- SIDEWALK IMPROVEMENT RESOLUTION NO. 340.
/ Resolved by the Board of Public Works of the City of South Bend, St. Joseph
County, . State of Indiana, That it is deemed necessary to improve Donald Street from
Michigan Street to Main Street, to —wit: —
By grading said Donald Street from property line to property line, and con—
stY•ucting cement sidewalk and cement curb on both sides of said street. All as shown on
the plans, profiles and detail drawings on file in the office of the Department of
Public Works of said City, in accordance with the profile, details, drawings and specifi—
cations on file in the office of the Department of the Board of Public Works of said City;
and such improvement is now ordered.
The cost of said improvement, including the cost of street and alley inter—
sections, shall be assessed upon the real estate abutting on said Donald Street, all
according to the method :-nd manner provided for in an Act of General Assembly of the
State of Indiana, entitled "An Act Concerning Muncicipal Corporations," approved March 6,
1905, and in accordance with and pursuant to the provisions of all amendatory and supple—
me,ntal acts thereto, passed by the Gener&l Assembly of the State of Indiana, Assessments,
if deferred, are to be paid in ten equal annual installmenta, with interest at 4he rate
of Six per cent per annum. A bond or bonds, shall be issued to the contractor in pay—
ment for such work, unless the property owners pay said assessment before said bond or
bonds are issued. Under no circumstances shall the City of South Bend, be, or be held
responsible for any sum or sums due from said property owner or owners for said work or
for the collection of the same, or for the payment of any bond, bonds, certificate or certi—
ficates, issued to said contractor in payment for such work , except for such moneys, as
shall have been actually received by the City from the assessments for such improvement,
or such moneys as said City is by said above entitled Act required to pay. All proceedings
had, and work done in the making of said improvement, assessment of property, collection
of assessments and issuance of bonds therefor, shall be as provided for in said above en—
titled Act and amendments thereto.

LOCAL SEWER IMPROVEMENT RESOLUTION NO. 341.
/ Resolved by the Board of Public Works of the City of South Bend, St.
✓ Joseph County,- State of Indiana. That the construction of a local sewer, intended
and adapted only for local use by the property holders whose property abuts thereon,
and not intended or adapted for receiving sewerage from collateral drains, be and the
same is, hereby ordered in and along Il.ine Street and -Calvert Street from Vistula
Avenue to Vernon Street,viz
Beginning at the intersection of the center line of Kline Street and the
south,er,ty line of Vistula Avenue; thence south along the center line of Kline Street
to the center of Calvert Street with a 15 inch vitrified pipe sewer; thence west along
the center line of Calvert Street to the center of Vernon Street with a 12 inch vitri—
fied pipe sewer. Together with the necessary manholes, inlets, conduits and houue con—
nections to the curb line along the line of said improvement. All as shown on the
plans, profiles and detail drawings and specifications on file in the office of the
Department of Public Works of the City of South Bend, Indiana,, and said sewer, with
all its appurtenances shall be constructed in accordance with the profile and speci—
fications now on file in the office of the Department of Public Works of said City. The
cost of said improvements bhall be apportioned against and paid by the property holders
whose property abuts thereon, and upon the City of South Bend if the City is benefitted
by said improvement, all according to the method and manner provided for in Act of the
General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Cor—
portions," approved March 611905. Assessments, if deferred, are to be paid in ten
equal annual installments, with interest at the rate of Six per cent per annum. A bond
or bonds shall be issued to the contractor in payment for such work, unless the pro—

Resolved by the Board of Public Works of the City of South Bend, St.
:Toseph'County, State of Indiana, That it is deemed necessary to improve the South side
of Fox Street from Miami Street to the east line of Demlerts 2nd. Addition.
By the construction of cement sidewalk and cement curb on the south side
of said Fox Street where same is not already constructed, All as shown on the plans,
profiles and detail drawings of file in the office ofthe Department of Public Works of
said City , , in accordance with the profile, details , drawings and specifications on
file in the office of the Department of the Board of Public Works of said City;, End such
improvements is now ordered.
The cost of said improvement, including the cost of street and alley

STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 343.
J Be it Resolved by the Board of Public Works of the City of South Bend,
St.Joseph County, State of Indiana, that it is desired and deemed necessary to im-
prove Johnson Street from Michigan Avenue to Vassar Avenue,tm-wit:-
By grading and paving the roadway, also grading end pfwving the roadway of
all intersecting and entering streets and alleys, lying within said portio-j of said
Johnson -Street not included in the roadway, to be improved with Asphatt "Asphaltic,
Concrete, Bitulithic, Creosoted Wooden Blocks, or Brick laid on a five (5) inch
Portland Cement Gravel Concrete Foundation. Or with Brick laid on a si'x-(6) inch
Rolled Grovel Foundation. Or a Concrete Pavement seven (7) inches in depth. Plac-
ing the necessary marginal cement curb, curbing the roadway with cement curb where
same is not already constructed. Also the construction of the necessary storm
water inlets and conduits, All as shown on the plans and in accordance i1th the pro-
files, detail drawings and specifications on file in the office of the Department
of Public Works of said City.
The cost of the improvement herein provided for except street and alley
intersections shall be paid by special assessments to be levied upon the property
specially benefitted, to the amount that the same may be legally assessed therefor,
ffi-:abcbrdance ith an Act of the General Assembly of the State of Indiana, entitled
An Act Concerning Municipal Corporations, approved March 621905, and in accordance
with and pursuant to the provisions of all acts amendatory and supplemental thereto.
The cost of all street and alley intersections, including one-half of the
width of the il,improvement opposite street and alleys which run into, but'do hot
cross said roadway herein proposed to be improved and that portion of such street or
alley abutting upon property belonging to said City, it upon property not subject to
such assessment, shall be paid by the City in cash out of its general fund, if able
to do so, or from a fund created by a special assessment to be elvied under the 'pro --
visions of Section 109 of the above entitled Act.
Assessments of ten dollars and more agai ist each lot, if deferred, are
to be paid in ten equal annual installments, with interest at the rate 'of Six per
cent per annum. A bond or bonds will be issued to the contractor to the amount of
such deferred assessments in pro rats payment for .such improvement.
Under no circumstances Ahall the City of South Bend,or be :held re-
sponsible for any sum or sums due from said property owner or owners for said work
or for the collection of the same, or for the pavement of any bond, bonds, certi-
ficate or certificates, issued to said contractor in payment for such work, except
for 'such moneys as shall have actually been received by the City from the assess-
ments for such improvements, or such moneys .as said City -is by said entitled Act
and amendments and supplements thereto required to pay. All proceedings had, and
work done in the making of said improvement, assessment of property,° collection
of assessments and issuance of bonds therefor, shall be as provided for in said
above entitled Act, and Acts amendatory thereof and supplemental thereto.
Be It Further Resolved, That the Board of Public Works fix the 18t.,
day of September 1914 at the hour Of 7:45 P.M. at the office of the Board of Public
Works, of this City, as the time and place for the public consideration of said pro-
posed improvement, at which said Board of Public. Works will hear all persons inter
ested or whose property ismliable to be assessed for said improvement, and will
decide whether the benefits to the property liable to' be assessed for said improve-
ment will equal the estimated cost thereof.
Be It Further Resolved. That notice of the time and place of such
public consideration be published and mailed in the manner provided by law. Notice
of this resolution shall be published &n the 6th., day of August,1914 and on the 131.
day of August,1914 in the South Bend Daily Tribune.

In the matter of the hearing on Pulaski Street pipe sewer from Division
Street to Ford Street, IA the City of South Bend, Indiana. Remonstrators appeared
and the Board find that after having said matter under advisement that the remon-
strance filed July 21st., 1914 should be sustained and that the resolution should be
and the same is hereby and in all things rescinded.
Hearing given on Improvement Resolution Not 330 for a pipe sewer on
/ Calvert,,Street from the Bowman Creek Trunk sewer to Witwer Avenue: In the City of
South Bend, Indiana.
Upon said hearing no remonstrators appeared and no remonstrances were
filed. And the Board being fully advised in the premises, decides that the bene-
fits to property liable to be assessed for said improvements are equal to the esti-
mated cost of the same, as reported by the City Civil Engineer, and thereupon takes
final, action on said resolution as originally adopted, and the same is hereby in all
things. ratified, confirmed and approved.
Resolved Furth-r, that notices be published on the 6th., day of Aug.
1914 and on the 13th., day of Amgust,1914 in a newspaper of general circulation
in said City, stating that this Board will receive bids for the construction of said
improvements up to'10:00 A.M. on the 25th., day of Au gust,1914 at 10:00 A.M. The
Board reserves the right to reject any and all bids.

Upon said hearing no remonstrators appeared and no remonstrances
were filed. And the' Board being fully advised in the premises, decides that the bene-
fits to property liable to be assessed for said improvements are equal to the esti-
mated cost of the same, as reported by the City Civil Engineer, and thereupon takes
final action on said resolution as originally adopted, and the same is hereby in all
things ratified, confirmed and approved*
Resolved further, that notices be published on the 6th., day of
Sugust,1914 and on the 13th., daynof August91914 in a newspaper of general circulation
in s,- id City, stating that this Board will receive bids for the enstruction of said
improvement upto 10:00 A.M. on the 25th., day of August,1914. The Board reserves
the right to reject any or all bids.
In the matter of a hearing on the pavement of the 1st alley
North of Washinton Avenue from Walnut Street to Sutdebaker Street,under Improvement
Resolution No. 331. In the City of South Bend, Indiana._`'Remonstrators appeared and
A remonstrance was filed, the Board having said matter under advisement find that
the remonstrance filed this 4th, day of August,1914 should be sustained and that the
resolution should be and the same is hereby in all things rescinded.

Civil Engineer, and thereupon takes final action on said resolution'as originally
adopted, and the same is hereby in all things ratified, confirmed and approved.

'Whereas on the 24th., day of March ,1914 the said party of the second
part by resolution No. 301 duly adopted provided for the grad ng and paving; of the
roadway and all intersections of Sherman Avenue from Michigan Avenue to the south end
of Sherman Avenue:
And 'Whereas, the said parties of the first part *heee not given notice
by the party of the second part, of a hearing upon said resolution as provided by law
and in consideration that the said party of the second part shall proceed to make
said improvement of said Sherman Avenue, the said parties of the first part hereby
waive all tab jections to said failure to give them notice as required by law, and they
further waive any and all ob jections , and the right t o. make any objections to any
steps or acts heretofore done in said proceedings by said party of the second part.

Hearing given on assessment roll and final estimate for Pipe sewer on
'/ Campau Street from Walsh Street to the lst alley east of Walsh Street, under Improve-
ment Resolution No. 305. In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no .remonstrances
were filed. The hoard therefore find that the property assessed in said roll filed
July 14th.,1914 is benefited in the amount of assessments as.;shown on said rolls, and
,he Board further find that the assessment roll filed July 14th.21914 and the final
estimate allowed July 14th.,1914'should be and the same are hereby in all things rati-
fied, confirmed and approved.
Hearing given on assessment roll and final estimate for water con-
,/nections on Cedar Street from Emerick Street to. Eddy Street, under Improvement Resolu-
tion No. 304. In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances
were filed. The Board therefore find that the property assessed in said roll filed
July 21st.11914 is benefited in the amount of assessments as shown on said roll, and
the Board further find that the assessment roll filed July 21st.,1914 and the final
estimate allowed Julyn2lst.21914 should be and the same are hereby in all things rati-
fied, confirmed and approved.
The Street Commissioner reported that, in regard to complaint received
for defective walk on South Rush Street, north of Keasey Street on west side, that the
same had been repaired.
The Street Commissioner reported on the following complaints for defective walks..
Brick walk at corner of Ohio and High Street needs repair. A notice
-"-was ordered sent owner.
Brick walk at 2_33 E. Paris Street needs repair,. notice ordered sent to
owner.
Communication received from John W. Rettinger of LaPorte, Indiana
The same was read and placed on file.
The City Civil Engineer reported on the petition for a pavement on
Euclid Avenue from La Porte Avenue to Brick Avenue and recommended that the said peti-
tion be placed on rile.
Partial estimate was allowed H. N. Barnes, Contractor on the concrete
pavement in the First alley West of Main Street from Marion Street to Navarre Street
for the amount of...................................•..............$552.27
Communication received from the Health Board in regard to the alley
--which lies between the Nickel Hotel on Main Street and the Derbin Cafe on Main Street.
The same was read and referred to the City Engineer for investigation and a report for
the next meeting Tuesday August llth.,1914. on same.
Partial estimate allowed Stewart -Sheets Company, Contractors on the
Bowman Creek Trunk sewer for the amount of ....... ........... ................ $32883.42
A statement and affidavit of William R. Zesinger and ' Cora A. Zesinger
was filed with the Board through their attorney Gaylord H. Case for the allowance of
a bill which was paid by them to Charles H. Oberlein Company for putting in a sewer
tap on part of lots 14 and 21 in John Rushes Addition to the Cite of South Bend on Vistula
Avenue. The Board decided to allowed three fourths (3% of -the original . bill- vh ich`
was Thirty six ($36.:00)Dollars and which amounts to Twenty seven($27.00)Dollars and the
same to be paid out of Street and alley Dept.,
CONDEMNATION RESOLUTION NO. 35.
JResolved by the Board of Public Works of the City of South Bend, Indiana,
That the fb llowing described property be appropriated for the use of said City;
Beginning at point on the north line of Corby Street 126 feet east of the east line
of St. Peter Street; thence northerly on' a straight line to a point on the south
line of Napoleon Street 103.7 feet east of the east line of St. Peter Street;thence
east on the south line of Napoleon Street 14 feet; thence south on a straight line to
a point on the north line of Corby Street 14 feet east of beginning; thence west on
the north line of Corby Street 14 feet which point is the place of beginning.
Excepting therefrom the first East and West Alley north of 'Corby Street, and the
First East and West Alley North of St. Vincent Street; and Howard Street and St.
Vincent Street which are already public thoroughfares.
The following described property may be injuriously or beneficially
affected by such appropriation: Beginning at the intersection of the east lisle of
St. Peter Street and the north line of Corby Street; thence north onnthe east liile
of St. Peter Street to the south line of Napoleon Street; thence east on the south
line of Napoleon Street to the westerly line of Notre Dame-Avenue;.thence southerly
on 1,he westerly line of Notre Dame Avenue to the north line of Corby .Street; thence
west on the north line of Corby Street to the east line of St. Peter Street which
point is the place of beginning.
The purpose of such: appropriation is for the opening of an alley
between Notre Dame Avenue 'and St. Peter Street from Corby Street to Napoleon Street.
Notice of this resolution shall be published on the 7th., day of Au.qus�
1914 and orr the 14th. , day of August,1914 in the South Bend Daily Tribune.
This Board, at its office in the City Hall on the lst. day of September
1914 will hear and receive remonstrances from all persons interested in or affected
by these proceedings.

Gentlemen: The Board of Public Works herewith presents its re;)ort
for the following sewer, gas and water connections.

On Motion duly made and seconded, the following preamble and, resolu-
tions were unanimously adopted:
WHEREAS. This Board did on the 24th., day of March 1914 deem it
expedient and of public utility to permanently improve Sherme.n Avenue between
Micigan Avenue and South end of said street, by paving the roadway of the same, and
did on said date pass and adopt,a resolution authorizing said permanent improve-
ment, and
WHEREAS. The City Engineer has prepared and filed with this Board a
report showing the number and location, as well as the material to be used and the
manner of laying the same of the service pipes, mains, conduits laterals and con-
nections which are, or will be necessary to accommodate the abutting property owners
with gas, water, heat, steam or any product for which any person, Firm or eprp.oratin
has been granted a franchise for supplying the ci-tizens of the City of South Bend,
Indiana, vdiich report is as follows:-

BE IT RESOLVED. That said report of said City Engineer be and is he
And Be It further Resolved, that it is contemplated by this Board to
improve Sherman Avenue from Michigan Avenue to South end of said Street, all in said
City of South Bend, by water, sewer and gas connections, and that it is, and is hereby
so declared, necessary for t e Northern Indiana Gas & Electric Company, which has, and
operates under,..a franchise from said City to supply gas to the Citizens of said City,
to provide and install mains, laterals, service pipes and connections for ga's in said pa
part of said street, of the description ,location and number set forth in said report
of said City Engineer, which mains, service pipes and connec+ ins are hereby declared
necessary for the immediate use of said Co-rpany in supplying gas to the owners of pro
perty abutting upon said part of said street.

The Board of Public Works herewith presents its report for the
Hollowing sewer, gas and water connections.

RESOLUTION OF THE BOARD OF PUBLIC WORKS.
No. 352.
On motion duly made and seconded, the following preamble and resolution
were unanimously adopted.
WHEREAS. This Board did on the 21st. day of JUlY1914 deem it expedient
and of public utility to permanently improvem Franklin Street between Sample St.
and Indiana Avenue by paving the roadway of the sa e, and did on said date pass ad
and adopt a resolution authorizing said permanent improvement, and
WHEREAS. The City Engineer has preparedand filed with this Board a
report showing the number and location , as well as the material to be used and
the manner of laying the same, of the service pipes, mains, conduits, laterals
and connections which are, or will be necessary to aceom modate the abutting prop-
perty owners with gas, water, heat, steam or any other product for which any per-
son, firm or corporation has been granted a franchise for supplying the citizens
of the City of South Bend, Indiana, which report is on file in tthe office of the
Board. Be It Resolved, That said report of said City Engineer is hereby adopted.
And be it further resolved, that it is contemplated by this Board to improve
Franklin Street from Sample St. to Indiana Avenue, all in said City of South Bend,
by co struction of pavement, and that it is and is hereby so declared necessary
for the Northern Indiana Gas & Elec. Company which has, and operates under, a
franchise from sa-d City to supply gas to the citizens of said city, to provide
and install mains, laterals, service pipes and connections for gas in said part of
said street, of the description, location and number set forth in said report of
said City Engineer which mains, service pipes and connections are hereby declared
necessary for the immediate use of said Company in supplying gas to the owners of
property abutting upon said part of said street.
