JOSEPH COUNTY RECORDER REC FEE: $21.00 PAGES: 6 RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION AMENDING THE AIRPORT ECONOMIC DEVELOPMENT AREA DEVELOPMENT PLAN. WHEREAS, the South Bend Redevelopment Commission ( "Commission "), governing body of the City of South Bend Department of Redevelopment ( "Department "), on February 23, 1990, adopted Resolution No. 919 declaring the Airport Economic Development Area to be an Economic Development Area within the meaning of I.C. 36 -7 -14 ( "Act"); and WHEREAS, Resolution No. 919 and the Airport Economic Development Area Economic Development Plan ( "Development Plan ") adopted by Resolution No. 919 on February 23, 1990 were confirmed by Resolution No. 938 adopted on June 27, 1990; and WHEREAS, Resolution No. 919 was amended by Resolution No. 965, adopted on November 9, 1990 and confirmed by Resolution No. 971 adopted on January 2, 1991 and said resolutions expanded the Airport Economic Development Area by adding Expansion Area No. 1 and Expansion Area No. 2; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1058, adopted on May 22, 1992 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 3; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1238, adopted on April 15, 1994; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1349, adopted on July, 7, 1995 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 4; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1516 adopted on July 18, 1997; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1545, adopted on November 21, 1997 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 5; and • As 466 WHEREAS, Resolution No. 919 was further amended by Resolution No. 1667, adopted on February 19, 1999 and said resolution expanded the Airport Economic Development Area by adding Expansion Areas No. 6,7, and 8; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1670, adopted on March 5, 1999; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1796, adopted on October 20, 2000 and said resolution expanded the Airport Economic Development Area by adding Expansion Areas No. 9 and 10; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1798, adopted on October 20, 2000; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1827, adopted on February 16, 2001 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 11; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1916, adopted on November 1, 2002 and said resolution expanded the Airport Economic Development Area by adding Expansion Areas No. 12, 13, 14 and 15; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1958, adopted on March 7, 2003; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 1977, adopted on July 18, 2003 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 16; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 2006, adopted on November 7, 2003 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 17; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 2019, adopted on December 19, 2003 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 18; WHEREAS, Resolution No. 919 was further amended by Resolution No. 2064, adopted on July 2, 2004; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 2090, adopted on October 22, 2004 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 19; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 2091, adopted on October 22, 2004; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 2106, adopted on November 5, 2004; and WHEREAS, Resolution No. 919 was further amended by Resolution No. 2144, adopted on March 4, 2005 and said resolution expanded the Airport Economic Development Area by adding Expansion Area No. 20; and WHEREAS, Section 43 of the Act permits the creation of an allocation area within an economic development area to provide for the allocation and distribution, as provided by the Act, of the proceeds of taxes levied on property situated in the allocation area; and WHEREAS, the Commission in accordance with the Act, has previously established the Airport Economic Development Area, Allocation Area No. 1 ( "Allocation Area No. V); and WHEREAS, the Commission, in accordance with the Act, expanded the boundaries of the Airport Economic Development Area, Allocation Area No. 1 to include Expansion Area No. 1 and Expansion Area No. 2 by the adoption of Resolution No. 965, adopted on November 9, 1990, and confirmed by Resolution No 971, adopted on January 2, 1991, and Expansion Area No. 3 by the adoption of Resolution No. 1058, adopted on May 22, 1992, and Expansion Area No. 4 by the adoption of Resolution No. 1349, adopted on July 7, 1995, and Expansion Area No. 5 by the adoption of Resolution No. 1545, adopted on November, 21 1997, and Expansion Areas No. 6,7 and 8 by the adoption of Resolution No. 1667, adopted on February 19, 1999, and Expansion Areas No. 9 and 10 by the adoption of Resolution 1796, adopted on October 20, 2000, and Expansion Area No. 11 by the adoption of Resolution 1827, adopted on February 16, 2001, and Expansion Areas No. 12, 13, 14 and 15 by the adoption of Resolution 1916, adopted on November 1, 2002, and Expansion Area No. 16 by the adoption of Resolution 1977, adopted on July 18, 2003, and Expansion Area No. 17 by the adoption of Resolution 2006, adopted on November 7, 2003, and Expansion Area No. 18 by the adoption of Resolution 2019, adopted on December 19, 2003 and Expansion Area No. 19 by the adoption of Resolution 2090, adopted on October 22, 2004 referred to the Allocation Area, as expanded, as Airport Economic Development Area Allocation Area No. 1, ( "Airport Economic Development Area Allocation Area No. 1 "); and WHEREAS, the Development Plan includes a list of the parcels of property within the Area to be acquired; and WHEREAS, it is not necessary at this time to modify the list of parcels of property within the Area to be acquired by adding parcels of property to the Property Acquisition List; and WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or plan in a way that enlarges the boundaries of an economic development area by not more than twenty percent (20 %) of the original economic development area or adds one (1) or more parcels to the Property Acquisition List; and WHEREAS, there was presented at this meeting of the Commission for its consideration and approval a proposed amendment to the Development Plan setting out the boundaries of the Area as expanded ( "Area "), adding parcels of property to the Property Acquisition List and further identifying the types of economic development projects and purposes to be undertaken in the Area (the Development Plan as amended is hereinafter referred to as the "Development Plan "), which Development Plan is entitled: 3 • "Airport Economic Development Area Development Plan" and consists of a typewritten document of _2L pages; and WHEREAS, the Development Plan has been revised and considered at the meeting; and WHEREAS, at the hearing held by the Commission on the 21 st day of July, 2006, at 10:00 a.m., Eastern Daylight Time, at 1308 County -City Building, South Bend, Indiana, the Commission heard all persons interested in the proceedings and received and considered D written remonstrances and objections and other such evidence presented. NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission, governing body of the City of South Bend, Department of Redevelopment, as follows: The Commission finds that the amendment is reasonable and appropriate when considered in relation to the Plan and the purposes of the Act. 2. The Commission finds that the Plan, with the proposed amendment, conforms to the comprehensive plan of the City. 3. To accomplish redevelopment of the Area it is necessary to acquire additional land within the Area as shown at Exhibit "A ", attached hereto and incorporated herein. 4. It is estimated that the cost of acquisition and redevelopment of the properties being added to the acquisition list shown at Exhibit "A" is $400,000.00. 5. The Plan is amended by adding the properties shown on Exhibit "A" to the acquisition list, and is hereby in all respects approved. 6. The Secretary is hereby directed to file a certified copy of said Plan, as amended, together with the minutes of this meeting. 7. The Secretary is directed to record this resolution pursuant to the requirements of Ind. Code § 36- 7- 14- 17.5(g). 8. All other findings, determinations, and conclusions in Resolution No. 2245 shall remain as stated therein. 9.
