Bend Daily Tribune.
