Resolution No. 2174
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
ACCEPTING THE TRANSFER OF REAL PROPERTY
FROM THE CITY OF SOUTH BEND, INDIANA
WHEREAS, the City of South Bend, Indiana (the "City ") is the owner of the following
described real property situated in St. Joseph County, Indiana:
See attached Exhibit A
(collectively hereinafter referred to as the Real Property); and
WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend
(the 'Board ") has custody of and may maintain all real property of the City of South Bend; and
WHEREAS, the City, through the Board, desires to transfer the Real Property to the City of
South Bend, for the use and benefit of its Department of Redevelopment for use in the
redevelopment of the South Bend Central Development Area; and
WHEREAS, the City of South Bend, Department of Redevelopment, acting by and through
its governing body, the South Bend Redevelopment Commission desires to acquire the Real Property
from the City of South Bend; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City, acting by and through the Board, may
exchange or transfer property with another governmental entity upon terms and conditions agreed
upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of
each entity; and
WHEREAS, it is anticipated that the Board of Public Works, at its meeting of June 20, 2005
will adopt its Resolution No. 2005 -47, approving the transfer of the Real Property to the City of
South Bend, for the use and benefit of its Department of Redevelopment.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION AS FOLLOWS:
1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally
described as follows:

by the City of South Bend, Indiana to the City of South Bend, for the use and benefit of its
Department of Redevelopment, shall be, and hereby is, accepted.
2. That the Director of Redevelopment for the City of South Bend shall cause the
recording of the quitclaim deed conveying all of the right, title and interest of the City of South
Bend, Indiana in and to the Real Property to the City of South Bend, for the use and benefit of its
Department of Redevelopment.
3. That this Resolution shall be in full force and effect upon its adoption by the South
Bend Redevelopment Commission.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on June 17,
2005, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.

EXHIBIT A
Legal Description
A parcel of land in the Southeast Quarter of Section 26, Township
37 North, Range 2 East, described as follows:
Beginning at the Northeast corner of the Southeast Quarter of said
Section 26; running thence West 150 feet; thence South 150 feet;
thence East 150 feet; thence North 150 feet to the place of the
beginning.
ALSO,
A parcel of land in the Southeast Quarter (1/4) of Section 26,
Township 37 North, Range 2 East, described as follows: Beginning
at a point on the East line of said Section 26, One Hundred Fifty
(150) feet South of the Northeast corner of the Southeast Quarter
of said Section 26, which point is also the Southeast corner of a
tract heretofore conveyed by Grantor to the Grantee by Warranty
Deed dated January 20, 1966, and recorded April 5, 1967 in Deed
Record 686, page 457; thence South along the East line of said
Section 26, a distance of Ninety (90) feet; thence West parallel
with the East-West centerline of said Section 26, a distance of
One Hundred Fifty (150) feet; thence North parallel with the East
line of said Section 26, a distance of Ninety (90) feet to the
isSouthwest corner of the said tract heretofore conveyed; thence
East along the South side of said tract heretofore conveyed one
Hundred Fifty (150) feet to the place of beginning.
