Bids were received ,opened and read for sidewalk on Pennsylvania Avenue from xigh j Street to -Viami Street, under Improvement Resolution No. 310. and the same were referred to the City Engineer for tabulation. The Board ordered a Ten (10) day notice served on the Chicago, Lake. Shore & South J Bend Railway Company demanding payment of the rebate to property owners for the removal of the Brick between the tracks on Main Street and LaSalle Avenue. The Board also ordered the Chicago, :Lake Shore & South Bend Railway Company to change their present pavement from brict to Aspha,lton Main Street between Washington Ave. and LaSalle Avenue, the same to be started within Teri (10) days fib mt date. Petition filed with th-e Board for a pipe sewer on Indiana Avenue from Carroll St. to lst. alley west of Miami. Street. The same was read and the Clerk was instructed t'o;prepare a resolution on tie same and set for hearing. The Street Commissioner reported the same to be repaired. The Clerk was instructed to notify the Ry. Company to have same repaired immediately. The Street Commissioner filed notice of the following intersections being in defective condition on account of being raised by roots. Notices were ordered given the City Contractor to fix same. At St. Louis and LaSalle Avenue, on N.E. Corner. S. W. Corner St. Peter & South Bend Avenue. The Street Commissio per reported on the following defective sidewalks and the Clerk was instructed to secure property owners and serve them with a thirty day note notice. S. W. Renewal of Bond No. 9967 fo excavation work in the City of South Bend ,Indiana of Josepri Colbert for One Triousand Dollars was approved by the Board. Comniunication received rrom trie Sout:Liern Surety Company, the same was read and placed on file. 1969 Petition presented to the Board for a street light on Kline Street at the crossing of the Lake Shore & Michigan Southern Railway,(or corner of Dayton and Kline Sts.. The same was read and referred to the Street Commissioner for investigation.. Permission granted the Indiana &Michigan Elec. Companynto set their poles i as follows: - To set 1 - 40tpole on the northeast corner of Golden and Portage Avenuo,This pole to be set jointly with C.U. Tel. Co. and Northern Ind. Street Car Company,in accordance to Ordinance No. 1650 .- Permission was granted the Central Union Telephone Company to set the follow ng poles. / To -set two(?) thirty (30) foot poles on the east side of College Street, be- tween Longley Avenue and Werwinski Street. Communication received from F. B. Bellis in regard to thirty day notice on ✓defective sidewalk at 1073 Woodward Avenue. The same was read and placed on file. Report filed with the Board for the repairing of the intersections at.Marion Street and Riverside Drive. The same was read and referred to the Street Commissioner to investigate. All members present., Hearing given on Vacation Resolution No.' 22 for the purpose of_ vacating the following deser'b;PrI property to-7Tit:- The vacation of alley J$etween lots 10, 112 4 and So. 1/2 of lot 3 in Stov6r, & Witwert s Addition; :in the City of South Bend , Indiana. - In the above matter the Board decided to defer all action until Tuesday June i6th . ,1914. i . 5 ,,% Hearing given on improvement resolution No. 317 for the grade:, curb and walk J on North side of East Calvert Street from South Leer Street to South Kline Street, in the City of South Bend, Indiana. Upon said hearing no reronstrators appeared and no remonstrances were filed. And the Board being fully advised in the premises, decided that the benefits to pro- perty liable to be assessed for said improvements are equal to the estimated cost of the same, as reported -"by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all thing. rati- E410 &M L pprovea.. Resolved further, that notices be published on the 12th.1, day of June, 1914 and on the 19th.2, day of June,1914 in a newspaper of general circulation in'said City, stating that this Board will receive bids for the construction, of said improve- ments up to 10:00 A. VI. on the 30th., day of June,1.914. The Board reserves the right to reject any and all bids. The City Civil Engineer filed the following report with the Board, and approved by the Board. To the Hon. Board of Public Works, of the City of South Bend, Indiana. Gentlemen,: - aI have made a careful investigation in order to determine, as near as p0sible, the amount of surplus dirt en Sunnyside Ave., Colfax Ave. and LaSalle Ave. Rased by the construction of sewers on hhe above streets by L. H. Webster. x I find that after the streets had been -graded, and before the sewer was started, a 6" water main was laid ex each street 9(nd connections run to the curb line of each lot 1, also find that a 4" gas main was laid on each of the above streets. The laying of the water mains and gas mains and the connections to the curb line is the cause of part of the surplus dirt and should not be charged against the sewer contractor. I beleive the most accurate way to arrive at the amount of dirt to be moved by Mr. Webster is to figure the amount of earth displaced by the pipe he laid an and also, calculate the amount of surplus due to the breaking up of the earth in ex* cavatin.g the trenches. It is my best judge*ent that 1/2 of 1%-would be a. fair allowance for the increase due to breaking up the earth, taking into consideration the character of the -material and the amount of moisture it carried at that time. The following is, therefore an itemized statement of the surplus dirt based upon: the above data. Amount of excavation displaced b sewer 192 cu.yds. P y pnpe............. The following ten (10) day notice was ordered sent to the Chicago, Lake Shore and South Bend Railway Company. You are hereby notified to rebate property owners within Ten (10) dams to whom you are indebted for the change of pavement on Main Street .and LaSa-.le Avenue. BOARD OF PUBLIC WORKS-. Also communication notifying them to change pavement from brick to asphalt on Main Street between LaSalle Avenue and Washington Avenue in, accordance with franchise, within Ten (10) days. The. HiJi Street To Mi,-TL St—{, under Improvement Res011ution No. 310. was awarded to H.N. Barnes. The contract for the pipe sewer on Campau Street from center of Walsh St. to center of lst. alley east of Walsh Street, under Improvement Resolution No. 305, was awarded to L. H. Webster, contractor. The City Engineer submitted the list of property owners in the matter of J the appropriation of certain property under .Condemnation Resolution No. 29(whieh is on page 333 of this record)which list includes the names of the owners and holders of pro— perty and of interests therein sought to be taken or beneficially or injuriously effected, and the description �of the several pieces of property which is affected by the said appro— priation proceedings. Thereupon the Board proceeded to award the damages sustained and to assess the benefits accruing to each piece of property upon said list: , It was thereupon, upon Motion duly made and seconded and unanimously adopted, resolved that said list, together with the amount of benefits and damages and net benefits and net damages therein set forth -as to the several parcels of land be adopted and ordered spread upon this record by reference, -and that the respective amount of bene— fits contained in said list be and are hereby assessed against the several tracts of land as specifically set forth in said list, and that the respective amounts of damages contained ii the said list be and are hereby awarded to the several tracts of land as specifically set forth in said list, and that the net benefits or net damages, as the case may be as to the respective tracts of land, contained in said list are hereby awarded or assessed , as the case may be as to the said several tracts of land. The Board hereby further sets off the benefits and damages each against the other where both benefits and damages are assessed against the same piece of property, tract of land or interest, and hereby fixes said respective net benefits as the amount that shall be paid by the respective owners as benefit-s, and further hereby fixes the respective net damages as to the several tracts as the amount that shall be paid to the owners of the respective tracts as damages. Thereupon, upon motion duly made and seconded and.unaninously adopted the 29th.2 day of ,July,1914 was fixed as the day on which this Board will receive or hear remonstrances --from persons with regard to the amount of their respective awards of assessments, and the Clerk of this Board was instructed to prepare and cause to be duly and legally given, notices to the owners of each parcel of property, showing the amount of the assessment or award, with a description of.the property affected, and the date of said hearing. 2'76 Tuesday June 9th.,191.4.
