Board met in regular session at 10:00 A.M. Mr. Rice absent:
f Bids were received, opened and read for curb and walk and grade for same on
�I Orange Street from Sadie Street to Olive Street, under Improvement Resolution No. 315.
The same were referred to the City Civil Engineer for tabulation to be reported back on
this date at 7:45 P.M.
Bids were received, opened and read for curb and walk and grade for same on
Wilber Street from Longley Avenue to Michigan Avenue, under Improvement Resolution No.
316. The same were referred to the City Civil Engineer for tabulation to be reported
back on this date at session at 7:45 P.M.
A complaint was received from N. F. Hozinski living on Birdsell Street in
regard to water standing north of Chicago,Lake Shore & South Bend Ry. Company's tracks
on Birdsell Street. The Street Commissioner reported that catch basins should be
placed at the p61nt.`mentioned above. The Clerk was instructed to send? a thirty
day notice on sameto the Chicago, Lake Shore and South Bend Ry. Company .`
Communication received from The Chicago, Lake Shore & South Bend Ry. Com-
pany in regard to relaying brick between their tracks on Main and LaSalle Avenue
instead of asphalt. The same was read and all action on same deferred until the.
even ng.session at 7:45 P.M.
Communication received from the Chicago, South Bend & Northern Indiana Ry.
Company in regard to the rebate on pavement on La Salle Avenue. All' action on the same
was deferred until evening session at 7:45 P.M.
(( Resignation of Mr. A. P. Perley as Clerk was received by the Board, the
1 same was accepted and placed on file.'
Communication received from J. C. Birdsell of the Birdsell Mfg. Company
Jin regard to the filling of excavation and the replacing of their fence on High Street
by the Contractor of the Bowman Creek Trunk sewer Stewart -Sheets Company, as per agree-
ment made with the City for the crossing of their propertyy with the Bowwan Creek Trunk
sewer. .'The Clerk was instructed to obfain a report on the above condition and
present at evening session at 7:45 P.M.
Complaint filed with the Board in regard to defective condition of
lcurb on Portage Avenue on east side of street about 250 ft from Cemetery. A notice
was ordered sent to H. N. Barnes, Contractor on said work in the fall of 1913 to repair
the same as soon as possible.
The Chicago, South Bend and Northern Indiana Ry. Company was ordered
.� to be notified to remove surplus dirt which was put on street vdien constructing their
tracks on East Madison Street east of Eddy Street, there being a complaint presented ;to
the Board in regard to the above condition.

At the regular meeting of the Common Council held on the 22nd. day of
June 1914, the following motion prevailed
JMOTION BY COUNCILMAN GOEBEL (Verbal)
I move that the Board of Public Works be instructed to notify The
Studebaker Corporation to keep cinders from washing onto the Sample Street sidewalks.
The above matter was referred to the Street Commissioner for investigation.
The Street Commissioner reported on the following walks
Brick walk at 213 and 215 E. Keasey Street in front of Harlan ro ert

needs repairs. Notice ordered to repair same.
Petition received for a pipe sewer on Yukon Avenue from Portage Avenue to
Woodward Avenue. The same was read and referred to the City Civil Engineer for a resolution.
Bond and contract signed by Rankert & Eggleston as prin6ipal and The Fidelity
and Casualty Company of New York as sureties, for Asphaltic concrete pavement on Cedar
Street from Emerick Street to Eddy Street, under Improvement Resolution No. 295, was
approved by the Board.
Bond and contract signed by Henry De Vos as principal and United States
r Fidelity & Guaranty Co. of Balitmore, Md. for Trunk sewer on Leer and Calvert Street, under
Improvement Resolution No. 309 was approved by the Board.
Bond and contract signed by Henry De Vos as principal and the United -
States Fidelity and Guaranty Company of Baltimore, Md. as sureties, for pipe sewer on
Dayton Street from Witwer Avenue to Miami Street, under Improvement Resolution No. 313.
was approved by the Board.
Bond andcontract for pipe sewer on Tecumseh Avenue from Parkovash Avenue
to Pokagon Avenue, under Improvement Resolution No. 312, signed by Henry De Vos as prini-
cipal and United States Fidelity and Guaranty Co. of Baltimore, Md. was approved by the
Board.

wiring.

fHearing on The pavement on Sherman Avenue from Michigan Avenue to south end of
Street, under Improvement Resolution No. 301 was deferred 'until Tuesday July 2eth.9
1914. at 7:45 P.M.
Citizens appeared before the Board in regard to a petition filed with the Board
on March 17th..21914. for the opening and ext-ension of South Scott Street from Sprnnle
Street to Terre Haute R. R. A resolution was ordered prepared on the same and a .
hearing set for.
JHearing given on Vacation Resolution No. 22 for the purpose of.vacating the
following described property to -wit: Vacation of Alley along lots 10211,4 and
So. 1/2 of lot 3 in Stover and Witwer+s Addition, in the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances were
filed, the Board therefore sustain all former action taken and declare the above des-
cribed property in all things vacated and this resolution in ail things ratified, con-
firmed and approved.
Resolved further that the City Engineer be instructed to prepare a roll
showing awards of damages and assessments of benefits to all parties and properties
interested in the above matter.
J Hearing given on Condemnation Resolution No. 30 for the opening and
extension of Calvert Street from Main Street to Michigan Street, in the City of South
Bend, Indiana.
In the above matter remonstrators appeared and a written remonstrance was
filed. All remonstrances were over -ruled and thereupon, being fully advised in the
matter the Board takes final action on said resolution, confirming without modification
all former action taken on the same.
The Board therefore declares the above property in all things condemned
and appropriated for public use, the Board now orders that a list or roll be pre-
pared of -all owners or holders of property and of vaulable interests therein sought
to be taken or to be injuriously affected, which said roll shall also describe the
property beneficially affected.

Complaitt received in regard to light at the corner of La Salle Avenue
and Taylor Street. The same was referred to the Street Commissioner to investigate.
Petition filed with the Board for a concrete pavement on Allen Street
from Michigan Aver -tie to Portage Avenue. The same was read and placed on filesto be
brought before the Board in Silty (60) days.
Remolstrance filed against the pavement on Allen Street between Michigan
Avenue and Portage Avenue. The same was read and placed on file.

The Board instructed the Clerk to notify property owners on Portage Avenue
from North line of Morris Park Addition to North line of Section 34 T. 38 N.R. 2 E. that
the improvement of said street at above points .by pipe sewer would be dicussed at meeting
QTITuesday June 30th.,1914 at 7:45 P.M. and a letter ordered sent to those interested to
be present at such meeting.
Clerk instructed to write to Mr. C. N. Wilcoxen of the Chicago, Lake Shore
J & South Bend Ry. Company requesting his to be present at meeting on Tuesday June 30th.,
1914 at 10:00 A.M.
Communication received, read and placed on file from W. G. Crabill

and Harris Streets.
LOCAL SEWER IMPROVEMENT RESOLUTION NO. 326.
Resolved by the Board of Public Works of the City of South Bend, County of
St. Joseph, State of Indiana; That the construction of a local sewer, intended and ada-
pted only for local use by the property holders whose property abuts, thereon and not
intended or adapted for receiving sewerage from collateral drains, be and the same is
hereby ordered in and along Indiana Avenue from Carroll Street to Miami Street,viz:-
Beginning at the intersection of the center line of Indiana Avenue and the
Bowman Creek Trunk Sewer. Thence west along the center line of Indiana Avenue to the
center of Rush Street with an 18 inch vitrified pipe sewer; thence still west along the
center line of Indiana Avenue to the center of Carroll Street with a 15 inch vitrified
pipe sewer.
Also beginning at the intersection of the center line of Indiana Avenue and
the Bowman Creek Trunk sewer; thence east along -the center line of Indiana Avenue to the
center of Miami Street with an 20 inch vitrified pipe sewer. Together with the necessary
manho&es, inlets, conduits -and house connections to the curb line along the line of
said improvement. All as shown on the plans, and in accordance with the profiles, detail
drawings and specificationa on file in the office of the Department of Public Works of the
City of South Bend, Indiana.
And such improvement is now ordered and said sewer, with all its appur-
tenances shall be constructed innaccordance with the profile and specifications now on
File in the office of the Department of Public Works of said City. The cost of said im-
provement shall be apportioned against and paid by the property holders whose property
abuts thereon, and upon the City of South Berid, if the City is benefited by said improve-
ment, all according to the method and manner provided for in Act of the General Assembly
of the State of Indiana, entitled," An Act Concerning Municipal Corporations," approved
March 6,1905• Assessments, iC deferred, are to be paid in ten equal annual installments,:'
with interest at the rate of Six per cent per annum. A bond or bolds shall be issued to the
.contractor in payment for such work, unless the property owners pay said assessments before
said bond or bonds are issued. Under no circumstances shall the City of -South Bend be or
be held responsible for any sum or sums due from said property ot,ner or owners for said
work, or for the collection of same, or for the payment of any bond or bonds, certi-
ficate or certificates, i.-sued to said contractor in payment for such work, except- Cor such
moneys as shall have been actually received by the City from the assessments for such
improvement, , or such moneys as said City is by said above entitled Act required topay.
All proceedings had, and work done in the waking of said improvement, assessment of pro-
perty, collection of ssessments and issuance of bonds therefor, shall be as provided
for in said above entitled Act.
Notice of this resolution shall be published on the 26th., day of June,1914
and on the 3rd. day of July,1914 in the South Bend Daily Tribune. This Board will give a
hearng on this resolution at its office in the City Hall on the 21st. day of July,1914
at 7:45 P.M.

TRUNK SEWER IMPROVEMENT RESOLUTION NO. 327.
J Resolved by the Board of Public Works of the City of South Bend, County of
St. Joseph, State of Indiana: That it desired and deemed necessary to 'construct a
sewer on Division Street from Olive Street to Chicago Street, all in said City, which
from its size and character, is not°>ronly intended and adapted for use by prope rty own—
ers whose property abuts along the line of said sewer, but is also intended and adapted
for receiving sewerage from collateral drains already constructed or which may be here—
after constructed, and the same is hereby ordered constructed in and along the follow—
ing lint: in said City to —wit : -
beginning at the center of Meade Street and Division Street; thence vast
along the center line of Division Street to the center of Olive Street with a 24 inch
vitrified pipe sewer,
Also beginning at the center of Meade Street and 'Division Street; thence
west along the center line of Division Street to the center of Berlin Street with a 24
inch vitrified pipe sewer; thence still west along the center line of Division Street
to the center of La Salle Street with a 20 inch vitrified pipe sewer; thence still west
along the center of Division Street to the center of Kenmore Street with an 19 inch
vitrified pipe _sewer; thence still west along the center line of Division Street to the
center of Chicago Street with a 15 inch vitrified pipe sewer. Together with the nec—
essary manholes, inlets conduits and house connections to the curb line along the line
of said improvement.
And to be built in accvrdnce with the profile, specifications, detail
plans, maps and estimates now on file in the office of the Department of Public Works
df said City, which includes an estimate of the proportion that the cost of an ade—
quate local sewer, built along the above line, rears to the cost of the main sewer,
to be built as follows:— The cost of an adequate local sewer, built along the line
above described, is hereby estimated and fixed to be of the cost of
the main sewer to be built along said line as above set forth, which proportion, as hr
herein estimated and fixed, shall be taken and adopted in all computations requiring a
knowledge of the cost of such local sewer if built along the line where -the main sewer
is to be built. The cost of the construction of said sewer shall be divided as follows:-
1.So much of such cost as shall be equivalent to the construction of
an adequate local sewer not adapted to receive sewage from collateral drains or sewers,
if built along the proposed line as hereinab&ve set forth, shall be paid by the abutting
property holders and the City of South Bend, if it be determined that said City is bene—
fited by said sewer in the same manner and to the same extent as local sewers, are paid
for by then,under to Statutes in such cases made and provided.
2. The excess of cost over and above what would be equivalent to the cost
of a local sewer, if built along said line, shall be assessed against each piece of pro—
perty in the district or area to be drained and against the City, if it be determined
that the said City if benefited by the said sewer, according to the manner and method
prescribed by law, all of which said property beneficially arfected lies within the.
following described territory in the City of South Bend, County of St. Joseph,and
State of Indiana ,to —wit: —
Beginning at the center of Jefferson Boulevard and Anthony Street,
thence west along the center line of Jefferson Boulevard to the center of Chicago
Street; thence south along the center of Chicago Street to a point 165 feet south of
the south line of Division Street; thence east parallel with and 165 feet south of
the south line of Division Street to a point 200 feet west of the east li a of
Section 9 Twp. 37 N. R. 2 E. thence south parallel with and 200 feet west ff the east
line of said Section 9 to the center line of Huron Street produced west; thence east
on the center line of Huron Street produced west and Huron Street to the center of
the Alley east of Kaley Street; thence north on the center line of the Alley
east of Kaley Street; thence north on the center line of the Alley east of Kaley Street
to the First Alley aouth of Division Street; thence east on the center line of the
First Alley south of Division Street t the center of Olive Street; thence north on the
center of Olive Street to a point 120 feet north of the north line of Division
Street; thence ' west parallel with and 120 feet north of- the north line of Division
Street to the First Alley west of Kaley Street; thence north on the center line of the
First Alley west of Kaley Street to the center of Jefferson Boulevard; thence west on
the center line of Jefferson Boulevard to the center of Anthony Streetwhich point is
the place of bgginning.

Said improvement shallbe known as THE WEST DIVISION STREET TRUNK SEWER
UNDER IMPROVEMENT RESOLUTION NO. 327 In the City of South Bend, Indiana.
And each piece of property in said district or area above described
including abutting property holders and the said City of South Bend, if the said City
is benefitted, shall be assessed, as aforesaid to pay said excess of cost over and above
what would be equivalent to the cost of a local sewer, all of which will more fully appear
by reference to the profiles, map, drawings and specifications now on file in the office
of the Department of Public Works of said City, which, among other things, gives the exact
course of said proposed main sewer; overflows' and its appurtenances, and the district
or area which may be injuriously or beneficially affected thereby, as shown by the heavy
boundary lines marked on said map and drawings, with proper worss and figures written
thereon. -clearly indicating what said heavy boundary lines represent, and the district or
area embraced thereby. Assessments, id deferred, are to be paid in ten equal annual
installments, with interest at the rate of six per cent per annum. A bond or bonds shall
be issued to the contractor in payment for said work, unless the property owners pay said
assessments before said bond or bonds are issued. Under no circumstances shall the City
of South Bend be or be held responsible for any sum or suss due from said property
owner or owners for said works or for the collection of the same, or for the payment of
any bond,bonds, certificate or certificates issued to said contractor in payment for such
work, except for such moneys as shall have been actually received by said City from the
assessments for such improvements.
All proceedings had and work done in the construction of said main
sewer and its appurtenances, manner of assessment of property collection of assessments
and issuance of bonds therefor, shall be provided for in an Act of the General Assembly
of the State of Indiana, entitled "An Act Concerning Municipal Corporations," in matters
pertaining to the constitution, alteration and maintenance of public drains and sewers,
providing for the construction, alteration and maintenance of such sewers and drains
in such cities and within four miles thereof, also providing for the assessment of pro-
perty specially benefited thereby for the payment thereof, in -whole or in part, and for the
collection of such assessments, repealing all laws and parts of laws in conflict there-
with, and declaring an emergency, approved March 6119052 and all acts supplementary and
amendatory thereto, passed by the General Assembly o the State of Indiana.
Notice of this resolution shall be published on the 26th.2 day of
June,1914. and on the 3rdo day of July21914 in the South Bend Daily News -Times. This
Board will give a hearing on this resolution at its office in the City Hall on the 21st.
day of July,1914 at 7:45 P.M.

J Resolved by the Board of Public Works of the City of South Bend, Indiana;
That the following described property be appropriated for the use of said City; Begin
at the north west corner of lot 14 in Lederer & Longley t s Sub- Division of Large Lot
One (1) in Cottrellts Addition to South Bent',; thence east along the south line of
Sorin Street sixty six (66) feet to the north east corner Of lot 13 in said Sub -
Division; thence south 105 feet to the first alley south of Sorin Street; thence west
along the north line of said alley sixty six (66) feet to the south west corner of said
lot 14; thence north 105 feet to the south line of Sorin Street which point is the
place of beginning. Being all of lots 13 and 14 in Lederer and Longleyf s Sub.

Notice of thi resolution shall be published on the 26th.2 day of
June,1914 and on the 3rd. day of July,1914 in the South Bend Daily News -Times.
This Board, at its office in the City Hall on the 21st., day of July,
1914 at 7:45 P.M. will hear and receive remonstrances from all persons interested in
or affected by these proceedings.
