Bids were received, opened and read for pavement on Cedar Street iron JEmerick Street to Eddy Street, under improvement Resolution No. 295. In the City "of South Bend, Indiana. The same were all referred to the City Civil Engineer for tabu- lation* J. E. Kaley appeared before the Board filing plans blue ::priht;3 and a description of Keley's Lincoln Highway Addition. The same was approved by the Board. Communication received from the Chicago, South Bend & Northern Indiana Railway Compa:nrelative to broken trick and asphalt pavement between their tracks.... The Street Commissioner was instructed to make a list of the defect;ve places and report the same to the Railway Company* Conn-unication received from Elmer D. Rex in regard to sidewalk inter- sections. The same was placed on file, and the Street Commissioner was instructed to N investigate. Blue print of the Chicago, Lake Shore and South Bend Railway Com- pany's approach to their barns, was approved by the Board and the following resolu- tion was adopted. RESOLUTION. Upon motion of Arthur H. Rice, seconded by John. B. Weber, the Board / of Public Works of the City of South Bend, Indiana unanimously adopted the fallowing V/ Resolution: - Whereas, on the 25th., day of April,1913 the Board of Public Works of said City, by its written contract, granted certain rights and privileges to the Chicago, Lake Share & South Bend Ry. Co., and to the Chicago, South Bend & Northern Indiana Ry. Co., which written contract was ratified and approved by ordinance by the Common Council of said City on April 29th., 1913 ,being Ordinance No. 1675. And, whereas Section No. Seven (7) of said written contract provides as follows: - "Said companies are also hereby authorized to construct, maintain and operate such "Y'S", turn -outs, cress-evers,poles,wi.res, and overhead construction work as may be or become necessary to connect their respective tracks with their exist ing tracks on the Streets herein mentioned and on other streets and so as to provided proper facilities for the routing of cars for city service and proper facilities for the movement of cars in and out of the respective stations, waiting rooms, terminals and yards of said corpanies, and so as to connect with -each other in the inter- change of traffic,and ane,,a:lso authorized to construct, maintain and operate "Y'S", turn -outs and tract arrangements as may be or become necessary to accommodate the respective companies in the use of any union station at or near any of the junction points or joint trackpoints of the respective companies now hereafter established. Provided, always that before either of said companies shall install any tract arrangement, "Y'S",turn-outs, or cross-overs tntended for the movement of cars in Pnd out of their respective stations, waiting rooms, terminals, and yards, or in- tended to connect each other's tracks for the interchange of traffic, tl*t a drawing shall be furnished to the Board of Public Works, showing the location of the special work"Y'S", turn -outs, cross-overs, and track arrangements and thereupon the said Board of Public Works of said Cit-qT shall approve only such necessary work to accom- plish the purposes herein intended, and said work shall thereupon be constructed as approved by said Board of Public Works and in the manner as by them indicated and to their satisfaction' and not otherwise. " And, whereas, said Chi cago, Lake Shore & South Bend Railway Com- pany has filed with the said Board of Public Works a drawing or blue-print,showing t%ie location of its site for car barn and terminal facilities, which is located on the north side of East La Salle Avenue between Hydraulic Avenue and Sycamore Street. Therefore, be it resolved by said Board of Public Works of said City that said drawing so submitted by said Railway Company's in all things approved, and said Company is in all thing& approved, and said Company is authorized and em- powered to construct its tracks, "Y' S",turn-outs, cross overs and track arrangements as is shovrm in said :drawing or blue -print ,which drawing is made a part of this resolution. 219 Tuesday April 21st. ,1g14. ' The said drawing or plan is approved upon the express condition that said Railway Company shall remove and replace in as good condition as before, all water hydrants, mvLn,-holes, and that said Company shall place all sidewalks sand crossings in good conditions and shall round the curb at the north west corner of La Salle Avenue and Sycamore Street in such manner as to provide a., sufficient clearance for passage be— tween the tracks of said Company and said curb; all of of which work is to be done sub— ject to the approval of the City Civil Engineer. All members present. Declaratory hearing given on improvement Resolution No. 1. 302 for grade, . curb and vel k on Francis Street from First Alley South of Sorin Street to Madison Street. Innthe City of South Bend, Indiana. In the above matter no remonstrators appeared and no remonstrances were filed. Tj,e Board therefore find in each and every case of said improvement that the benefits to the piZoperty and to the r;+,Er .,� c�„+�, n� are equal to the esti- mated cost of said,,imp,rovement and the same are hereby in all things ratified,con- firmed and approved. The Board reserves the right to reject any or All bids. Declaratory hearing given on improvenent Resolution No. 301 for pavement / on Sherman Avenue from 14ic'higan Avenue to South end of said -Street. In the City of V South Bend, Indiana. In the above matter all action was deferred until Tuesday April 2Sth.2 1914 at 7:45 P.M. Declaratory nearing given on improvement Resolution No. 303 for grade, / curb and walk on Meade Street from Washington Street to Bertrand Street. In the City ,YJ of South Bend, Indiana. In the above matter no remonstrators appeared and no remonstrances were filed.. The Board therefore find in each and every case in said improvement that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improvement and the same are hereby in all things ratified confirmed and approved. Resolved, that notices be published on the 23rd. day,of April,1914 and on the 30th., day of Apri1,1914 in the South Bend Daily "ribu 6 ; stating that this Board will receive bids for the construction of said improvements up to 10:00 A.I. on the 12th. , day of ?day, 1914. Gentlemen: In the matter of bids for the improvement of the roadway of Cedar Street from Emerick Street to Eddy Street, according to the improvement Resolu- tion No. 295. 1914 . I hereby report that I nave tabulated tine same and find that the bid of Rankert and Eggleston is the lowest and best for Asphaltic Con- crete and the bid of C. Continued., ORDER SELECTING KIND OF MATERIAL Concerning the improvement of the roadway of Cedar Street from Emerick Street to Eddy Street, in pursuance of improvement Resolution No. 295, 914 the preliminary order for the improvement heretofore adopted is her ' eby con-, irmed. The Board now orders that so much of t1ie said street be improved with ASPHALTIC CONCRETE and awaeds the contract to RANKERT EGGLESTON they being the lowest and best bidders. E. 11. WEBER The Board made a preli-inary award of the pavenent on Cedar Street from Emerick Street to Eddy Street to Rankert and Eggleston of Asphaltic Concrete, the award expiring on 10;00 A.M. May 2nd.,1914. Petition for curb and walk on Wilber Street between Linden and Michigan Avenue filed with the Board. The same was referred to the City Civil ngineer for investigation. Petition for an opening of Sherman Avenue south to Oak Street presented to the Board. The some was read zmd placed on file. The, following resolution was adopted by the Board* RESOLUTION. Upon motion of John B. Weber, seconded by Arthur H. Rice, the following Resolution was unanimously adopted: - Whereas, on March 25th. 1913, the Board of Public Works of the City of South Bend adopted Condemnation Resolution No. Twenty-three (23), recorded in the Records of said Board of Public Works, in Record No. Four(4) at page 752 for the open- ing of Huey Street in said City, and on March 27th.,,1914 said Board caused to be pre- pared and filed, a list or roll of all the owners or holders -of property, and of all interests therein sought to be taken or to be injuriously effected; also a desckiption of each piece -of property belonging to stash persons and to be taken, or to be effected either beneficially or injuriously. And, Whereas, there was a defect and error in making said list in tl)P--t the property of one person affected by said resolution was incorrectly described, and in that the property of a certain other person was,not included in said list. Therefore, in pursuance to Section 8703 of Burnt Revised Statutes of 1914, and in pursuance to all other laws of the State of Indiana in relation to said subject, said assessment list is hereby corrected and it shall bb as follows: - The description of the property of Jacob Andrzysiak shall be: - Six (6) acres of east end of ten (10) acres off west end in W-1/2 of N. E. 1/4 T. 37 N.R. 2 E. except one acre off of west end; and his damages are assessed at 0175.00, and his benefits are assessed at $150-00. Resolved by the Board of Public Works of the City of South Bend, 5t. Joseph County, State of Indiana,, That the construction .of a- local sewerJ.11- tended,and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains;, be and the sane is., hereby ordered in and along CAMPAU STREET from the center of WALSH STREET to the center of the FIRST ALLEY EAST OF WALSH STRFETviz:- Begin at the manhole in the center of Campau Street and Walsh Street, thence east on the center line of said Campau Street to the center of the First Alley east of said Walsh Street with an 18 inch vitrified pipe sewer. Together witli'i the necessary manholes, inlets, conduits and house con-negtions to the curb line along the line of said improvement. And such improvement i-s now. ordered. And said sewer,, with all its appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said City. The cost of said im- provement shall be apportioned against and paid by the property holders wiose pro- perty abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Colporations". approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual installments with interest at the rate of Six per cent per annum. A bond or bonds shall be i sued to the contractor in payment for such wark.unless the property owners pay said assessments. before said bond or bonds are issued.Under no circumstances shall the City of South Bend be or be held responisble for any sum due from said property owner or oviners, for said work, or for the collection of , same or for the payment of any bond or bonds, certificate or certificates, issued to. said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such noneysas said City, is by said above entitled Act required to pay. All proceedings -had, and work done in the making of said improvement, assessment of property,cal- 1-ections of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the 24th. day of April 1914 and on the Ist. day of May.1914 in the South Bend Daily Tribune. JOSEPH,STATE OF INDIANA: That it is desired and deemed necessary to construct a sewer in LEER STREET RIND Ci\LVERT STREET, FROM THE ST. JOSEPH RIVER TO VERNON STREET. all in said City, which, from its size and character, is not only intended and adapted for use by property owners whose property abuts along the line of .said sewer, but is also in- tended and adapted for receiving sewage From collateral drains already c' nstructed or which may be hereafter constructed, and the same is hereby ordered constructed in and along the following line in.said City,to-wit:. Begin. at the St. Joseph River where the center line of Leer Street produced northerly inte-rsects same; thence southerly on the center line of Leer Street produced to a point_ on Vistula Avenue about five feet south of the northerly curb line- with an 19 inch vitrified pipe sewer; thence still southerly on the center line of Leer Street to the center of Dubail Avenue west with an 24 inen vitrified pipe; thence still south on the center .line of said Leer Street to the center of Calvert Street east with a 20 inch vitrified pipe sewer; thence east on the center line of Calvert Street to the center line of Vernon Street south w: th a 15 inch vitri- fied pipe sewer. Together with the necessary Hanholes, Inlets and House9 connections to the curb line along the line of said improve- ment . And to be. built in accordance with the profiles, specifications, detail plans, maps and estimates now on, file in the office of the Department of Public Works of said City, which includes an estimate of the proportion that the cost of an adequate local sewer, built along the above line, bears to the cost of the main sewer, to be built as follows: The cost of an adequate local sewer, built along the line above described ,is hereby estimated and Fixed to. be _ of the cost of the main sewer to be built along said line as above set .forth , which proportion, as herein_ estimated and fixed, shall be taken and adolited in all computations requiring a knowledge of .the cost of such local sewer if built along the line where the main sewer is to be built. The` cost of the construction of said sewer shall be divided as follows: 1. So much of such cost as shall be equivalent to the construction, of an adequate local sewer not adapted to receive sewage from collateral drains or sewers, if built along the propsed line as hereinabove set forth, shall be paid by the abutting pro- perty holders and the City of South Bend, if it be determined that said City -is'benefited by said sewer in the same manner and to the same extent as local sewers, are paid -,for by them, under the Statutes in such cases made and provided. 2. And each piece of property in said district or area above described, including abutting property holders and the said City of South Bend, if the said City is_benefited, shall be assessed, as aforesaid, to pay said excess of cost over and above what would be equivilent to the cost of a local sewer; all. of which will more folly appear by reference to the profiles, map, drawings and specifications now on file in -the office of the Department of Public Works of said City, w ich,. among other things, gives the exact course of said proposed main sewer, overflows,` and its Appurtenances, and the district or area which may be injuriously or benef°iciilly affected thereby, as shown by the boundary lines marked on said map and drawings, with proper words and figures written thereon, clearly indicating what said heavy boundary lines represent, and the district or area embraced thereby. Assessments, if deferred, are to be paid in ten equal annual installments , with interest at the rate of six per cent per arrraum. A bond or bonds shall be issued to the contractor in payment for said work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from said property ewer or owners for said work, or for the collection of the same, or for the payme�it of any bond., bonds, certificate or certificates issued to said contractor in payment for such work, except for such moneys as small :lave been actually re eeived by said City from the assessments for such improvements. All proceedings had and work done in the construction of said main sewer and its appurtenances, manner of assessment of property collection of assess- ments and issuance of bonds therefor, shall be as provided for in an Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Mftncipal Corporations," in matters pertaining to the constitution, alteration and maintenance of public drains and sewers, providing for the construction, alteration and main- tenance of such sewers and drains in such cities and within pour miles thereof also providing f-r the assessment of property specially benefited thereby for the payment thereof, in whole or in part, and for the collection of such assessments, repealing all laws and parts of lags in conflict therewith, and declaring an emergency.ap- proved March 611905, and all acts supplementary and amendatory thereto, passed by the General Assembly of the State of? Indiana. Notice of this resolution shall be published on the 24th. day of April 1914 and on the lst. day Of May21914 in the South Bend Daily Tribune. That it is deemed necessary to improve PENNS)YLVANIA AVENUE FROM NIGH STREET TO MIAMI STREET by th4 grading of both sides of said street for the construc- tion of cement sidewalks and the construction of the same, 'tvhere the same is not already constructed and such improvement is now ordered, in accordance with the profile., details, drawings and specifications now on file in the Office of the Department. of �the Board of Public Works of said City) and such improvement is now ordered. The cost of said improvement, including the cost of street and alley inter- sections, shall be assessed upon the real estate abutting on said Peinsylvania Avenue all according tot he method and manner provided for in an Act of the General Assembly of the State of Indiana, e,ntitled,,"An Act Concerning Municipal Corporations, " approved March 6th.,19p5,,and in accordance with and pusuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assess- ments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per amum. A bond or bonds shall be issued to the contractor in pay merit of such work, unless the property owners pay assessment before said bond or bonds are issued.
