Board met in regular 'session at 10:00 A.M. All members present.
The matter of enforcing the smoke Ordinance, and the contract for
,"'heating the Oliver Hotel which was fildd with the Board on Tuesday January 5th.,1915
was discussed by the Board with the Mayor.
The following communication was recei ved from Eli. Seebirt, City Attorney, read and
pla ced on f :ile .

In re:- Contract of Stewart Sheets * ConpanyfM� co _str r,tion in
of Bowman Creek sewer.
I.advise you as follows in regerence to the following clause in
said contract.
"The above proposal includes the
132 feet of 72-inch cast iron pipe
as pr specifications. It also
includes latteral connections from
10 inch to 36 inch."
This langu,--ae seems yo be very ambiguous and is certainly sus—
ceptible to two interpretations, It seems to be the settled law.that municipalities,
through their authorized officials, can settle and adjust disputed questions, parti--
cula.rly if said adjustments and settlements are made in good faith and in an honest
doubt as to the construction of a contract.
I Believe that a. compromise made between the contractor end your
board would be sustained by the courts.

Permission wes granted Indiana & Michigan Electric Company to set
pole and anchor as follows: -
To set 1-501 pole in the southwest corner of first alley east of
Michigan Street on Tutt Street, this to be used jointly with the Central Union Tel. Co,
and to be placed inside of the curb.
To set anchor on the east si, e of Park Avenue on the north property
line of 840 Park Ave. and south of water pipes now there.
Communication received from the Wrlsbach Street Lighting Company fff
America relative to two lights recently ordered placed in giver Park. The same was read and
V/placed on file.
Communication received from Indiana & �i iciiigan Elec Company
p/relative to the location of lamps. The same was read and placed on file.
Application for the setting of a billboard on Portage Pvenue
on lot 143 by the South Bend. Billposting Company was approved by the Board.
Petition received from property owners on Kemble Avenue and
Ewing Avenue fro a street ligrit The same was read and referred to the Street
Commissioner for iirrestigation.

The Board ordered that the india.na & Micnigan Electric Company be notified
to place electric lights at the following places: —
one 0 candle power incandescent liFf�ht on post at northeast corner of
Hasler's Fruit Company building on South Scott Stret.
Cut out Arc light midway between Chapin Street and Scott Street on Ford
Street and place instead one c30 candle power incandescent light.
One f30 candle power f2ncandescent light on corner of Ford Street and Scott St
One 90 candle power incandescent light at corner of Scott and Orchard St.
One 80 candle power incandescent light on Scott Street at alley between
Orchard and Ford Street. Cut out arc light on Orchard. Street midway between Scott
end -Chapin .Streets and place inst-ad one F0 candle power incandescent lig'�t.
One 90 ce idle power incandescent light at jog on East Calvert Street one
block east of Miami Street.
One are light at corner of Williams Street aid Blanche Street.
One 80 candle power incandescent light at corner of Portage Avenue end
McCartney Street.
One are light two blocks west of Ant_;ony Street on Division Street.
90 candle power light on Kalarama Avenue and Hill Street.
90 candle power light on Miner Street and -Eddy Street.

Board met in regular session at 7:45 P.M. All members present.
✓ Hearing given on assessment roll and final estimate for pipe sewer
on Dayton Streit from tiWitwer Avenue to Miami Street, under Improvement Resolution
No. 362. In the City of South Bend, Indiana.
In the above ma tter no renonstrators appeared and. no remonstrances
were tiled. Tile Board therefore Find t,at the property assessed Li sc-id roll filed
December 22n.d.1914 is benefitted in the amount of assess exits as shown on said rolls, and -
the Board further find that the assessment roll filed December 22nd. 1914 and the
Final estimate allowed December 22nd. 1914 should be and the same are hereby in all things
ratified, confirmed a 7._-
d approved by unanimous consent of the Board.

✓ College Street from Lincoln Way west to Vassar Avenue, under Improvement Resolution
No. 362, In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances
.were filed. The Board therefore find that the property assessed in said roll filed
December 22nd..1914 is benefitted in the amunt of assessments as shown on said rolls,
and the Board further find that the assessment rolls filed December 22nd.1914 and
the final estimate allowed December 22nd.1914 should be and the same are hereby in all
tings ratified, confirmed and approved by unanimous consent of the Board.
Hearing on assessment :rolland final estimate for Brick pavement on
Johnson Street from Michigan AveTlTue to Vassar Avenue, under Improvement Resolution
No. 343. in the City of South Bend, Indiana.
In the above' matter two property owners appeared, but no written
remonstrance was filed. The Board therefore find that the property assessed in said
rolls filed December 22nd.1914 is benefitted in the amount of assessments as shown on
saT.,'' rn]_ls, and the Board further find that the assessment roll tiled December 22nd.
1914 and the final'estimate allowed December 22nd.1914 should be and the same are
hereby in all things ratified, confirmed and approved by unanimous m nsent of the
Board.
The following resolution was adopted by the Board.
Resolved with reference to Improvement Resolution No. 360 dor pipe
sewer on Nineteenth Street from St. Joseph River to Mishawaka Avenue, that the notice
for the letting of said -contract be -re —published and that said notice be published on
January 29th. ,February 5th. and February 12th. ,1915 in a newspaper of general circulation
in said City, stating that this Board will receive bids for the construction of this
improvement up to 10:00 A.M. on the 23rd. day of February,1915 The Board reserves the
right to reject any and all bids.
