"Yhile the resignation was dated July l, on account of the Chie� being v�ay the �ollo�ving week and no Board meetings the �ollowing t�vo �reeks, this is the first meeting Chief Knoblock has had to . prese t sam� to the Board. The C rk reported there was nothing to be taken up with the Board. ��� AUGUST 10, 1931 ( cont'd) POLICE DEPART�.�T�T Requisitions and bills_ approved and ordered paid. Chief Kuespert reported on the activities of his department �or the past weQk. , Chief Kuespert requested the Board to egtend �Sr. Chas. Kemmerly's time until September 1, 1931, at which time the Pension Boasd would take him. Attorney Sam Fiwell appeared before the Board stating he represented P��r. Rudolph Summers v�ho attempted to operate a news stand in front of the Odd Fello�vs Building, corner P�Tain and �r'dashin�ton Streets. Nr. Fi�vell explained that he was t�ere on behal� of T�:r. Summers and �,�r. Geor�e Sands caho ovans the building. The Board explained to T:Ir. Fiwell that they had made a ruling, sometime a�o, against news stands being established in the loop district of the city, however, �1r. Fiwell continued to make an wrgent plea to the Board. Attorney Sidney Eder was also present and protested against the establishment of news . stands. City Attorney Clements was also present and advised the Boar d as to their legal rights in the m atter. Chie� Kuespert egplained his views and sta�ed that he was of the same opiriu�n as the Board and that � it was absolutely wrong to grand the stand. After hearing R�r. Fiwell, the Board on motion of r�Tr. Long, seconded by ?s�r. Gadacz, agreed that the stand should not he established on the corner and ordered Chief Kuespert to remove stand if' it continues to remain. Attorney Iden S. Romig appeared before the Boar d on behal� of some of his clients, residen ts of George Avenue, stat_ing that they desired that the Board rule that there be no parking at the dead end of the street, which he contended was an alley. The Board informed r�r. Romig that the City Ordin�nce covering same only prohibits the p�,rkin5 in alle�rs in the vehicular loop and advised him to present an ordinanee covering same to the Common Council. rEZr. Clements vrho � was present stated that he would see that the ordinance vras presented before the Council tonight and upon recommendation of the Board he agreed to see that the ordinance , which covers the parkin� in alleys be amended to read that there be no parking in any alley in the City of South Bend , instead of just vehieular loop as it is notiv. , The Clerk read the �ollowing charges presented by Chie� Kuespert and filed v�ith the Clerk �lugust 6, 1931: r'To the Honorable Board of Public Sa�ety Gentlemen: I herewith prefer the �ollovain� charges against Offieer John r.tyers. That the said officer, John rlyers, ha.s been guilt� of eonduct unbecoming an of�icer by his careless use of his revolver in shooting at dogs thereby breaking a plate glass ��indotFa in the ' premises knovrn as 1702 Prairie bvenue oti�ned by Vincent Kirsits. Further more that Officer John P.�yers, in a report to me dated July 15, 1931, es�ablishes �or himself a policy of shooting at dogs vvithout any consideration for the safety of the public. Respeet�ully submitted, John B. Kuesnert ( signed) Chief of Police. TT Chief Kuespert appeared before the Boar3 to substantiate his charges. � Officer John �Zyers appeared inhis o�rn behalf. � A�ter the Clerk had read the charges, Chie� Kuespert explained his stand in the matter. O�ficer �:iyers denied the charges o� ' conduet unbecoming an of�icer� and stated he thought he was v�ithin his rights. The Board informed him he �vas �Frrong and stated that for his benefit he might remember that in the future if he had any difficulty v�ith dogs or any other animals to noti�y the Chief and he would take the matter up with ?:"r. Downes,and the attendants o� the �og Pound vrould ����� �UGUST 10 1931 (cont'd) POLICE DEPt'�RTr.R�VT ( eont'd} be gla to take care of the complaint, as they take eare of scores of simila complaints daily. �lhe Board felt it was not within the �urisd' etion of Officer �;Zyers to deal, in any way, vrith dogs as it was a atter which belonged to the Do� Pound Department. Officer . r;Zyers as very sarcastic in his explana.tion to the Board and stated he fel as he was being persecuted. The Board was inclined to believe that C ie� Kuespert had the right slant on the matter, and on motion of ��ir. Gadaez, seeonded by �Tr. Zong , Of'ficer �;iyers ti�as fined five days p y from August lOth to 14th, inclusive, and in addition to this O�fice 1;�yers was severly reprimanded by the I�embers of the Board and warned not to appear before them for the same o�fense a�ain. Police oman' s report read, approved and placed on file. The Clerk read the following letter from Alfred D. Hollis and Hav rstock, undertakers and funeral direetors of 2528 River Par , i,Iishawaka Avenue , South Bend, telephone 5-0489, have agr ed that they ��ill take eare of all ambulance calls which com to the Police Department of the city of South Bend out- r„ sid of the corporate limits o� the City of South Bend and T:iis' awaka and furnish their ov�n ambulance and drivers and run the rish of collecting �rom the injured party, if- col ectible, if not, they v�i11 charge the rish to advertising.
