Jefferson Blvd. South Bend, IN 46601 Attention: Mr. Matt Sikora RE: PROPOSAL FOR PROFESSIONAL CONSULTING SERVICES FOR THE CITY BLOCK — WESTERN AVE., TAYLOR STREET, WAYNE STREET AND WILLIAMS STREET, SOUTH BEND, INDIANA, PROPOSAL WP11-004 Dear Mr. Sikora: Wightman Petrie (WP) is pleased to submit this proposal for Professional Consulting Services to the City of South Bend, Community and Economic Development, for the proposed re- development of the city block consisting of Western Avenue to the south, Taylor Street to the west,W. Wayne Street to the north, and Williams Street to the east. The subject site is currently developed with an existing residential dwelling (double lot) and a telecommunications support building (Kentucky Data Link). All other formerly existing structures have been demolished and the properties (lots) leveled; however, the paved parking area at the northeast quadrant remains intact(former Gurley-Leep Buick/Gates Chevrolet Body Shop). Wightman Petrie has previously completed a Phase I Environmental Site Assessment of the former Fred's Transmission facility, which was formerly located at the southern third of the proposed re-development site (along Western Avenue). Results of the Phase I Site Assessment identified environmental concerns best addressed through the demolition process. It was during that demolition process that several historical heating oil UST systems were identified and removed from the ground. Such historical heating oil UST systems were likely associated with the former residential dwellings and/or businesses present prior to the construction of the Fred's Transmission building. This assumption was partially based on the demolition encountering significant volumes of rubble. We note that additional Phase I Environmental Site Assessments have also been completed for properties to the east (Gates Chevrolet) and south (Harmon Glass) of the subject site; however, other than the aforementioned Fred's Transmission property, the northern portions of the subject property, as proposed for re-development, have not been addressed by a Phase I Environmental Site Assessment. City of South Bend—Westem/Wayne Re-development March 1, 2011 Page 2 of 8 collected and analyzed as part of the Fred's Transmission demolition, as residential heating oil tanks are considered exempt from regulation, and any potentially impacted soils encountered during the excavation/demolition (principally identified by olfactory senses) were placed on visqueen for subsequent off-site disposal. The City of South Bend, as part of the environmental due diligence process in preparation for re- development, has requested completion of Phase I/II Environmental Site Assessments for the subject site to identify recognized environmental conditions, as well as obtain data for confirmation that the subject site does not pose any "excess risk" with regard to residential development. In addition, the City of South Bend has also requested that all existing utilities and associated connections to the residential lots be "mapped" in order to support the presentation of the development to the Regional Planning Commission. Details regarding the aforementioned requests for Professional Consulting Services, as well as pricing and schedule considerations are presented in the following sections. PROPOSED SCOPE OF SERVICES TASK 1 —PHASE I ENVIRONMENTAL SITE ASSESSMENT As previously indicated, WP has previously completed Phase I Environmental Site Assessments for the former Fred's Transmission facility, located at the southern end of the subject site, along Western Avenue, as well as for the former Gates property, located to the east, and Harmon Glass located further to the south/southeast of the subject site, across Western Avenue. However, other than the Fred's Transmission property, which forms the southern one-third of the subject site, there has not been a Phase I Environmental Site Assessment performed for the"city block"as a whole. The objective of the Phase I is the identification of Recognized Environmental Conditions in connection with the subject property. The proposed Phase I Environmental Site Assessment will consist of the following components: • Records Review • Site Reconnaissance • Interviews • Reporting RECORDS REVIEW The purpose of the records review is to obtain and review records that will help identify environmental concerns in connection with the subject property. As part of this phase of the project, we will attempt to obtain and review those records that are"reasonably ascertainable." For the purposes of this proposal, "reasonably ascertainable" information is defined as: (1) publicly available, (2) obtainable from its source within reasonable time and cost constraints, and (3) practically reviewable. WP will review any listings for the subject site address and immediately adjacent properties within the IDEM Virtual File Cabinet, a repository of environmental related reports and correspondence submitted to IDEM. Additional file review, beyond that available through a review of the Virtual File Cabinet will necessitate a Freedom of Information Act (FOIA) submittal to the representative regulatory agency, and are not considered as part of the Phase I effort. The initiation of a Freedom of Information Request may result in an additional time delay in the completion of the Phase I report. All prior Environmental Site Assessment Reports (as previously documented) will be summarized relative to current regulatory criteria. PHYSICAL SETTING SOURCES A current United States Geological Survey (USGS) 7.5 Minute Topographic Map will be reviewed to help evaluate area topographic and surface drainage. At least one additional physical setting source will be reviewed for information on the geologic, hydrogeologic, hydrologic, or topographic characteristics of the site. HISTORICAL USE INFORMATION The purpose of consulting historical sources is to develop a history of the previous uses or occupancies of the property and surrounding area in order to identify those uses or occupancies that are likely to have led to recognized environmental conditions in connection with the subject site. Historical information gathered during the completion of prior Phase I Site Assessments will be incorporated within the discussion of the subject site. USES OF THE SUBJECT PROPERTY The prior uses of the subject properties will be identified from the present back until at least 1940 using available"standard historical resources" listed below: � � Aerial Photographs Fire Insurance Maps � Property Tax Files � City of South Bend—Westem/Wayne Re-development March 1, 2011 Page 4 of 8 Recorded Land Title Records USGS 7.5 Minute Topographic Maps Local Street Directories Zoning/Land Use Records Our proposal does not include a Chain-of-Title search. If others have recently completed a Chain-of-Title, WP will review the document for potential environmental concerns associated with prior ownership. USES OF PROPERTY IN SURROUNDING AREAS Using available resources, the history and/or general uses of properties in the area surrounding the subject site will be researched at a search distance and time period deemed appropriate, given the findings of other portions of the assessment. Complete coverage using local street directories, Sanborn Fire Insurance Maps and potentially other historical records regarding the prior uses of the subject site and surrounding properties may be limited, may not be readily available, or may not even exist for purposes of review. SITE RECONNAISSANCE The purpose of the site reconnaissance is to observe current conditions at the site and obtain information indicating the likelihood of environmental concerns in connection with the property. A site reconnaissance will be perFormed looking for surface indications of past or present waste handling or disposal activities that may pose a hazard to the subsurface environment. Quantities, areas of storage, waste disposal procedures and manufacturing processes will be documented as identified, or made known to WP. We will require access to all areas of the site, to the extent they are not obstructed by bodies of water, adjacent buildings, or other obstacles. WP understands that access to the existing buildings may not be provided to WP (residential dwelling and data center), although the site reconnaissance effort will include inspection of existing grounds and building exteriors for any indications of the presence of UST systems or other chemical/petroleum use. Unforeseen circumstances notwithstanding, only one site visit will be made to the subject property. INTERVIEWS The objective of interviews is to obtain direct, personal information from individuals indicating recognized environmental conditions at the property. Prior owners and/or occupants may be interviewed regarding site activities and/or operations which are currently, or may have in the past, affected the environmental condition of the site. Selected local regulatory and/or emergency response officials may also be interviewed regarding knowledge environmental problems or emergency responses at the site. IDENTIFICATION OF DATA GAPS Depending on the availability of certain resources for evaluating historical property use, current or historical manufacturing operations, chemical use, waste disposal activities, previous property owners (for interview) and other pertinent information; certain "Data Gaps" may be identified within our Report. WP will make determinations regarding potential impacts such Data Gaps may have on conclusions as to the presence or potential presence of recognized environmental conditions. PHASE I ENVIRONMENTAL SITE ASSESSMENT REPORTING Upon completion of our site reconnaissance, regulatory database and historical records review, a verbal summary will be presented. Our written report will include documentation to support the analysis, opinions and conclusions found in the report, inclusive of referenced sources. If appropriate, recommendations for additional assessment (Phase II) will be made. Estimated �. � � �' � City of South Bend—Westem/Wayne Re-development March 1, 2011 Page 5 of 8 costs and the specific scope of services for performing any Phase II recommendations will be submitted under separate cover. Included within the report will be the qualifications of the environmental professional responsible for the assessment. TASK 2—PHASE II SITE ASSESSMENT As the proposed re-development of the subject site is residential; historical property uses become of significance given the potential for long-term exposure to residents/children, should contamination be present. We note that the northernmost portions of the subject site were residential until such time as the northeast quadrant was transitioned to a paved parking lot for autos associated with both the historical Gurly-Leep Buick and Gates Chevrolet Body Shop operations. The northwest quadrant continued as residential until such time as demolition of the units began in the mid to late 1980s. With respect to these former residential dwellings, historical heating oil UST systems are likely to be present, as well as significant volume of rubble associated with the former foundations. The southern half of the subject site was historically developed as residential (heating oil USTs, rubble), with subsequent conversion of the lots along Western Avenue to commercial operations that included a former gas station, a former dry cleaners, former department store, former auto battery sales/service facility, and more recently as a transmission repair facility. With the recent demolition of the former transmission repair facility, clean-up of the heating oil UST systems encountered was based on field screening and visual assessment. As such there were no confirmation samples collected as part of the removal actions. In light of the aforementioned, Wightman Petrie proposes some level of confirmation that the area of the general site is consistent with the criteria established under the RISC Residential guidelines. Such confirmation can be accomplished through the collection of various surface and subsurface soil samples, as well as groundwater samples collected from temporary wells. We note that any such borings or temporary wells should consider any additional Recognized Environmental Conditions identified during the completion of the Phase I Environmental Site Assessment(i.e., review of Sanborn Maps, historical aerials, site reconnaissance, etc.). SOIL SAMPLING VIA GEOPROBE METHODOLOGY Using Geoprobe methodologies (small track mounted hydraulically driven sampling probe) soil samples will be collected from a total of eight (8) locations across the subject site (GP1 — GP8). For each of the Geoprobe boring locations, discrete soil samples will be collected from a depth of approximately 1-foot below land surface (surface soils), as well as the interval immediately above the soil/groundwater interface (up to 30 feet below land surface), assuming that there are no other indications of the presence of contamination (visual/olfactory). Surface soils will also be collected from an additional four (4) locations across the subject site. Each 5-ft. soil sample interval (until groundwater is encountered or 30 feet below land surface) will be screened for the presence of volatile organics by placing a portion of the soil sample into a plastic bag, allowing time for equilibration, and insertion of a photo ionization detector (PID) probe to observe a reading of"total VOCs" in parts per million (ppm). All data associated with the field screening of VOCs will be recorded for future reference (Soil Boring Logs). Should field screening with the PID indicate the presence of significant VOCs, a sample of the soil in question will be collected and submitted for analysis. Surface soil samples will be analyzed for the presence of RCRA metals; whereas subsurface soil samples selected for laboratory analysis will be analyzed for the presence of Volatile Organic Compounds (VOCs) and Carcinogenic Polynuclear Aromatic Hydrocarbons (CPAHs). Wightman Petrie will utilize IDEM guidance Terra-Core Methods to collect soil samples from each discrete sampling interval for the analysis of VOCs. All soil samples will be labeled, packed on ice and forwarded to the laboratory under chain-of-custody procedures. City of South Bend—Western/Wayne Re-development March 1, 2011 Page 6 of 8 TEMPORARY GEOPROBE WELL INSTALLATION FOR GROUNDWATER SAMPLING Wightman Petrie proposes to convert each of the eight (8) Geoprobe soil borings to temporary wells through use of a Geoprobe groundwater sampling device that will be advanced to the soil/groundwater interface, or 30-feet below land surface. The use of the Geoprobe groundwater sampling device allows for the extension of a stainless steel slotted screen for collection of a groundwater sample. Once the desired depth interval has been attained and the sampling device extended (additional 5-feet), the temporary well will be purged until such time as the water discharge becomes relatively free of solids or until at least five (5) gallons of water have been removed. Once the purge process has been completed, a representative sample will be collected within laboratory provided containers. Each groundwater sample (total of eight (8)) will be appropriately labeled, packed on ice, and forwarded to the laboratory (priority overnight delivery) under chain-of-custody procedures. Groundwater samples will be analyzed for the presence of Volatile Organic Compounds via EPA Method 8260. Wightman Petrie will plug the boreholes/wells with bentonite once sampling and water level measurements have been completed. REPORTING Upon receipt of the laboratory analyses, data will be reviewed and tabularized. Comparison of the data for each respective chemical constituent will be made to the Risk Integrated System of Closure (RISC) Default Closure Values for Residential and Industrial/Commercial Properties. Upon completion of the initial data review, a "Letter Report" will be prepared which presents the sample collection and analytical methodologies used during the field phase of the assessment. Copies of the sample location maps, tabulated data and comparison to RISC Default Closure Values will also be incorporated. Recommendations for any additional assessment activities will be made for review and comment. TASK 3—SURVEY OF PUBLIC UTILITY CONNECTIONS As with any proposed residential re-development, the location of public utilities becomes important relative to the conceptual plan, inclusive of housing type and density, the proposed size and width of lots/parcels. While the City of South Bend has prepared an initial conceptual plan for residential housing for the subject site based upon previously existing housing and lot sizes; the location of the utility taps (gas, electric, sanitary sewer and water service connections), have not been located on an established survey of the subject site. Such survey of utility connections is a requirement for the replat of the subject site, as well as Planning Commission review and approval for re-development. Based upon the conceptual plan, there are a total of seventeen (17) parcels for future development, although one (1) existing residential structure currently occupies a double-sized lot. Each of the seventeen (17) parcels require the respective utility connections, which may be present along the adjoining streets or common alleyways at the rear of the parcels. In addition, the conceptual plan calls for four (4) taps (two (2) to the east and two (2) to the west of the north/south alleyway) along Western Avenue and W. Wayne Street. Although it is thought that many of the connections for underground utilities already exist, confirmation and location of such utility runs and connections, as well as documentation of any "missing" or disabled" taps are necessary moving forward in the re-development process. Accordingly WP will utilize accepted survey techniques and established monuments to physically locate/confirm the presence of utility connections associated with the subject site. Such efforts will also involve coordination with each of the utility companies as verification of their service lines, whether active or abandoned. All such confirmed utility service connections will be transferred to an existing Survey Map for future use in planning and re-development of the subject site. � � � City of South Bend—Western/Wayne Re-development March 1, 2011 Page 7 of 8 � FEE FOR SERVICES � � We propose to perform the Phase I Environmental Site Assessment(TASK 1)for a Lump Sum Fee of $1,700. Our Phase I Report will be submitted within three (3) weeks of our receipt of the attached Proposal Acceptance page, assuming that access for the on-site reconnaissance is provided within a period of three(3)days of signed Authorization. An ESTIMATED COST for Phase II Environmental Assessment Services (Task 2) with respect to the Environmental Assessment is presented as follows: Field Engineering Services/Project Management $1,600 Geoprobe Rental (assumes 1-day @$1,500/day, including mobilization) $1,500 Laboratory Analysis: 28 soil samples for% Moisture @$15/sample $ 400 12 surface soil samples for analysis of RCRA metals @$85/sample $1,020 8 subsurface soil samples for analysis of cPAHs @ $90/sample $ 720 8 subsurface soil samples for analysis of VOCs @ $85/sample $ 680 8 groundwater samples for analysis of VOCs @ $85/sample $ 680 Terra Core Sampling Kits for collection of soil samples (40 kits @$15/kit) $ 600 Survey Services $ 600 Reporting 1 400 ESTIMATED COST $9,200 The Phase II Environmental Site Assessment will be coordinated with the Phase I Assessment effort with respect to any specific recognized environmental conditions that may be identified. We anticipate that the Phase II Site Assessment will commence within two (2) weeks of proposal authorization. We anticipate field work requiring up to 2 days. Laboratory analysis will be completed on a one-week turnaround from the date on which the samples are received by the laboratory. Completion of a Letter Report summarizing the results of the Phase II will be completed within one-week of receipt of such results by WP. The Survey of Utility Connections (TASK 3) can be performed for a Lump Sum Fee of $1,200, inclusive of the Survey Map documenting such connections for subsequent incorporation into a comprehensive Plan for Re-Development and submittal to the St. Joseph County Area Plan Commission. The Survey of Utility Connections will be completed during the time period that the Phase I and Phase II Environmental Site Assessments are undertaken.
