All members present. - Delegation 6f Property holders on Mishawska Avenue.appeared before the Board relative to the petition which was filed with the Board on March 2nd-1915 for a pavement, " on said.street-.- The Board took this matte-r under advisement for -one week until Tuesday March 23rd.1915. at 10:00 AiM. Petition was presented to the Board for the condemnation of the SEly. corner of La .Porte Avenue and La Salle Avenue. The same was read and 'Placed on ,/file, to be taken up at meeting Tuesday March 23rd-.1915 at 7:45 P*M. Petition filed with the Board by 1ft* Goebel, Councilman a 7th, hard for cement `sidewalks and curb on east Dubail Avenue from -South High Street to V'Slo. Dale Street. The same was ordered in on both sides under Various Street Resolution No. 366. Hearing given on Condetmation Resolution No. 34 for the purpose of appropriating a strip of land foythe Widening of Terrace Avenue from Portage Avenue /to Woodward Avenue, In the above matter the Board decided to defer all action on same until Tuesday March 23rd-1915 at 7:454P.M. The Board instructed the Clerk to send. out notices for the Opening of William 'Street from Colfax Avenue to Navarre Street under Condemnation Resolution /No., 09. The date for said hearing to be May llth.21915 at 7:45 P.M. The following resolution was.approved by the Board. It is hereby resolved by the Board of Public Works that all other resolutions for the improvement of Michigan Street by trunk sewer from La Salle Avenue t-o South Street are hereby re.scidded. Anjuriously -or beneficially affected thereby, as shown by the heavy -boundary lines marked on said nap and drawings, with pro— per words and figures written thereon, clearly indicating what said fteavy boundary lines represent, and the district or area embraced thereby. Assessment's if deferred, are to be paid i n ten equal anual installments., with interest at the rate o six per cent per annum. A bond or, bonds shall be. issued to the contractor in payment for said work, unless the property owners. pay -said assessments before said bond pr bends are issued. Under no cir— cumstances shall.. the .City of South Bend be or be held responsible for any sum or sums due from said property owner or tpwners for said work, or for the collection of the same, or for the pay -went of any bond, bonds, certificate or'cert~fifcates issued to said contractor in payment for such vork, except for etuch moneys as shall have been actually received by said City foam the assessments for such impovements. All proceadi ngs had and work done in Vie ccnttruction of sadtd maim sewer and its appurtenances, manner of assessment of property collection of assessments and issuance of bonds therefor, shall be as provided for ina,n Act of the General Assembly of the State of Indiana, entitled *An ,Act Concerning Municipal C®Tp orations," in matters pertaining to the cons tian, alteration and.maintenance of public drains acid sewers, providing for the construction, alteration and maintenance of such sewers and drains in such cities and within four.Miles .thereof, also providing for the assessment of property specially benefitted thereby for the payment thereof, in whole or i peat, and. for the collection of such assessments; repeali ng all laws and parts of laws in conflict therewith, and declaring an emergency, approved March 6,1905, and all acts supplementary and amendatory thereto, passed by the General Assembly of the State of Indiana. Notice of this resolution shall be published on the 20th. day of March.1915 and on the 27th. day of March21915 in the South Bend Daily Tribune. The sidewalks on the north side of Lin6oln Way Wiest from Taylor St.to Scott Stteet being in very bad condition, water standing on same for several days a,f ter a rain.
