Engineer's Services Article 1 of the Agreement is supplemented to include the following agreement of the parties. Engineer shall provide Basic and Additional Services as set forth below. PART 1— BASIC SERVICES Project Understanding. After a significant rain event ending on February 18, 2018; South Bend and surrounding areas suffered significant flooding and damage. This rainfall was compounded by significant snowmelt and freezing temperatures that accentuated stormwater runoff. Warmer temperatures continued in the following days contributing to the St. Joseph River continued rise cresting in the early hours of February 23, 2018. Widespread damage occurred to city infrastructure and facilities near the St Joseph River. During this period and since, professional Engineering Services have been requested and performed related to these events. As a result of the flooding the bank along the St. Joseph River and East Bank Trail just north of the Niles Avenue Dog Park to just north of a second wooden over look in the area. A project location map can be found in Appendix A. There were two (2) distinct areas of failure that were visually identifiable. The area furthest north near the wooden overlooks is about 175-ft in length and has experienced a slope failure adjacent to the trail. The second area is to the south of the previously identified failure, near the dog park, and is a bout 150-ft in length. These are the failure areas that are identifiable from visual inspection other areas may become evident upon completion of the topographic survey and geotechnical investigation. The City has requested that LFA prepare schematic design documents for the repair of the slope within the limits as identified above and on the project location map shown in Appendix A. The schematic design process will include the evaluation of the long-term, cost effective solutions available for the slope repair. These options will be presented and discussed with the City and the preferred alternative will then be progressed from Schematic Design through Final design. This agreement is for providing professional Engineering Services to assist the City with the assessment of the damage from the February 2018 flood and to progress the East Bank Trail Slope Failure project up through the Schematic Design Phase. Some of the work for assistance with the Flood Damage Assessments was conducted prior to the preparation of this agreement. Those work items will be identified below. A1.01 Assist the City with Flood Damage Assessments A. Flood damage assessment work performed to date: 1. Prepared graphics and other supporting material in the vicinity of South Bend Wastewater Treatment Plant. This provided the anticipated crest elevation superimposed on aerial exhibits to quantify the impacts from this flooding. Page t -- - (Exhibit A — Engineer's Services) EJCDC E-500 Agreement Between Owner and Engineer for Professional services Copyright c0 2008 National society of Professional Engineers for EJCDC. All rights reserved. 2. Performed damage assessment, prepared cost estimates for repairs across six (6) park areas damaged by the flooding. These areas included the Governor Kernan Walkway, East Bank River Walk, East Race, Pier Park, East Bank Trail, and Riverside Drive. These were prepared for City staff s use in submitting claims with FEMA. B. As may be requested or directed by the City, provide as needed professional services that may include attending FEMA meetings, conducting investigations, reviewing technical material and providing recommendations and other communications. These on -call professional services may include planning, studies, and investigations as may be requested or directed by the Owner. A1.02 Prepare Schematic Design Documents A. Site Assessment and Survey 1. The Engineer shall review construction plans of past improvements in and near the project area. It is assumed for this proposal that the City will provide these plans from their records. 2. The Engineer shall inform all properties, via U.S. Mail letter, within or adjacent to the proposed survey area of planned survey activities pursuant to Indiana Code IC 25-21.5- 9-7. 3. The Engineer shall Establish two (2) inter -visible horizontal control points and witnesses. And establish temporary benchmarks on USGS Datum (NAVD 88). 4. The Engineer shall call IUPPS for utility locates. 5. The Engineer shall provide topographic survey of the area within the project limits. LFA shall obtain bank topography for approximately 700 lineal feet from the north edge of the dog park to 50 feet north of the north overlook deck. Survey width will be from the uphill side of the existing trail to the midline of the St. Joseph River. River bottom data will be obtained with an echosounder. The following will be acquired along with the river bottom data, the following data collected will include: i. Existing grade features ii. Limits of hard surfaces iii. Location of overlook decks and path amenities iv. Corby Boulevard outfall V. Utility locates vi. Ordinary High, Normal, and Current water elevations by inspection. 6. The Engineer shall perform a title search on the properties within the project boundary in order to research rights and easements associate with the existing infrastructure and the impacts that these may have on potential repair options. Page 2 (Exhibit A — Engineer's Services) EJCDC E-500 Agreement Between Owner and Engineer for Professional Services Copyright (0 2008 National Society of Professional Engineers for EJCDC. All rights reserved. 7. The Engineer shall process the obtained information to create a surface model through a triangular irregular network (TIN) of the survey limits and produced a CAD drawing depicting existing conditions. B. Geotechnical Investigation and Evaluation Earth Exploration Inc. (EEI) shall conduct a geotechnical field investigation at key location within the project limits. This includes a total of seven (7) soil borings summing to a depth of 410 feet. 2. EEI shall perform the appropriate laboratory testing including visual soil classification, hand penetrometer readings, moisture content and grain size analysis. 3. EEI shall prepare a technical report which will include a summary of findings and recommendations for geotechnical consideration for a proposed repair(s). 4. EEI shall coordinate with the City and property owners it gain access to their boring location which will be determined once the project commences. C. Schematic Design Process The Engineer will coordinate and conduct an early coordination meeting with the applicable regulatory agencies which will include the Army Corp of Engineers (ACOE), Indiana Department of Environmental Management (IDEM), and the Department of Natural Resources (IDNR). The goal for this meeting will be to learn of any regulatory constraints and concerns prior to progressing with potential design alternatives. LFA will prepare and distribute minutes from the meeting. 2. The Engineer will develop up to three (3) design alternatives to stabilize the slope and adjacent area with the noted project limits. The alternatives will consider: a. Project Cost b. Consttuctability c. Regulatory agency considerations. d. Material to be utilized e. Site Access f. Environmental impacts g. Sustainable solutions 3. The Engineer will prepare preliminary plans for each alternative that will include plan sheets and critical typical sections. 4. The Engineer will develop a preliminary estimate of probable cost for each of the alternatives. 5. The Engineer will prepare a Schematic Design Package documenting the process and presenting the alternatives also including the preliminary drawings, estimate of probable cost, and benefits and disadvantages for each alternative. This package will be submitted to the City for review. - wage 3 (ExhibitA — Engineer's Services) EJCDC E-500 Agreement Between Owner and Engineer for Professions Services Copyright © 2008 National Society of Professional Engineers for EJCDC.
