Board met kn regular session at 10:00 A.M. 19Ir. A. H. Rice absent.
✓ Bids were received,openedand read forresurfacing pavement on South
Lafayette Street,under improvement Resolution No. 319. The. sane were referred to the
City Civil Engineer for tabulation to be reported back.at 1:45 P.M.
Bids were received, opened and read for pipe sewer, on Talbot Avenue, under
✓Improvement Resolution No. 319. The same were referred to the City Civil Engineer for
tabulation to:be reported back at 7:45 P.M. session.
Representatives of the Michigan Central Railway Company appeared before
the Board in regard to the moving of theLturn table now on ~the °City's "ground at Cedar
,, Street near Emerick Street and the grates ah La Salle Avenue at Emerick Street. The Board
decided to go out and look at the above.
Bill presented by M. Feser for work done for the City, and the same was
,/referred to the City Engineer for measurements.

Petition for a pavement on Diamond Avenue from Michigan Avenue to end of
Street. The same was referred to the City Civil Engineer .for a resolution.
Engineer filed assessment roll and final estimate for cement walk and curb
on Frances Street from Alley south of Sorin Street to Madison Street, under Improvement
Resolution No. 302. In the City of South Bend, Indiana.
Resolved, that notices as to the amounts of assessments be published for
six consecutive days in the South Bend Daily News -Times, commencing on the 13th., day of
July 1914 stating that this Eoard will giVe a hearing on the amount of such assessments
at its office in the City Hall on the 29th., day of JUly,1914 at 7:45 P.M.
Resolved further that the entire work under the above contract be accepted
and -approved and the fnal estimate thereon allowed. Notice of this resolution shall be
published on the 13th., day of July,1914 in the South Bend News -Times, stating that
this Board will give a hearing on the acceptance of such work at its office in the City
Hall on the 28th.2 day of July,1914 at 7:45 P.A.

on Dale Avenue from Dayton Street to Bowman -Street, under Improvement Resolution No.
284. In the City of South Bend, Indiana.
Resolved, that' notices as to the amounts of assessments be published for six
consecutive days in the South Bend Daily News -Times, commencing on the.13th., day of
iluly,1914 stating that this Board will give a hearing on the amount of such assessment at
its pffice in the City Hall on the 213th., day of July21914 at 7:45 P.M.
Resolved further, that the entire work udder the above contract be accepted
and approved and the final estimate thereon allowed. Notice of this resolution shall be
published on the 13th., day of July,1914 in the South Bend, Daily News -Times, stating
that this Board will give a hearing on the acceptance of such work at its office in the
City Hall on the 28th., day of July,1914. at 7:45 P.M.
Application for the setting of a billboard on W. Sample Street by the
South Bend Billposting Company was approved by the Board.
Extengion of time for sixty days granted by the Board to Szabo & Co. Contrs.
on 2 story brick building on N.W.Corner of Maple and Division St. for Martin Kearewski
with the understanding that resolution passed by the Board for the covering of sidewalk
shall be complied with.
The following persons were ordered to repair or construct sidewalks in front of their prope
/oroperty within thirty days from notice or the sane would be constructed Or repaired by
V the City under Improvement Resolution.No. 294 for Various Street. In the City. Mrs. Emma
W. Harlin in front of Hot 23 Keasey Street on 213 and 215 E. Keasey St, in care of Wilber
Harlin, Guardain.

JHearing given on Condemnation Resolution No. 31 for the opening and extending
of Ottawa Court across the Lake Shore & Michigan Southern Ry. Company right of way.
In the City of South Bend, Indiana.
In the above ,matter Mr. W. A. McInerny Attorney for the Lake Shore & Michigan
Southern Ry. Company appeared before the Board in the interest of the Lake Shore &
Michigan Southern Ry. Company and filed a remonstrance. Also Mr. Gabriel attorney
for the petitioners appeared. The Board after due consideration decided to deferr
all action on the above condemnation until -Tuesday July 21st.,1914 at 7:45 P.M.
Hearing had on improvement Resolution No. 325 for the pipe sewer on Indiana
Avenue from Leer Street to Marine Street In the City of South Bend, Indiana.
Upon said hearing no remonstrators appeared and no remonstrances were filed.
And the Board being Hilly advised in the premises, decides that the benefits to pro-
perty liable to be assessed for said improvements are equal to the estimated cost
of the same, as reported by the City Civil Engineer, and thereupon takes final action
on said resolution as originally adopted, and the same is hereby in all things rati-
fied, confirmed and approved. a

on the 16th., day of July,1914 in a newspaper of general circulation in said City,
stating that this Board will receive bids fo the construction of said improvements
up to 10:00 A.M. on the 29th., day of July,1914. The Board reserves the right to
reject any or all bids.

perty liable to be assessed for said improvements are equal to the estimated cost of
the same, as reported by the City Civil Enginneer, and thereupon takes finalaction
on said resolution as originally adopted, and the same is hereby in all things rati-
fied, confirmed and approved.

Upon said hearing no remonstrators appeared and no remonstrances were filed.
And the Board being fully advised in the premises, decides that the benefits to the
property liable to be assessed for said improvements are equa 1 to .the estimated cost
of the same, as reported by the City C vil Enginneer, and thereupon takes final action
on said resolution as origignally adopted, and the same is hereby in all things, rati-
fied, confirmed and approved.

Hearing given on Improvement Resolution No. 324 for pipe sewer on St. Peter
`Street and Sorin Street from South Bend Avenue to Eddy Street. In the City of South Bend,
Indisra.
Upon said hearing remonstrators appeared and a remonstrance was filed.
The Board after due consideration decided to deferr all action on the above improvement
until Tuesday July 14th.11914. at 7:45 P.M.
Hearing given on assessment roll and final est mated for concrete pavemEn t
on Howard Street from Niles Avenue to Leeper Aveme, under Improvement Resolution No. 217
1913- In t he City of South Bend, Indiana.
In the above matter Mr. S. Krueger appeared remonstrating against assessment
on Lot 9 Studebaker Leeper Avenue Addition. The Board after due consideration modified his
assessment from Two Hundred and *ifty nine dollars and ten cents ($259.10) to Two Hundred
($200.00)_Dollars. Fifty nine dollars and ten cents ($59.10) to be pro ratedto the balance
of the abutting property owners. No remonstrance being filed. The therefore find that the
property assessed in said roll filed June 16th. ,1914 is benefited in the amount of assess-
ments as shown on said rolls, and the Board further find that the assessment roll filed
June 16th.21914 and the final estimate allowed June 16th.21914 should be and the same is
in all things ratified, confirmed and approved.

In the above matter no remonstrators appeared and no remonstrances were

LOCAL SEWER IMPROVEMENT RESOLUTION NO. 329.
J Resolved by the Board of Public Works of the City of South Bend,County of St.
Joseph, State of Indiana, That the construction Of a local sewer, intended and ad-
apted onlu for local use by the property holders whose property,abuts thereon, and not
intended or adapted for receiving sewerage from collateral drains, be and the same is _
hereby ordered in and along PULASKI STREET FROM DIVISION STREET TO FORD STREET,viz:-

Beginning at the center of Huron Street and Pulaski Street;; thence north
along the center of Pulaski Street to a point 100 feet -south of the south line of
Division Street ith a 15 inch vitrifidd pipe sewer. Also beginning at the center of
Pulaski Street and Ford Street; thence north along the center of Pulaski Street to*
a point 60 feet south of the south line of Huron Street with a 15 inch vitrifiltd
pipe sewer. Together with the necessary manholes, inlets, conduits and house con-
nections to the curb line along the line of said improvement. All as shown on the
plans, and in accordance with, the profiles, detail drawings and specifications on
filed in the office of the Department of Public Works of the City of South Bei d,
Indiana. and said sewer, with all its appurtenances shall be Instructed in accordance*
with the profiles and specifications now on file in the office of the Department of
Public Works of said City. The cost of said improvement shall be apporitioned against
and paid by the property holders whose property abuts thereon and upon the City of
Suth Bend if the City is benefitted by said improvement, all according to the method
and manner provided for in Act of the General Assembly of the State of Indiana,entitld
"An Act Concerning Municipal Corporations," approved March 621905. Assessments,if
deferred, are to be paid in ten equal annual installments, with interest at the rate
of Six pdr cent per annum. A bond or bonds shall be issued to the contractor in pay-
ment for such work,unless the property owners pay said assessments before said bond or
bonds are issued. Under no circumstances shall the City of South Bend be dr be held
responsible for any sum or sums due from said property owner or owners for said work
or for the collection of same, or for the payment of any bond or bonds, certificate or
certificates, issued to said contractor in payment for such work, except for such mong
moneys as shall have been actually received by the City from the assessments for' such
improvement, or such moneys as said City is by said above entitled Act required to
pay. All proceedings had, and work done in the making of said improvement ,assessmet
of property, collections of assessments and issuance of bods therefor, shill be as
provided for in said above entitled Act.

r/ Resolved by the _Board of Public Works of the City of South Bend, St. Joseph
County, State of Iridiana. That the construction of a local sewer,intended and adapted only
for local use by the property holders whose property abuts thereon, and not intended or
adaopted for receiving sewerage from collateral drainsm be and the same is hereby ordered in
and along CALVERT STREET FROM THE BOWMAN CREEK TRUNK SEWER TO WITWER AVENUE,viz:-
Beginning at the intersection of the Bovman Creek Trunk sewer with the
center line of Calvert Street; thence west along the center line of Calvert Street to the
center of Fellows Street with an 18 inch vitrified pipe sewer; thence still west along the
center line of Calvert Street to the center of Witwer Avenue with a 15 inch vitrified pipe s
sewer; Together with the necessary manholes, inlets, conduits and house c) nnect ions to the
curb line along the line of said improvement. All as shown on the plans, and in accordance,
with the profiles, detail drawings and speicifcations on file in the office of the Depart -
rent of Public Works of the City of South Bend, Indiana., and said sewer, with all its appur-
tenances shall be eD nstructed in accordance with the profile and specifications now on file
in the office of the Department of Public Works of said City. The c st of said improvement

J Beit Resolved by the Board of Public Works of the City of South Bend, St.
Joseph County, State of Indiana, that it is desired and deemed necessary to improve_
The First Alley North of Washington Avenue from Walnut Street to Studebaker Street,as
Follws,to—wit:—
By grading the First alley north of Washington Avenue- from Walnut Street to
Studebaker Street from -property line to property line and paving said alley its full
width, with ASPHALT,ASPHALTIC CONCRETE, BITULHIC,CREOSOTED WOODEN BLOCKS or BRICK
laid on a : five inch PORTLAND CEMENT CONCRETE FOUNDATION, or with BRICK laid obi a SIX
INCH ROLLED GRAVEL FOUNDATION, or a CONCRETE PAVEMENT. Placing the necessary marginal
cement curb, the construction of the necessary storm water inlets and conduits, All
as shown on the plans , and in accordance with the profiles, detail drawings and
specifications on file in the office of the department of Public Works.
The cost of the improvement herein provided for, except street and alley
intersections, shall be paid by special assessments to be levied upon the property
specially benefitted, to the amount that the same may be legally assessed therefor, in
accordance with an Act of the General Assembly of the State of Indiana, entitled "An
Act mg Concerning Municipal Corporations, "approved March 6,1905, and in accordance
with and pursuant to the provisions o f all acts amendatory and supplemental thereto.
The cost of all street and alley intersections, including one-half of the
width of the improvement opposite street and alleys which run into, but do not cross
said roadway herein proposed to be improved and that portion of such street or alley
abutting upon propety belonging to said City, or upon property not subject to such
assessment, shall be paid by the City in cash out of its general fund, id able to do
so, or.from a fund created by a special assessment to be levied under the provisions
of Section 108 of the above entitled Act.
Assessments of ten dollars and more against each lot, if deferred, are
to be paid in ten equal annual installments with interest at the rate of Six per cent
per annum. A bond or bonds will be issued tothe contractor o the amount of such
deferred assessments in pro rats payment for such Improvement,
Under no circumstances shall the City of South Bend be, or be held,
responsible for any sum or sums due from said property owner or owners for said work,
or for the collection of the same, or for the payment Of any bond, or bonds, certi—
ficate or certificates, issued to said contractor in payment for such vo rk, except
for such moneys as shall have actually been received by the City,from the assessments
for such improvements, or such moneys as said City is by said entitled Act -and amend—
ments and supplements thereto required to pay. All proceedings had, and work done in
the making of said improvement, assessment of property, collection of assessments
and i suance of bonds therefor, shall be as provided for in said above entitled Act
and Acts amendatory thereof and supplemental thereto.
BE IT FURTHER RESOLVED. That the Board of Public Works fix the 4th.
ddy of August,1914 at the hour of 7:45 P.M. at the office of the Board of Public Works
of this City, as the time and place for the public consideration of said proposed im—
provements, at which said Board of Public Works will hear all persons interested,or
whose property is liable to be assessed for said improvement, and will decide whither
the benefits to the property liable to be assessed for said improvement will equal
the estimated cost thereof.
BE IT FURTHER RESOLVED. That notice of the time and place of such
publish consideration be published and mailed in the manner provided by law. Notice
of this resolution shall be published on the 9th., day of July,1914 and on the 16th.,

the same is hereby ordered in and along DUBAIL AVENUE FRO'11A CARROLL STREET TO MIAMI
STREET, viz: -
Beginning at the intersections of the Bowman Creek Trunk sewer and the
center line of Dubail Avenue; thence east along the center line of Dubail Avenue to the
center of Miami Street with an 18 inch vitrified pipe sewer.
Also beginning at the intersection of the Bownan Creek Trunk sewer and
