Tuesday August lgth.,1914.
Board met in regular session at 10:00 A.M. All members present.
Bids were received, opened and read for pipe sewer on Yukon Avenue from.
Portage Avenue to Riverside Drive, under Improvement Resolution No. 328. The same
were referred to the City Civil Enf-,Ineer for tabulation to be reported back at 2145
P. M. this date.
Mr. Hardy of the Shieago, South Bend & Northern Indiana Ry. Company and Mr.
Rosenberger of the Vandailia Ry. Company appeared before.the Board in regard to the
refunding of money to the City due on demurrage. (Water Works)
i,Ir. J. Yeagley appeared before the Board representing the Indiana & Michigan
JElectric Company in regard to the paving of the trenches made by the Indiana &
Michigan Electric • Company in laying their underground. It was agreed upon, .and the
Indiana & Michigan Electric Company was instructed to refill all trenches made by them
in laying their underground conduit, place the necessary foundation for paving, have
an inspector on the work to see that same was carried on in a good wor like manner.
The Board of Public Works to repair or relay all pavement, and to make cost charge
against the above mentioned Electric Company for the same.
Mr. Br.ant Mr. Hartman, and Attorney Yeagley appeared before the Board in
regard to the communication sent to the Board under date of Au gust 8th.,1914 re-
lative to the Heating contract between the St. Joseph Heating Company and the City.
All action was deferred at request of Mr. F. A. Bryan President of the Indiana &
Michigan Electric Company until he secured further advice from his attorney as to
legality of proposed plan.

Hearing given on Improvement Resolution. No. b 336. for pavement on Blaine
✓ A venue from LaPorte Avenue to Van Buren Street, In the City of South Bend, Indiana.
Upon said hearing remonstrators appeared:,(the majority of same being
against paving the above mentioned street north of Michigan Avenue) but no further remon-
strance was filed. The Board deferred their decision on said improvement until Tuesday
August 25th.,1914 at 7:45 P.M.
Hearing had on improvement Resolution No. 334 ,for pavement on Franklin
/Street from Sample Street to Indiana Avenue, In the City of South Bend, Indiana.
Upon said hearing remonstrators appeared but no further remonstrance
was filed.(One having been filed April 24th.,1914.) The Board after due consideration
decided to defer all action on the above resolution until Tuesday March 2nd. ,19Z5 at 7:45 P.M.
Notices were ordered send in time for hearing.)
Hearing had on improvement Resolution No. 335 for pavement on Cottage
Grove Avenue from Michigan Avenue to Portage Avenue. In the City of South Bend, Indiana.
Upon said hearing no remonstrators appeared and no further remonstrance
was filed. And the Board being fully advised in the premises, decides that the benefits
to property liable to be assessed for said improvements are equal to the estimated cost of
the same, as ,reported by the City Civil Engineer, and thereupon takes final action on said
resolution as originally adopted, and the same is,he reby in all things ratified, confirmed
and approved.
Resolved further, that notices be published on the 20th., day of August,
1914 and on the 27th., day of August,1914 in a newspaper of general circulation in said City
stating that this Board will receive bids for the construction of said imp rovements up to
10:00 A.M. on the 8th., day of September,1914. The Board reserves the right -to reject any
and all bids.
Hearing had on improvement Resolution No. 333 for pavement on Allen St
from Oak Street to Van Buren Street, In the City of South Bend, Indiana.
Upon said hearing remonstrators appeared but no further remonstrances
were filed.(There being one remonstrance filed June23rd.,1914. and on August llth.,1914)
The Board after due consideration decided to defer all action on said improvement until
Tuesday March 2nd. ,1915. (Notices to be sent property owners in time for hearing.)

In the above matter remonstrators appeared but no remonstrance m s filed.
The Board therefore find that the property assessed in said rolls filed July 14th.
1914 is benefited in the amount of assessments as shovn on said r0:l,ls; and the Board
further find that the assessments rolls filed July 14th.91914 and the final -estimate
allowed July 14th.21914 should be and the same are hereby in all things ratified,
confirmed and approved.
Deferred hearing given on assessment roll and final estimate for curb and
J walk on Orange Street from Sadie Street to Olive Street, under Imrovement Resolution
No. 315. In the City of South Bend, Indiana.
In the a ove matter no remonstrators appeared and no remonstrances were
filed. The Board therefore find that the property assessed in said roll f!Ljdd
July 14th.21914 is benefited ,in the amount of assessments as shown on said rolls,
and the Board further find that the assessments rolls filed July 14th,, 1914 and
the final estimate allowed July 14th.11914 should be and the same is hereby in all
things ratified, confirmed and approved.
Engineer submitted a plan of the proposed change of the curb lines at
/South Bend Avenue and Notre Dame Avenue. All action on same was deferred until
�/ Tuesday August 25th.,1914 at 10:00 A.M.

City Civil Engineer reported on the following: _
Regarding the attached motio-i of Councilamn Thompson referring to the
Grade of the C. I. & S. R. R. at Florence Avenue and Longley Ave. I beg to report
that the Tracks of said Company are about 6" above- grade at Florence Ave. and
18" above grade at Longley Ave. I recommend that they be notified to bring their
tracks to grade at both street.
A thirty day (30) notice was ordered sent to the C. I. & S. R. R.

The engineer reported on the following and the same was referred to the Street Com—
missioner for investigation.
In regard to the attached letter from the Health Department, referring
to the condition of the alley between the Nickel Hotel and the Derbin Cafe. I beg to
report that there is Flo sewer in the above alley near to private alley back of the Derbin
Cafe. There is an inlet near the west cross —walk at Main Street which will take care of
all the water which fall in the alley, but I find thatthe pavement is uneven and con—
siderable water stands along the gutter line. I believe if the street commissioner was
ins tructed to level up the pavement that would remove all the objections*

Regarding the petition of H. S. Cover asking to have Chippewa Avenue
✓ improved. I beg to report that I have investigated the matter and I recommend that
the said street be graded and curb from Michigan Street to the City limits.

ThThe Board decided that the above improvement was unnecessary at this time and the
same was placed on file.
Petition was filed with the Board for a pipe sewer on Parry,Francis
and one block on Division Street from Division Street to St. Joseph River. The Board
✓ referred the same to the City Civil Engineer for a resolution.
The Street Commissioner reported on extensions of sidewalks at N.E.
S. E. and S. W. corner of Bronson and Carroll Streets. The Board ordered City Contractor
,/notified to. repair or put in same.

Communication received from the Indiana and Michigan Electric Company
V�oliciting the number of are lamps in the underground district and the total number
of lamps to be installed, so that they could sign up contract for underground. work. The
same was filed.
Bond and contract for pipe sewer on Indiana Avenue from Carroll
Street to Miami Street under improvement Resolution No. 326, signed by L. H. Webster
✓ as Principal and The London & Lancashire Guarantee & Accodent Company of Canada as
sureties, was approved by the unanimous consent of the Board.
Mr. C. D. Emmons, Mgr. of the Chicag, South Bend & Northern Indiana
Ry. Company was ordered notified to be present at the meeting of the Board to be held
on Tuesday August 25th.,1914 at 10:00 A.M.

The City Civil Engineer filed the ..following report, and ta resolution was adopted
and ordered set for a hearing on same.
I wish to call your attention to the fact that the County Com-
missioners are constructing a Concrete Culvert across Bowman Creek at Dubail Ave.
This culvert is practkcally completed with the exception of t:!e fill. It is the cus-
tom for the County to build these culverts and the City to make the necessary ap- .
proaches. I gave prepared a resolution for the grading of Dubail Ave. from High
St to. Dale Avenue which would provide sufficient dirt to make the fills.
GRADE IMPROVEMENT RESOLUTION N0. 346.
J Resolved by the Board of Public Works of the City of South Bend,
St. Joseph County, State of Indiana. That it is deemed necessary to improve Dubail
Avenue from High Street to Dale Avenue as follows,to-wit:- .
By grading said Dubail Avenue from property line to property
line to the established grade. As shown do the plans and in accordance with the
profiles, detail drawings and specifications on file in the office of the Depart-
ment of Public Works of the City of South Bend, Indiana, in accordance with and
the profile, details, drawings and specifications on file in the office of the
Department of the Board of Public Works of saId City and such improvement is now
ordered.
The cost of said improvement, including the cost of street and
aley intersections, shall be assessed upon the real estate abutting on said Dubail
Avenue* all according to the Method and manner provided for in an Act of the General
Assembly ofnthe State of Indiana, entitled, " An Act Concerning Municipal Corpor-
tions," approved March 691905, and in accordance with and pursuant to the provisions
of all amendatory and supplemental acts thereto, passed by the General Assembly of tb.
the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual
installments, with interest at the rate of Six per cent per annum. A bond or b6ts
sha 1 be issued to the contractor in payment of such work, unless the property owners
pay said assessment before saald bond. or bonds are issued. Under no circumstances
shall the City_' of South Bend, be, or be held responsible for any sum or sums due form
from said property owner or owners for said work or for the collection of the same,or
for the payment of any bond, bonds, certificate or certificates, issued to said
contractor in payment for such work, except for such moneys as shall have been
actually received by the City from the assessments for such improvements, or such
moneys as said C ty is by said above entitled Act required to pay. All proceedings
had, and work done in the making of said improvement, assessement of property, collef
collections of assessments and issuance of bonds therefor, shall be as provided for A
in said above entitled Act and amendments thereto.

LOCAL SEWER IMPROVED-1ENT RESOLUTION NO. 347.
Resolved by the Board of Public Works of the City of South Bend, County of
St. Joseph, State of Indiana; That the construction of a local sewer, intended and a-
dapted only for local use by the property holders whose property abuts thereon, and not
intended or adapted for receiving sewerage from collateral drains, be and the sane is
hereby ordered in and along MILTON STREET FROM HIGH STREET TO.'MIi�.MI STREET as follows,
to -wit.
Begin lin}= at the center of High Street and Milton Street thence east along
the center of said Milton Street to the center of Dale Avenue with a 15 inch vitrified
pipe sewer, thence still east along the center of Milton Street to a point 100 feet west
of the west line of 1Iiami Street with a 12 inch vitrified pipe sewer. Together with the
necessary manholes, inlets, conduits and house connecions to the curb line along the line
of said improvement. All as shown on the plans, and in accordance -with the profiles,
detail drawings and specifications on file in the office of the Department of Public Works
of the Citynof South Bend, Indiana, and said sewer, with all its appurtenances shall be
constructed in accordance faith the profile and specifications now on file in the office
of the Department of Public Works of said City. The cost of said improvement shall be
apportioned against and paid by the property holders whose property abuts thereon, and
upon the City of South Bend, if the City is benefitted by said improvement, all according
to the method and manner provided for in Act of the General Assembly of the State of
Indiana, entitled " An Act Concerning Municipal Corporations," approved March 6,1905
Assessments , if deferred, are to be paid in ten equal annual installments,, with interest
at the rate of Six per cent per amum. A bond or bonds shall be issued to the contractor
in payment for such work, unless the prop rty owners pay said assessments before said
bond or bonds are issued. Under no circumstances shall the City of South Bend be or he
held responsible for any sum or sums due from said property owner or owners for said work,
or for the collection of same, or for the payment of any bond or bonds, certificate or

shall have been actually received by the City from the assessments for such improvement, or

improvement, or such moneys as said City is by.said above entitled Act required to pay.

in said above entitled Act.

TRUNK SEWER IMP"OVEMENT RESOLUTION NO. 349.
J Resolved by the Board of Public works of the City., of South Bend,Iffounty
of St. Joseph, State of Indiana: That it is desired and deemed necessary to con-
struct a sewer on High 'Street from Dayton Street to Bowman Street all In said City,
whikth, from its. size and character, is not only intended and adapted for use by pro-
perty eftmers whose property abuts along the line of said sewer, but is also intended
and adapted for receiving sewage from collateral'drains already constructed or which
may be hereafter constructed, and the same is hereby ordered constructed in and a-
long the following line in said City,to:wit:
Beginning at the center of Dayton Street
and High Street; thence south along the center of High Street to the center of
Calvert Street with a 36 inch sewer; thence still. south aong the center of High
Street to the center fff Bowan Street with a 30 inch sewer.
And to be built in accordance with the profiles, specifications, detail
plans, maps and estimates shovcm on file in the office of the Department of Public
Works of said City, which includes an estimate of the proportion that the cost of an_,,,
adequate local sewer, built along the above line, bears to the cost of the main sewer
to be built as follows: The cost of an adequate local sewer, built along the line
above described, is hereby estimated and fixed to be of the cost of
the main sewer to be built along said line as above set forth, which proportion, as
herein estimated and fixed, shall be taken and adopted in all computations, requir-
ing aknowledge of the cost of such local sewer if built along the line where the main
sewer is to be built. The cost of the construction of said sewer shall be divided as
follows:
1. So much of. such cost as shali be equivalent to the construction of
an adequate local sewer not adapted to receive sewage from collateral drains of
sewers, if built along the proposed line as hereinabove set forth, shall be paid
by the abutting property holders and the City of South Bend, it it be determined that
said City is benefitted by said sewer in the same manner and to the same extent as
local sewers, are paid for by there, under the Statutes in such cases made and pro-
vided. 2.
2. The excess of cost over and above what would be equivalent to the
cost of a local sewer, if built along said line, shall be assessed against each piece
of property in the district or area to be drained and against the City, if it be
determined that the said City if benefitted by the said sewer, according to the man-
ner and method prescribed by law, all of which said property beneficially affected
lies within the following described territory in the City of South Bend, County of
St. Joseph, and State of Indiana, to -wit: -
Beginning at the intersection of the First
Alley west of Miami Street and the First Alley South of Dayton Street; thence south
along the center of the First Alley west of Miami Street and said alley produced to
the center of Ewing Avenue; thence west along the center of Ewing Avenue to the South
west corner of the south east 1/4 of the south east 1/4 of Section 13 Twp. 37 N. R.
2 E. thence north along the west line of the south east 1/4 of the south east 1/4
to a point 135 feet south of the south line of Dayton Street'; thence east parallel
with amd 135 feet south of south line of said Dayton Street to the First Alley west
of Miami Street which point is the place of beginning.
Said improvement shall be known as TRUNK SEWER ON HIGH ;STREET,under
IMPROVEMENT RESOLUTION N0. 348. In the City of South Bend, Indiana.
And each piece of property in said district or area above described,
including abutting property holders and the City of South Bend, if the said City is
benefitted, shall be assessed, as aforesaid, to pay said excess of cost over and
above what would be equivalent to` the cost of a local sewer; all of which will
more fully appear by reference to the profiles, map, drawing s and specifications now
on file in the office of the Department of Public Works of _ said City, which, ariong
other things, gives the exact course of said proposed main sewer,overflows, and
its appurtenances, and the district or area which may be injuriously or beneficially
affected thereby, as shown by the heavy boundary lines marked on said map and
drawings, with proper words and figures written thereon, clearly indicating what
said-heavy:�boundary lines represent, and the district or area embraced thereby.
Assessments if deferred, are to be paid in ten equal annual installments, with in-
terest at the rate of six per cent per annum. A bond or bonds shall be issued to the
contractor its 'Payment for such works unless the property owners pay said assess-
ments before said bond or bonds are issued. Under no circumstances shall the Ci3ry of
South Bend be or be held responsible for any sum or sums due from said property ow-ner
or owners for said work, dr for the collection of the same, or for the payment of any
bond, bonds certificate or certificates issued to said contractor in payment for
such work, except for suct-i moneys as shall have actually received by said City from

the assessments for such impro vements.
All proceedings had and work done in the construction of said main sewer
and its appurtenances, manner of assessments of property collection of assessments and
issuance of bonds therefor, shall be as provided for in an Act of the General
Assembly of the State of Indiana, entitled." An Act Concerning Municipal Corporations,"
in matters pertaining to the constitution, `alteration and maintenance of public drains
and sewers, providing for the construction, alteration and maintenance of such sewers
a.nd drains in such cities and w1thin hour miles thereof, also pr(bviding for the assess—
ment Of property; specially benefited thereby for the payment thereof, in whole or in
part, and for the collection of such assessments, repealing all laws and parts of laws in
conflict therewith, and declaring an emergency , approved March 6,1905, and all acts
supplementary and amendatory thereto, passed by the General Assembly of the State of
Indiana.
Notice of this resolution shall be published on the 22nd. day of August,
1914 and on the 29th., day of August,1914 in the South Bend Daily Tribune. This Board
will give a hearing on t is resolution at its office in the City Hall on the 22nd.,day
of September71914 at 7;45 P.M.

north on the center line of Virgina Street to a point 20 feet south of the south line of
Broadway with a 12 inch vitrified pipe sewer. Together with the necessary manholes, inlets,
conduits and house connections to the curb line along the line of said -improvement.' All
as shown on the plans, and in accordance with the profiles, specifications and detail
drawings can file in the office of the Department of Public forks of the City of South
Bend, Indiana and said sewer, with all its appurtenances shall be constructed in accordance
with the profile and specifications now on file in the office of to nea.rtment of Public
Works of said City. The cost of said improvement shall be apportioned against and paid by
the property holders whose property abuts thereon, and upon the City of South Bend if the

Beginning at the center of Dubail Avenue
and Fellows Street; thence north along the center line of Fellows to the center of the
First Allege north of Dubail Avenue with a 10 inch vitrified pipe sewerr. Together with
the necessary manholes, inlets, conduits and house connections to the curb line along
the line of said improvement. All as shown on the plans, and in accordance with the
profiles, detail drawings and specifi cations on file in the office of the Department
of Public Works of the City of South Bend, Indiana, and said sewer, with all its appup
tenances shall be constructed in accordance with the profile and speiif-icatioris now
on file in the office of the Department of Public Works of said City. The cost of
said -improvement shall be apportioned against, and paid by the property holders whose
property abuts thereon, and upo i said City of South Bend, if the City is benefitted
by said improvement all according to the method and manner provided for in Act of the
General Assembly of the State of Indiana, entitled, " Ari Act Conerning'Municipal
Corporations," approved March 621905. Assessments, if deferred, are to be paid in ten
equal annual installments with interest at the 'rate of Six per cent per annum. A
bond or bonds shall be issued to the contractor in payment for such work, unless the
property owners pay said assessments before said bond or bonds are issued. Under no
circumstances shall the City of South Bend, be or be held responsible for any sum or -
sums due from the said property owner or owners for said work, or for the collection
of same, or for the payment 47f any bond or bonds, certificate or certificates, issued
to said -contractor in payment for such work, except for such moneys as shall have been
actually received by the City from the assessments for such improvements, or such
moneys as said City'is by said above entitled Act required to pay. All proceedings
had, and work done in the making of said improvement, assessment of property, col-
lections of assessments and issuance of bonds therefor, shall be as provided for in
said above entitled Act.
Notice of this resolution shall be published on the 22nd. day of August,
1914 and on the 29th., day of August,1914 in the South Bend Daily Tribune, This Board
will give a hearing on this resolution at its office in the City Hall on the 22no.,
day of September,1914 at 7:45 P.M.

City of South Bend, by water, sewer and gas connections and that it is, and is hereja
hereby so declared, necessary for the Northern Indiana Gas & Electric Company, which
has, and operates under, a franchise from said City to supply gas to the citizens
