The Board instructed the Clerk to prepare a resolution on t'.Le same and set for a hearing. Board ordered the Clerk to notify Hoban & Roach to reset the sewer: connection at lot 54 Portage Park Addition as per specifications. The same to be com— plied with not later than Three (3) days from servance of the notification. Board ordered a resolution prepared for the Vacation of the First Alley South of the proposed opneing of Calvert St-reett and set the saiie #or a hearing. Excavation bond for One Thousand ($1,000.00)-ollars signed by The Studebaker Corporation as principal and Nelson J. Riley and John F. Deacon as suteties eras approved by the Board. Mr. George Hoffman appeared before the Board and presented plans, J and blue print of a side-track on the main line of the Michigan Central Ry. on Emerick Street projecting east into the tract of land known as the Hagerty tract. No action taken. . Hearing given on roll of alyards of damages and asessments of bene- 'tits in the matter of appropriating for public use a. strip for the opening and ex- tension of Huey Street from No,-th line of Mayr's Ihiichigan Avenue. Addition to Elwood Ave-nue, under Condemnation Resolution No. 23. in the City of South Bend, Indiana. In the above matter remonstrators appeared, but no further re- monstrances were filed. The Board after due consideration decided to modify the above mentioned assessment roll allowing Jacob Andrzysiak damages of $75.00 instead of $25.00 as shown in ink on roll filed Tuesday Larch 24th. ,1914 on, pages 297-2F,8 and 299 of this record and, amended by resolution under date of April 21st. ,1914 on page '�;21 of this record and also allowing Telesfor Andrzysiak damages of $125.00 instead of $25.00 as shown in resolution adopted by the Board under date of April 21st.,1914 on page 321 amending roll filed Tuesday March 24th. , 1914 on pages 297-2£ f and 2£ 9 in tills- record, and the said roll is hereby in all things ratified, conf- rmed and approved, and all action under Condemnation Resolution No. 23 is hereby concluded. Communication received from t.-ne Board of Public Safety with enclosed bid J of Jollin Beyrer for repairs to the roof of Fire Station No. 2, stating teat he will furnish a.11 necessary material and labor for making the needed repairs as mentioned above for $42.50. The Board approved of the same. The petition for a street light at the intersection of idichigan Street and Donmoyer Avenue, was approved by the Board. The Board instructed the Clerk to prepare resolution on same and set for a hearing. Communisation received from Gustave F. Schmidt of Chicago, Ill, relative to gas lighting in the City. The same was read and placed on tile, and clerk instructed to pl a cknowlledge Communication received from The Termal Syndicate relative to Gas lighting in the City, the same was read and placed on tile. The Clerk was instructed to acknowledge the same. Bond signed by Loren H. Vander Karr for the sum of One Thousand ($1000,.00) Dollars end contract for the repairing of all asphalt pavements in the City of South ✓ Bend, Indiana from May 12th.,1914 until March ist.,1915 was approved by the Board and the same was placed on file in the office of the Board. The Street Commissioner made a report on the followi-rig defective walks in the City, and the Board ordered Thirty day (30) notices sent,. and if not put in'within thirty (30) /d.-iys same to be constructed under Improvement Resolution No. 294. Resolved by the Board of Public Works of the City of South Bend, Indiana St. Joseph County, State of Indiana, That it is deemed necessary to improve North side of East Calvert Street from South Leer Street to South Kline Street by the grading of the North side of said street for the construction of ce-ment sidewalks and cement curbs and the construction of the same, where the same is not already con— structed, And such improvement is now ordered, in accordance with the profile details, drawings and spetificat-�ons on file in the office of the Department of t:he Board of Public Works of said City, and such improvement is now ordered. The cost of said improvement, including the cost of street end talley intersections, shall be assessed upon the real estate abutting on said North Sideof East Calvert Street, all according to the method and manner providedfor in an Act of the General Assembly of the State of'Indiana, entitled, "An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and, pusuant to the pro— visions of all amendatory and suplIlemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent %er annum. Be It Resolved By the Board of Public Works of the City of South Bend, ✓ St Joseph County, State of Indiana, that it is desired and deemed. necessary to im- prove SOUTH LAFAYETTE STREET FROM SIA11PLE STREET TO A POINIT 281-1/2 ft.VORTH OF THE THE NORTH OF TUTT STREET. By reomrfacinlg the roadway, also tie roadway of intersecting and entering street streets and alleys, lying within said portion of said Lafayette.Street not included in the roadway to .be improved, with Asphalt, Bitulithie, Asphaltic Cnncrete or Wooden Block laid on the present surface, except where it is necessary to use concret to bring. the present surface to the proper grade, or* to fill in the holes or other irregularties, from curb line to curb line, placing the necessary ,marginal cement curb, also the construction of the necessary sotrm water inlets all as shown on the plans, and in accordance with the profiles, d6tail drawings and specifications ors file in the office of the Department of Public Works, of said City. Under no circumstances shall the City of South Bend, be, or be held responsi— ble for any sum or sums due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds,- certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have actually been received.by the City from the assessments for such improvement, or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceedings had, and work done in the making of said improvement, assessment of oro ;erty, collection of a.ssessnents and issuance of bonds therefor,, shall be as provided for in said above entitled Act, and Acts amendatory thereof and supplemental thereto. Treat the Board of Public Works five the 16th., day of June,1914 A.D. at the hour of 7:45 P.M. at the office of the Board. of Publi-c Works, of Inds City, as the time ana place for the public consideration of said pro— posed improvement, at w-rzich said Board of Public Works will hear a.:l persons in— terested, or whose property is liable to be assessed for said improvement, and .will decide Wnether tie benefits to the property liable to be assessed for said im— provement will equal the estimated cost thereof.
