DORAU SUPPLEMENTAL AGREEMENT NO.2 This Supplemental Agreement No. 2 is made and entered into this day of , 20/ by and between the City of South Bend, Indiana, acting by and through the Board f Public Works, hereinafter referred to as the "Owner", and DLZ Indiana, LLC, 2211 East Jefferson Blvd., South Bend, IN 46615, hereinafter referred to as the "Engineer". WITNESSETH WHEREAS, the Owner and Engineer did, on February 28, 2017 enter into an agreement for the preparation of construction documents for the construction of the Colfax Avenue Two -Way Conversion as modified by: Supplemental Agreement Number 1 dated October 10, 2017, and WHEREAS, during the course of design, certain additional services, not included in the original contract or Supplemental Agreement No.1, have become necessary; specifically: • Preparation of Three Conceptual Alignments for West ColfaxAlleyApproach • Redesign of West ColfaxAlleyApproach • Repackage the Colfax/Studebaker Intersection Design from the 2018 into the 2019 Project. • Preparation of a Right of Way Dedication Plat for additional right of way required for realigning the West Colfax Alley Approach, if required • Additional negotiation services NOW THEREFORE, the Owner and the Engineer desire to amend the above referenced Design Contract as follows: Add Sub -Section A.5.a.4 ix To Section A1.02 as follows: ix) The Engineer shall provide additional acquisition coordination for Parcel Number . With the property owner's request to relocate the house andgarage, it will be necessary to obtain additional quotes for expenses required to move the structures at 1119 West ColfaxAvenue. Additional coordination will also be required to work though the issues associated with this parcel. Add Sub -Section A.5.a.4 x To Section A1.02 as follows: x) If directed by the Owner, the Engineer shall assist the Owner in obtaining the Right of Way donation from St. Joseph County Parcel 71-08-11104-002. 000-026 for realigning the alley near the intersection of W. ColfaxA venue and Birdsell Street. Ill. Add Sub -Section A.1.c. to Section A1.04 of Exhibit A as follows: c. The Engineer shall develop up to three conceptual alignment options forre-aligning the West Colfax Alley approach. 1of5 Supplemental Agreement No. 2 IV. Add Sub -Section A.1.d. to Section A1.04 of Exhibit A as follows: d. The Engineer shall develop design and plans for re aligning the West ColfaxAlleyApproach based on the Owner's selected preferred alignment option. V. Add Sub -Section A.2.a. to Section A1.04 of Exhibit A as follows: a. As part of the review of the 90%plan submittal, the Owner directed the Engineer to move the design for the ColfaxAvenue and Studebaker Intersection from 2018 phase (115-053A) to the 2019 phase (115-053B). VI. Add Sub -Section A.2.b. to Section A1.04 of Exhibit A as follows: A As part of moving the design for the ColfaxA venue and Studebaker Intersection to the 2019 phase, the City directed the Engineer to re -design the West ColfaxAlleyApproach. The revised alignment will reduce the length ofnewpavement, which will reduce construction costs V11. Add Sub -Section A.2.c. to Section A1.04 of Exhibit A as follows: c. The Engineershall perform a boundary survey and create a legal description for the Proposed Taking across St. Joseph County Parcel71-08-11-104-002.000-026, located near the intersection of W. ColfaxA venue and Birdsell Street. The survey will be performed in accordance with the minimum standard requirements for retracement surveys per 8651AC 1-12. A Plat of Survey will be prepared at a suitable scale and will be signed and stamped by an Indiana Professional Land Surveyor. Unless already monumented, the corners of the parcel will be staked with 5/8'rebar with plastic identibcanon caps, or other suitable material.
