to Portage Avenue, I beg to report that no petition was filed asking for a di 'ferent
kind of pavement from that specified by the Board in your preliminary order of
Sept., 8th.,1914.

The following resolution was unanimously adopted by the Board.
The City Engineer having reported, in the matter of the Improvement of
the roadway of Cottage Grove Ave. from Michigan Ave. to Portage Avenue, 1.under
Improvement Resolution No. 33591914 that no petition was filed by the resident free-
holders whose'property abuts upon said street asking to have the street paved with
any other kind of material other that the kind specified by the Board, w ieh the
Board finds is true, and Improvement Resolution No. 335 1914 ,heretofore adopted,
is in all things approved and confirmed, said portion of said Cottage Grove Ave.
is hereby ordered improved with Sheet Asphalt, in accordance with the plans and
specifications heretofore adopted.

cents ($114.99) for one years maintenance on Marion Street Brick_ pavement, signed by
Hoban and Roach, was approved by the Board.
Bond and contract for the resurfacing of Marion Street with 3"
Bituminous Macadam from west line of St. Joseph St. to E. line of Lot 6 Hammond &
✓'Whitcomb Addition, under Improvement Resolution No. 339, signed by Hoban & Roach
as principals and The Fidelity and Casaulty Company of New York fl.$ sureties, was
approved by the Board.

Indiana Avenue,under improvement Resolution No. 325 for the amount of ...... $342.04
Partial estimate allowed Staples and Ackerman,Cont;ractors for the
sewer on Donald Street, under Improvement Resolution No. 321. for the amount of $372.71
Communication received and read from the Southern Ohio Vault Company
acknowledging order for grave vaults for the City Cemetery. The same was placed on
file.
Complaints about defective crosswalks, sidewalks and railroad crossings
received from Wm. Goebel, Councilman of the 7th. Ward, was reported on by the Street
Commissioner as follows:—
In regard 'to new cross walks at Indiana & Scott, Indiana and Taylor,
/ Indiana and William Street and India a and Franklin Street. Same is on list to be
prepared.
Cross walk in bod con ition at Corner of Stull and Franklin. Same is
✓ repaired.
Defective brick walk at 233 E. Paris Street. The above has been re—
paied and is sufficient for the present.
Defective brick walk at 210 E. Ohio Street. Sidewalk reported below
grade, but Fairly smooth.
Repair crosswalks at Indiana Avenue and Kendall Street, Michigan Central
R. R. and Kendall Street, MichigAn Central Ry. and Kimble Avenue, Indiana Avenue .and.
Franklin Street. Reported that the Michigan Central Ry. Vompany_ are working on the
above. Crosswalks will be repaired in about two days.
Brick walk in bad condition on account of tree roots at 4-09 E. Wenger
Street. The above was reproted as raised some, by -roots and needs some repairs.

On motion du!y made and seconded, the following preamble and.resolutions sere
unanimously adopted.
WHEREAS. This Board did on the °4th. day of August,1914. deem `it expedient and
of public utility to permanently improve Johnson Street etween Michigan Street and
and Vasuar Avenue, by paving the roadway of the same, and did on said date pass and
adpt a resolution authorizing said permanent -improvement, and
WHEREAS. The City Engineer has prepared and filed with this Board a report
showing the number and location, as well as the material to be -used and the manner of
laying the same, of the service pipes, mains, conduita, laterals and connections which
are, or will be necessary to accommodate -the abutting property owners with gas, water,
heat, steam or any other product -for which any persons, firm or corporation has been
granted a franchise for supplying the Citizens of the City of South Bend, Indiana,
which is as follows::

And be it further Resolved, That it is contemplated by this Board to Amprove
Johnson Street from Michigan Avenue to Vassar Avenue, all in said City of South Bend,by
water, sewer and gas connections, and that it is , and is hereby so declared necessary
for the Northern Indiana Gas & Electric Company, whi h has, and operates under a franchise
from said City to supply gas to the citizens of said City, to provide and install mains,
service pipes and connections are hereby declared necessary for the immediate use of said
Company in supplying gas to the owners of property abutting upon said part of,said street.

so delcared, necessary forthe Northern Indiana. Gas & Electric Co mpany, which
has, and operates under, a frnachise from said City to supply gas to the Citizens
of said City,to provide and install mains, laterals, service .)ipes and connections
for gas in said part of said Street, of the description, location an number
set forth in said report of said City Engineer, which mains, service pipes and
connections are hereby declared necessary for the immOdiate use of said Company
in supplying gas to the owners of property abutting.upon said part of sd d Street.

Hearing; given on Improvement Resolution No. 350 for pipe sewer on
Fellows Str"et from Dubail A venue to lst. alley North of Dubail Avenue. In the City of
South Bend, Indiana.
Upon said hearing remonstrators appeared and remonstranced against said
improvement being put in this fall. But no further written remonstrance was filed.
( One Aiaving been filed September �Sth. ,1914.) And the Bard being fully advised in the
premises, decides that the benefits to property liable to be assessed for said improve—
ments are equal to the estimated cost of the same, as reported by the City Civil Engineer
and thereupon takes final action on said resolution as originally adopted, and the same
is hereby iri all things ratified, confirmed and approved.
Resolved further, that notices be published on the 17th. day of March,1916
and on the 2 cay of March,19150 in a newspaper of general circulation in said City,
stating that this Board will -receive bids for the construction of said improvement up to
10:00 A.M. on the 6th. , day of April 1915. The Board reserves the right to reject any
and all bids.

to property liable to -be assessed for said improvements, are equal to the'estimated
cost of the same, as reported by the City Civil Engineer, and thereupon takes final
action on said resolution as originally adopted, and the same is hereby in all things
ratified, confirmed and approved.

for the purpose of vacating a part of the proposed William Street . In the City of
South Bend, Indiana.
JThe Board having the above matter under consideration decided to modify
said resolution as follows:- Beginning on N9 th line of Marion Street at a point..
33 feet West of Southeast corner of Lot 57 Henrick's and Grants Addition; thence
northerly to a point in center of old Kankakee Mill Race a distance of 39.3 feet
west of east line of said ,lot 57 Henrick's & Grant's Addition; thence north parallel
with and 3.3 feet west of E. line of Lot 7 Burrough's Sub. Div. of Bank Out Lot
115 to the north line of said lot 7 which point is south line of Short Navarre St.
Thence west along south line of Short Navarre Street 10-7/10 feet;thence .ouch
pararell with and 49 ft. West of the E. line of said Lot 7 and the East line of
Lot 57 Henrick's and Grant's Addition to the North line of Marion Street; thence
east along the North line of said Marion Street 16 feet to the place of beginning$
and the Board declare the above described property in all things vacated and this
resolution -in all things raTiried, confirmed and approved.
Regfved further, that the Oily Engineer, be instructed to prepare
a roll showing awards of damages end assessments of benefits to all parties and
properties interested in the above matter.
JHearing given on Assessment roll and final estimate for Asphaltic
Concrete Pavement on Cedar Street from Emerick Street to Eddy Street, under
Improvement Resolution No. 295. In the City of South Bend; Indiana.
In the above matter remonstrators appeared remonstrating against
their assessments, but no written remonstrances were filed. The Board aster due
consideration find t'nat the property assessed in said roll filed August, ."th.
191A is benefitted in the amount of assessments as shoirn on said rolls, and the
Board f'utier find that tn.e assessment roll filed August 25th. ,I" 14 and the final
estimate allowed August 25th.,1914 should be and the same are hereby -in all things
ratified, confirmed and &,)proved.
Hearing given on assessment rol and final estimate for curb and
vaalk on Pennsylvania; Avenue from TUi Stre�7.t to Iviiami Street, under Improvement,
Resolution No. 310. In tie City of South Bend, Indiana.
In the above matter no remonstratiors appeared and no written re-
rionstances were filed. The Board therefore rind that the property assessed in
said roll filed August 25th.,1914 is benefited in the amount of assessments
as shown on said rolls, and the Board fu„ r,er find that the assessment roll filed
August 25th,,1914 and the final estimate allowed August 25th.,1914 should be and
the same is hereby in all things ratified, confirmed av, i apl roved.

ORDER SELECTING KIND OF PAVE.IKETNT.
Concerning the Improvement of the roadway of Johnson Street From
Michigan -Avenue to Va.ssp:r Avenue,in pursuance of Improvement Resolution No. 3431,
the preliminary order for the improvemefat heretofore adopted is hereby confirmed.
The Board now orders that so much of the said street is improved with
Nelsonville Block Brick and awards the contract to Harry N. Barnes he being the lowest
and best bidder.

The City Engineer reported as follows on petition for pipe sewer on College Street
from Michigan Avenue to Vassar Avenue-.

STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 361.

Be It Resolved by the Board of PUblic Works of the City of South Bend,
St. Joseph County; State of Indiana, Tiat it is desired and deemed neee'ssary to im-
prove Division Street from Michigan Street to St. Joseph Street, as follows,
1. The cost of the imrovement herein provided for, except street and alley
intersections, shall be paid by special assessment to be levied upon the property
specially benefitted, to the amount that the se may be legally assessed therefor,
in accordance -with an Act of the General Assembly of the State of Indiana, entitled
" An Act Concerning Municipal Corporations, " approved Mgrch 6th.21905, and in accoNd-
ance` with and pi).rsuant to the provisions of all acts amendatory and supplemental
thereto.
The cost of all street and alley intersections, including one -hall" of the
widtii of the improvement oppoiste street and alleys which run into, but do not cross
said roadway herein proposed to be improved and that portion. of such street or a! --Ley
abutting upon property belonging to said City, or upon property not subject to
such assessment, shall be pair by the City in cash out of its general fund, if able
to do so, or from a fund created by a special assessment to be levied under the pro-
visions of Section 108 of to above entitled Act.
Assessments of ten dollars and more against each lot, if deferred, are to

moneys as shall have actually been received by the City from the assessments for
such improvement, or such moneys as said City is by said entitled Att and amendments
and supplements thereto required to pay. All proceedings had, and work done in the
making of said improvement, assessment of property, collection of assessments and is-
suance of bonds therefor, shall be as provided for in said above entitled Act,and
Acts amendatory thereof and supplemental thereto.
BE IT FURTHER RESOLVED. That the Board of Public Works fix the 20th.
day of Octber,1914 at the hour of 7:45 P.M. at the office of the Board of Public
Works, of this City, as the time and place for the public consideration of said pro-
posed improvement, at which said Board of Public Works will hear axdx all persons
interested, or whose property is liable to be assessed for said improvement and
will decide whether the benefits to the property liable to be assessed for said im-
provement will equal the estimated cost thereof.

Resolved by the Board of Public Works of the City of South Bend, County
oi: St. -Joseph, State of Indiana. That the construction of a local sewer, intended and
adapted only for.local use by the property -holders -Whose property abuts thereon, and not
intended or adapted for receiving sewerage from colateral drains, be and the same is, hereby
ordered in and along College Street, from Lincoln Wavy West to Vassar Avenue as follows
to —wit:—

Beginning at the center of Linooln Way West and College Street; thence north
along the center of College Street to the center of Quincy Street with a 15 inch vitrified
pipe sewer, thence still north along the center of said College Street to the center of
Vassar Avenue with a 12 inch vitrified pipe sewer. Together with the necessary manholes,
inlets, conduits and house connections to the curb line along the line of said improvement.
All as shown on the plans; and in accordance itch the profiles and detail drawings on
file --n the off ice of the Department of Public Works of the City of South Bend, Indiana,
and said sewer, 'with all its appurtenances shall be constructed in accordance with the

The City Engineer submitted the list of property owners in the ma r of
fthe appropriation of certain property under Condemnation Resolution No. 30, as per
resolution for Condemnation on Page 351 Record 5, which list includes the names of
the owners and holders of property and of interests therein sought to be taken or
beneficially or injuriously affected, and the description of the serveral pieces of
property which is -affected by the said appropriation proceedings.
Thereupon the Board proceeded to award the damages sustained and to
assess the benefits accruing to each piece of property upon said list.
It was thereupon, upon motion duly made and seconded and unanimously
adopted, resolved that said list, together with the amounts of benefits and damages
and net benefits and net damages therein set ,forth as to the servera-1 parcels of land
be adopted and the respective amount of benefits contained in said list be and are
hereby assessed against the serveral tracts of land as specifically set forth in said
list, and that the respective amounts of damages contained in the said list be and
are hereby awarded to the serveral tracts of land as specifically set forth in said
list, and that the net benefits or net damages, as the ease may be as to the respectie
tracts of land, contained in said list are hereby awarded or assessed, as the case
may be as to the several tracts of land.
The Board hereby further sets off the benefits and damages each against
the other where both benefits and damages are assessed against the same piece of pro-
perty, tract of land or interest , and hereby fixes said respective net benefits
as the amount that shall be paid by the respective owners as benefits, and further
hereby fixes the respective net damages as to the several tracts as the amount that
shall be paid to the owners of the respective tracts as damages.
Thereupon, upon motion duly made and seconded and unanimously adopted,
the 24th. day of November,1914 at 7:45 P.M. was fixed as the day on which this
Board will receive or hear remonstrances from persons with regard to the amount of
their respective awards or assessments, and the Clerk of this Board was instructed
to prepare and cause to be duly and legally given, notices to the Owners of each
parcel of property, showing the amount of the assessment or award, with a descrip-
tion of the property affected, and the date of said hearing.
