The Special Exception is necessary to correct a technical zoning issue with the current site zoning requirements as the proposed stadium improvements will expand the overall footprint of the park area beyond the current site limits. The Commission, as owner of land adjacent to the park into which the park area would expand, would be a co-petitioner with the South Bend Park Commission, the present owner of the Cove property. This resolution also requests Commission approval to allow Wightman Petrie, Inc., to represent the Commission and serve as its agent during the exception approval process. Lastly, the Resolution would authorize Don Inks to sign any documents related to the special exception petition. Staff requests favorable approval of this Resolution. RESOLUTION N0.2849 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION TO PETITION FOR A SPECIAL USE EXCEPTION WHEREAS, the South Bend Redevelopment Commission (the "Commission") is the governing body of the City of South Bend Department of Redevelopment (the "Department") and exists and operates under the provisions of I.C. 36-7-14, commonly known as the "Redevelopment of Cities and Towns Act of 1953", as amended from time to time (the "Act"); and WHEREAS, under the authority of the Act, the Commission has adopted and declared the South Bend Central Development Area ("Area") to be an area in need of redevelopment within the meaning of the Act and has acquired property and assisted in the development of Stanley Coveleski Regional Stadium, 501 W. South Street, South Bend, Indiana, and wishes to expand the said facility; and WHEREAS, the expansion will require that a special exception be granted from the Area Board of Zoning Appeals (BZA). NOW, THEREFORE, BE IT RESOLVED, by the South Bend Redevelopment Commission as follows: 1. The Commission hereby authorizes the presentation to the area BZA of a petition for a special exception (the "Petition"). 2. Wightman Petrie Environmental, Inc., 412 S. Lafayette Blvd., South Bend, Indiana, 46601, has the expertise to prepare the Petition and is appointed as the agent of the Commission for purposes of preparing and presenting the Petition for a Special Use Exception. The actions of the Agent to date in this regard, including the February 7, 2011, Petition for Special Use Exception to the Area Board of Zoning Appeals, are hereby ratified. 3. Don Inks is hereby authorized to sign all necessary papers in connection with the Petition on behalf of the Commission. 4. This Resolution shall be in full force and effect after its adoption by the Commission.
