RE: A proposed ordinance and site development plan of Family & Children's Center
Properties Management, Inc. and South Bend Redevelopment Commission to zone from
"B" Residential, "A" Eieight and Area to "PHC" Professional/Health Care, property
located on the east side of Fellows Street, approximately 150 feet north of the
interseCtion of Wenger and Fellows Streets, City of South Bend - APC #1756-97
Dear Council Members:
The above referenced ordinance and site development plan of Family & Children's
Center Properties Management, Inc. was legally advertised March 6, 1997. The
Area Plan Commission at its public hearing on April 15, 1997, took the following
action:
Upon a motion by Joseph Serge, being seconded by Henry Keultjes and unanimously
carried, the proposed ordinance and site development plan of Family & Children's
Center Properties Management, Inc. and South Bend Redevelopment Commission to
zone from "B" Residential, "A" Height and Area to "PHC" Professional/Health Care,
property located on the east side of Fellows Street, approximately 150 feet north
of the intersection of Wenger and Fellows Streets, City of South Bend is sent to
the Common Council with a favorable recommendation, subject to a Final 5ite
Development Plan. The "PHC" Professional/Health Care district is not
unreasonable for this site, which is located on the east side of Fellows Street
just south of the new Family and Childrens Centier and across from the future Ivy
� Tech campus. It is the Coamnission's opinion that a health care facility is
compatible with the other uses in this area.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

REQUESTED ACTION: The petitioners are requesting a zone change
from "B�� Residential, '�A'� Height and Area �o

EXISTING LAND USE: The property contains vacant land.
SURROUNDING LAND USE AND ZONING: Located to the north is the Family and
Children's Center zoned "B" Residential, "B"
Height and Area; ta the east are single family
homes zoned "B" Residential, "B" Height and
Area; to the south is vacant land zoned "B"
Residential, "B" Height and Area and "C"
Commercial, "E" Height and Area; and to the
west is vacant land zoned "B" Residential, "B"
Height and Area.
ACCESS: Access to the site is from Fellows Street and
the Family and Children's Center.

petitioner.
SITE DATA: The total site to be rezoned is 2.8 acres. Of

square feet, or 3 percent of the site; the
parking and drives will occupy 1.1 acres, or
40 percent of the site; and 1.2 acres or 43.5

PETITION TO REZONE
The undersigned,L. D. Williams, President and CEO Executive Director of Family&Children's Center
Properties Management, Inc. and Ann E. Kolata, Deputy Executive Director of the South Bend Redevelopment
Commission, make application and petition the Common Council of the City of South Bend, Indiana to amend
the zoning ordinance as herein requested.
1) The property sought to be rezoned is located at:
On Fellows Street at the intersection with vacated Keasey Street as shown on the
attached E�ibit "A", consisting of two parcels, Parcel "B" being owned by
Family & Children's Center Properties Management, Inc. and Parcel "C" being
owned by South Bend Redevelopment Commission.
2) The name and Address of the Property owner is:
Family & Children's Center Properties Management, Inc., 1411 Lincolnway
West, Mishawaka, Indiana 46544, as to the northerly portion of the property
described as Parcel "B" on Exhibit "A" attached hereto and The South Bend
Redevelopment Commission, 12th Floor, County-City Building, South Bend,
Indiana 46601, as to the southerly portion of the property described as Pazcel
"C" on E�chibit "A" attached hereto.
3) It is desired and requested that the Property be rezoned from "B" Residential District "A" Height and
Area to "PHC Professional/Health Care District".
4) The property will be purchased by Memorial Health System, Inc. which will build a medical clinic
containing approximately Sixteen Thousand Square Feet (16,000 sq. ft.) of space on the property as is
depicted in the preliminary site plan which is filed with this Petition.
5) Attached is a copy of (a) legal description of the property; (b) a list of names and addresses of all
property owners within 300 feet of the petitioned Property (c) six (6) site plans; and addressed, stamped
envelopes for all property owners within 300 feet of the subject property.
6) By signing this Petition, I and any contingent purchaser understand that if the Council approves this
petition to rezone, it may be approved subject to the submittal of a final site plan. A final site plan must
be submitted to the Area Plan Commission within one(1)year of the Council's action. Failure to submit
a final site plan within that time period, causes the zoning of the petitioned property to revert to the initial
zoning classification. Time extensions on the submittal of the final site plan may be requested.
