595 -Board met in regular.se_ssion at 10:00 A.M. All members present. ✓ Mr. Joseph Eckman :_ and Mr.' Dudley""M.; Shively. Mr. Beitner and Mr.. Fulk appeared before the Board in regard to their ass'essnent on the Bowman "Creek Trunk sewer. Permission was granted the Central Union Telephone Company to set one pole on the west side of alley north of Van Buren Street between Diamond Ave -and Howard Ave. The following guarantee bonds were approved by the 'Board. V/Resurfaeing of South Lafayette Street from Sample"Street to a point 281-1/2 ft.-north of the north line of Tutt Street, by Rankert & Eggleston, for Five hun red ninety seven Dollars and twenty six cents (597.26) ,/Cedar Street from Emerick St to Eddy Street, by Rankert & Eggleston for......q.2,173.00) /Johnson Street from Michigan Avenue to Vassar Avenue, by Harry N. South Bend, v a The Grand Trunk Western Railway Company respectfully shows to the Board that its main track bridge over St. Louis Street in the City of South Bend is in need of addi— tional support by reason, first, of the age of the girdersf. and second, of the heavy equipment which is now being used upon road and over the bridge; that the said bridge was originally supported by two bents inside the curb line, resting on a masonry foundation and that it has heretofore placed an additional bent of piling on the west side of the street about eight feet east of the west bent; and that in judgement of its en gsneers an additional bent of piling or frame work should be placed on the eadt side of said .street about six feet west of the east bent; that,the safety of the public requires that this precaution be. taken at once and it therefore requests permission to install such bent After the installation of such additional bent, there will be a clear space of eighteen feet for public travel between the bents GRAND TRUNK WES TERN RAILWAY CO. Contract for the supply of Electric bulbs to be used by the City for the ensuing year was approved by the Board with the Brilliant Electric Division. J -Deferred,hea3ring had Qn Improvement Resolution No. 337 , f'or pavement on Diamond Avenue from Michigan Avenue to No^th line of Cushing's 5th. addition In the City of South Bend, Indiana. Upon said nearing remonstrators appeared, but no further remonstrance was filed. The Board having said matter under advisement find by unanimous con- sent that the remonstrance filed July 14th.1914 should be sustained and that the resolution should be and the same is hereby and in all things rescinded. ]Deferred hearing had on improvement Resolution No. 333 for the Jpavement on Allen Street from Oak Street to Van Buren Street ln�7,the City of South Bend, Indiana. Upon said hearing remonstrators appeared but no further remonstrance was filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated -cost of -the same, as reported by the City Civil Engineer, and there- upon takes final action on said resolution as originally adopted, and the same ;s °hereby 1n all things ratified, confirmed and approved. Resolved further, that notices be published on the 1. day of r,���i:•c:i,1915 and on the a day of March,1915 in a newspaper of general circulation in said City, stating that this Board ,will receive bids for the construction of said improvements up to 10:00 A.M. on the - day of April,1915 The Board reserves the right tar reject any and all bids. Deferred. hearing had on Improvement Resolution No. 361. for pavement / on Division. Street from Michigan Street to St. Joseph Street. In the City of South d $en.d, Indiana,. Upon said hearing no remonstrators appeared and no remonstrances were filed. And the Board being Hilly advised in the premises, decides to modify the .above resolution to read as follows: Pavement on Division Street from Michigan Street to the lst. alley east of Michigan Street, and decides that the benefits to the property liable to be .assessed for said improvements are equal to the esti- mated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as modified and the same is hereby in all things. ratified, aD nfirm- ed and approved. The same referred t�o the•,=Street Commissioner for investigation. Petition filed with the Board lfy property owners on Michigan Street for the construction of a trunk sewer and pavement on Michigan Street from La Salle Avenue to' Monroe Street this year. Resolved by the Board of Public Works of the City of South Bend, St. State of Indiana, That it is deemed necessary to improve; Various Streets That an improvement be made of the kind, size, location and terminal points as follows: — That bids be received fvr the construction and repairing of cement side —walks, curbs, and for filling and excavating for said sidewalks and curbs, on different streets in said City, where the same have already been partly constructed or arendefectively, constructed. All such work to be done after the owners of bbutting property Mve been ordered -R-nd-notifie-d -to construct or repair such sidewalks and curbs for a period of 30 ,days from the. date -of anysuch. notice. All work to be constructed or repaired in accordance with standard specifications on file in the office of the City -Engineer of said City. All work to be..done and assessments made as provided in Section 1 of an Act entitled "An Act Concerning Municipal Corporations, approved 1909, at pages "412-418." in accordance with the profile, details, drawings and specifications, on file in the office of the Department of the Board of Public Works ofsaid City; and such improvement is now ordered. The cost of said improvement, including the cost of street and alley 41-ersections, shall be assessed upon the reel estate abutting on said Various Streets all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled "An Act Concer ing Municipal Corporations," approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and sup— plemental acts thereto, passed by the General assembly of the State of Indiana. Assess — meats, if deferred, are to be paid in ten equal annual installments, =xitb. interest at the rate of Six per cent per annum. A bond or bo ds . shall be issued to the contractor in payment of such work, unless the property owners pay said assessment before said bond 'or bonds are issued. Under no circumstances shall the City of South Bend, be, or be held responsible for any sum or sums, due from said property owner or owners for said vark or for the collectia n of the same, or for the payment of any bond, bonds, certificate or certificates.$ i sued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above Act regz ired to pW . All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance ff bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Notice of this resolution shall by published on the 1 th. day of March, 1915 and on the 20h. day of March,1915 in the South Bend Daily Tribune. This Board will receive sealed proposals in their office in the City Ha 1 on the 6th. day of April,1915 at 10.:00 A.M. for the execution of the aforesaid work.
