DORAU AMENDMENT'No. 2 Dated as of,RL\�A 1 V 2018 to AGREEMENT BETWEEN OWNER AND ENGINEER FOR PROFESSIONAL SERVICES by and between Board of Public Works, City of South Bend, Indiana ("Owner") and McCormick Engineering, LLC ("Engineer") For Bowen Street Drainage Improvements ("Project") This Amendment amends, modifies and supplements the Agreement between Owner and Engineer for Professional Services (the "Agreement"). The Agreement, whether or not it is attached to this Amendment, is hereby incorporated into this Amendment by this reference and is made part hereof as if it were fully set forth herein. The amendments, modifications and supplements to the Agreement contained in this Amendment are set forth by reference Section number contained in the Agreement. Unless a part of the Agreement is amended, modified or supplemented by this Amendment, the Agreement shall remain in full force and effect. Engineer's Additional Services under this Agreement: • Layout and integration of an additional permanent maintenance road into the Facility from the Miami Street Right -of -Way. • Geotechnical engineering services needed to incorporate the newly proposed permanent maintenance road into the design of the facility • Reconfiguration of access drive for maintenance of existing water quality structures • Preparation of revised design Plans and Contract Documents to remove accumulated sediment from the basin known as the "Miami Basin" as well as provide additional surface stabilization measures • Coordination and preparation of Contract Documents to provide improvements to an existing automated valve that will result in: o Elevation of the actuator motor above the existing ground surface o A new actuator motor with improved manual flywheel orientation o Reestablishment of electrical connections to actuator motor o Remote sensing of levels and/or flows from the Miami Basin o Ability to open and close the valve by means of the actuator motor from remote facilities by the City 1.01 Basic Agreement and Period of Service B. Engineer shall complete its services within a reasonable time, or within the following specific time period: The Engineer shall make every effort to complete the portion of the Work needed to solicit Contractor bids within three months from the Effective Date of Amendment 2. 7.01 Basis of Payment l of 2 A. Using the procedures set forth in Paragraph 2.01, Owner shall pay Engineer as follows: 2. In accordance with, the time and material provisions of Paragraph 7.02. Total project payments shall not exceed an amount of $193,783.00, an Increase from total budget established in Amendment 1 of $74,530.100 for the Scope of Services outlined above without prior written consent and authorization of the Owner.
