AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY GENERALLY LOCATED BETWEEN ROGERS
STREET ON THE NORTH, WASHINGTON STREET ON THE
SOUTH, OLIVE STREET ON THE EAST, AND KALEY
STREET AND KALEY STREET EXTENDED ON THE WEST,
CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED By the Common Council of the City of South Bend,
INDIANA:
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification
of the following described real estate in the City of South Bend, St.
Joseph County, State of Indiana:
Lots 5 through 9, 13 through 15, 24 through 28, 36
through 43, 49 through 51, 54 through 59, 68 through
75, 80 through 89 north of Washington Street, and 90
through 96 West End Subdivision, Portage Township,
City of South Bend, St. Joseph County, Indiana;
Lots 2 through 20, 33 through 50, 53 through 65, the
east 12 feet of Lot 66, Lots 69 through 72, Lots 85
through 96, and Lots 98 through 104 Kaley's 1st
Subdivision, Portage Township, City of South Bend,
St. Joseph County, Indiana;
Lots 109 through 124, 201 through 214, and the north
64 feet of Lots 215 and 216 Kaley's 2nd Subdivision,
Portage Township, City of South Bend, St. Joseph
County, Indiana; and
Lots 217 through 232 Kaley's 3rd Addition, Portage

SECTION II. This ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the mayor,
and legal publication.

Indiana to amend the zoning ordinance as herein requested.

North, Washington Street on the South, Olive Street on the East, and Kaley 5treet and
Kaley 5treet extended on the West
Dear Mr.Kelly:
Attached, is a proposed ordinance that was initiated by the Area Plan Commission at its
meeting of March 18, 1997. The purp ose of this ordmance is to rezone single family areas
that are �resently improperly zoned. The rezoning of this area will provide zoning protection
for the single family homes located in this area. Please place this proposed ordinance on the
April 14, 1997, Common Council meeting for first readmg.

Dear Council Members:
The above referenced ordinance initiated by the Area Plan Commission was legally
advertised on April 3, 1997. The Area Plan Commission at its public hearing on
April 15, 1997, took the following action:
Upon a motion by Bruce Huntington, being seconded by Beverly Crone and carried,
the proposed ordinance initiated by the Area Plan Commission to zone from "B"
Residential, °A" and "B" Height and Area, "C" Commercial, "C,D, and F" Height and
Area, "D" Light Industrial, "C" and "F" Height and Area, and "E" Heavy
Industrial, ��F" Height and Area to "A° Residential, "A" Height and Area, property
located generally between Washington Street on the south, Roger Street on the
north, Olive Street on the east, and Kaley Street and Kaley Street extended on
the west, City of South Bend is sent to the Common Council with a favorable
recommendation. The initiation of this rezoning plan is based on the large
number of inconsistences of existing uses with the present zoning district
designations. A large portion of the properties within the petition area are
single family homes that are currently zoned "B" residential, °C" commercial and
"D" light industrial. The proposed rezoning would bring this neighborhood's
current uses in line with the proper zoning, and at the same time protect the
viability of the residential areas.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

REOUESTED ACTION: This is an Area Plan Commission initiated
petition to rezone from "B" Reaidential, "A"
and "B" Height and Area, "C" Commercial, "C,D,
and F" Height and Area, "D" Light Industrial,
"C" and "F" Height and Area, and "E" Heavy
Industrial, "F" Height and Area to "A"
Residential, "A" Height and Area to allow the
appropriate zoning to reflect the existing
uses of the area.
PRELIMINARY
STAFF RECOMMENDATION: Based on information available prior to the
public hearing, the Staff recommends that this
petition be sent to the Commmon Council with a
favorable recommendation. The initiation of
this rezoning plan is based on the large
number of inconsistences of existing uses with
the present zoning district designations. A
large portion of the properties within the
petition area are single family homes that are
currently zoned "B" residential, "C"
commercial and "D" light industrial. The
proposed rezoning would bring this
neighborhood's current uses in line with the
proper zoning, and at the same time protect
the viability of the residential areas.
