Board met in regular session at 10:00 A.M. All members present.
Agent of the American Title Guaranty & Surety Company appeared before the
Board in regard to the following releases on Contractors and excavatIrs bonds., And the
Board approved of same.
The undersigned, the Board of Public Works of the City of South Bend,
Indiana, hereby releases and discharges the Title ]auaranty & Surety Company from any and
all further liability, on new work undertaken and completed after April lst.,1914 as
surety on that certain bond of Ladislaus Holdy, dated April lst.,A.D. 1913, and covering
replae-.ng of pavement and, repairs of streets, which bond is known as Contractor's Bond.

Mr. C. D. Emmons, Mgr. of the Chicago, South Bend & Northern Indiana Ry.
JCompany appeared before the Board in regard to railing and valk on Vistula Avenue also
in the matter of the rebate on brick pavement between the rails. No action was taken.
Communication received from the -Common Council notifying the Board to
order proper guard rails placed on the riverside of Vistula Avenue. The matter was taken
up with -Mr. C. D. Em mon.s, Mgr. of the Chicago, South Bend & NorthemnIndian.a Ry. Co..,
Bids were received, opened and read for Pavement on lst. alley West of
Main Street from Marion. Street to Navarre Street, under Improvement Resolution No.
305• The same were referred to the City Engineer for tabulation, to be reported on
Friday May 29th.,1914 at 10:00 A.M..
Bond of excavation for the amount of One Thousand ($1,000.00)Dollars
signed by Lawrence E. Albright of South Bend, Indiana as principal and United States
Fidelity & Guaranty Company of Balitmore, Md. as sureties, was approved by the Board.
A renewal certificate tT @ ?.s:suled_ by the American Surety Company of
New York for renewal of Bond No. 779331 for One Thousand ($17000. 00)Dollars for the
South Bend Home Telephone Co. The same was approved by the Board.
Petitition filed with the Board for a pipe sewer on E. Sorin Street from
South Bend Avenue to Eddy Street. The same was read end referred to the City Engineer
for investigation. .
Petition filed with the Board &or a street light on Sample Street at irate;
intersection of Grand Street. The same was read and referred to the Street Commissioner
for investigation.
Bond and contract for grade, curb and walk on Meade Street from
Washington Avenue to Bertrand Street, under Improvement Resolution No. 303. In the City
of. South Bend, Indiana, signed by C. L. Headley and approved by the Board.
In regard to petition filed April 29th. ,1914 for Brick pavement or concr
J concrete on alley north of La Salle Street from Main Street to Lafayette Street and t
alley west or Main..Street from La Salle Avenue to Madison Street, the Board ordered a
resolution prepared on sand and set for a ?fearing.

j The following resolution -was presented to the Board by the Chicago, Indiana & Southern
Railroad Company, approved and referred to the Common Council for ratification.
BE IT ORDAINED, By the Common Council of the City of South Bend, That the
Chicago, Indiana. and: Southern Railroad Company is hereby invested with full power. and
authority to construct, maintain and operate an industrial or spur railroad track with—
in -the City of South Be -Aid, over, upon and along Wilber Street, as follows: —
Beginning at. a point near Where the east line of Wilber Street, if ex—
tended, would intersect the main track of the said Chicago, Indiana,
& Southern Railroad, thence in a general southwesterly direction a—
cross said Wilber Street to the west line thereof, as indicted in the
blue print hereto attached and made a part thereof, said track- being in-
dicated by lines shown in red.
This grant is made upon the egpress condition that where the said
track crosses said Wilber Street, it shall be constructed so as to conform to the
established grade of said street; and further, that said railroad Company shall plank
-the e+vessing of said street between the rails of said track, and for trio (2) feet
on either side of said rails.
This Ordinance shall be in full force ann' effect from and after its passage
and acceptance by said Railroad Company.
The above blue print referred to was approved by the Board on April 28th. ,1914.

Hearing given on Condemnation resolution No. 29 for the opnein:.g and exten-
fsion of Sherman Avenue from south end op Sherman Avenue to Oak Street. In the City of
South -Bend, Indiana.
In the above matter memonstrators appeared and a written remonstrance was
filed. The Board took the matter under advisement and decided to defer all action until
Tuesday June 2nd . ,1014 at 7 : 45 P.M.
Hearing given on improvement Resolution No. 313 for pipe sewer on Dayton
Street from Witwer 'Avenue to Miami Street, In the C:.ty of South Bend, Indiana.
In the above matter no remonstrators appeared and no re, onstrances were filed.
The Board therefore find in each and every case in said improvement that the benefits to the
property and to the City of South Bend are equal to the estimated cost of said improvement,
and the same are hereby in all things ratified,, confirmed and approved.
Resolved further, that notices be published.on the 29th., day of May,1914
and on the 4th., day of June,1914 in the South Bend Daily News-Ti-.es, stating that this
Board will receive bids for the construction of said improvement up to 10:00 A.1vi. on the
16th., day of June,1914. The Board reserves the right to reject any and all bids.

Avenue from Parkova.sh Avenue to Pokagon Avenue, In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances were
filed. Tne Board therefore find in each and every case in said improvement that the benefits
to the property and to the City of South Bend are equalto the estimated cost of.said im-
provernent, and the same are hereby in all things ratified, confirmed and approved.
Resolved further, that notices be published on the 29th., day of May,1914
and on the 4th., day of_ June,1914 in the South. Bend Daily News -Times, stating that this Board
will receive bids for the construction of said improvement up to 10:00 A.M. on the 16th.,
day of June,1914. The Board reserves the right to re; ect any or all bids.

from Portage Avenue to Riverside Drive, In the City of South Bend, Indiana.
In the above•matter no remonstrators appeared and no remonstrances were filed.
The Board therefore find in each and every case in said improvement thp--t the benefits to the
property and to the City of South Bend are. equal to the estimated cost of said improvement,
and the same are hereby in all things ratified, confirmed and approved.

In the above natter remonstrators a.,�eared and a written remonstrance was
filed.. Tf-ie Board therefore after due consideration decided that in each and every case in
said improvement that the benefits to the property and to the City of South Bend are equal
to the estimated cost of said improvement, and the.same are hereby in all things ratified,
confirmed and approved.
Resolved further , that notices be published on the 3rd.. day of December,1914
and on the 10th> day of December,1914 in the South Bend Daily News-Tiir:es, stating that
this Board will receive bids for the construction of said improvement up to 10:00 o:,,- the
22nd. day of December,1914 The Board reserves the right to rE7ect any or all bids. (TFris

Street and Calvert Street from St. Joseph River to Vernon Street. In the -City of South
Bead, Indiana.
In the above matter remonstrators appeared and remonstrances were filed.
The Board therefore find in each and every case of laid improvement that the benefits to
the property and to the City of South Bend are equal t,o the estimated cost of said im-
provement, and the same are hereby in all things ratified, confirmed and approved.

No. 299. In the City of South Bend, Indiana.
In the above matter no remonstrators app-eared and no remonstrances were
filed. The Board therefore find that the p1poperty assessed in said roll filed April
27th.,1914 is benefited in the amount of assessments as shown in said roll, and the
Board further find that the assessment roll filed April 27th-21914 and the final esti-
mated allowed April 27th.,1914 should be and the same in all things ratified, confirmed
and approved.

In the above matter no remonstrators appeared and no remonstrances were
filed. The Board therefre find that the property assessed in said roll filed May 5th.,
1914 is benefited in the amount of assessembiats as shown in said roll, and the Board
further find that the assessment roll filed May 5th.,1914 and the final estimate allowed
May 5th-21914 should be and the same is hereby 1" all things ratified7confirmed and

In the above matter no remonstrators appeared and no remonstrances
were filed. The Board therefore find that the property assessed in the said roll
,filed May 5th.91914 is benefited in the amount of assessments as shown in said rolls
and the Board further find that the assessments roll filed May 5th-11914 should be and
the final estimate allowed May 5th.11914 should be and the same is hereby in all things
ratified, confirmed and approved.
The following report was filed by the City Civil Engineer. The Clerk was notified
to write to Mr. C. D. Emmons of the Chicago, South Bend 81 Northern Indiana.--Ry.

of the City of South Bend, Indiana.
Gent emen:-
I have made an examination of the brick pavement of La Salle Avenue from
Hill Street to Michigan St. and beg to report, that it is my hest judgement, the life
of thiis pavement will be about 25 years. As the pavement has been down 9 years the
Chicago, South Bend & Northern Indiana Ry. Co. should rebate the property owner 68% Of
the original; cost as the correct value of the pavement taken up by daid comp,-ny.

and the pipe sewer on same, the Board decided to bring these up at meeting on June 2nd..

approved by the Board.
An invitation was received from the Honorable Mayor to attend
Memorial day exercises. The same was read .and .placed on file.
Bond and contract forwaterconnections on Cedar Street from E,erick
Street to Eddy Street, under Improvement Resolution N 305 , was signed by W.H.Burke
as prinicpal and John E. Fisher as sureties, was approved by the Board.

Miami Street. On Miami Street west side, lots on each side of alley between Indiana Ave.
and Dubail Avenue.
