Tuesday April 7th.11914.
Board met in regular .session at 10:00 A.N. All members present.
The City School Board appeared. before the Board in regard to the matter
/of the William Street opening. The matter was referred to the City Attorney and
the School City Attorney.
Mr. Stewart,of Stewart -Sheets Company -,Contractors on the Bowman. Creek
sewer, appeared before the Board in regard to the street car crossing of East
Indiana Avenue.
Loved and carried that the Chicago, Lake Shore and South Bend Ry. Co:
J. can have the privilege of making the approach to lot on La Salle Avenue,on condi-
tion that they build a presentable fence along the Street.
J Board ordered one half bll. of C.H.N. desinfectant at $1.00 per gal.
f. o. b. South Bend. 2% ten (10) days. They to furnish holders and inspector.
Bought from West Desinfecting Company, of Cilicago, Ill.,
The Chicago, South Bend & Northern Indiana Ry. Company, was ordered to
settle their ground on Pennsylvania Avenue.
The followmng resolttion was adopted by the Board and referred to the

Gentlemen:- The Board of Public Works herewith presents its report for
the following Sewer, gas and water connections.

RESOLUTION OF THE BOARD OF PUBLIC STORKS.
On motion.duly made and seconded, the following preamble and resolutions
were unanimously adopted:
WHEREAS. This Board did on the 17th., day of February21914 deem it
expedient and of public utility to permanently improve CEDAR STREET between
Emerick Street and Eddy Street, by paving the roadway of the same, and did on said
date pass and adopt a resdlution authorizing said permanent improvement, and
WHEREAS, The City Engineer has prepared .and filed with this Board a
report showing the number and location, as well as the material to be used and the
manner of laying the same, of the service pipes, mains, conduits, laterals, and
sonnections which are, or will be necessary to accommodate the abutting property
owners with gas, water, heat, steam or any other product for which any person firm
or corporation has been granted a franchise for supplying the citizens of the City
of South Bend, Indiana, which report if as follows: -

And beit Further Resolved, that is -is . contemplated by this �-.oard to im-
prove Cedar Street from F.merick Street to Eddy Street all ih said City of South Bend,
by constrution of pavement., and that it is, and is hereby do declared, necessary for the
Northern Indiana Gas and Electric Company, which has, and operates under, a franchise from
said City to supply gas to the citizens tuft said City, to provide and install mains, later-
als, service pipes and connections for gas in said pa�_►•t of said street, of the description
location and number set forth in said report of said City Engineer, which mains, service
pipes and connections are hereby declared necessar�� for the immediate use of said com-
pany in supplying gas to the owners of property abutting upon said part of said street.

JHearing given on improvement Resolution No. 296. for the pavement o-f
Pennsylvania Avenue from Michigan Street to Miami Street._. In the City of South
Bend, Indiana.
In the above matter a further remonstrance and petition was filed. The
Board after due consideration decided that in each and every case in said improve-
ment that the benefits to the property a r are equal to.
the estimated cost of said improvement, and the same are hereby in all things,
ratified, confirmed and approved.
Resolved further, that notices be published on the 9th., day of April,
1914 and onnt:ne 16th., day of Apri1,1914 in the South Bend Daily Tribune,stating
that this. Board will receive -bids for the construction of said improvement up to
10:00 A.M. on the 29th. , day of April,1914. The Board reserves the right to re-
ject any and all bids..

Petition filed with the Board for the placing of a street light at
the corner of Broadway and Fellow Streets. The same was read and referred to the
Street Commissioner for investigation.

Regarding the petition of Councilman Goebel for sidewalk on East side of
Prairie Avenue from Sample St. to the 1st. alley north of Leon Ct. I recommend

BE It Resolved btr the Board of Public Works of the City of South
J Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary to
improve THE FIRST ALLEY NEST 0 FAAIN STREET FROM MARIO'N STREET TO NAVARRE STREET,
as follows ,to -wit"
By grading said. Hirst Alley west of Main Street from Marion Street to
Navarre Street,. from property line to property line, and paving the said alley its
full width , with Asphalt , Asphaltic Concrete, Bithulithic, Wooden Ble k, concrete
or Brick laid on a five (5) inch, Portland Cement Gravel Concrete Foundation, or with
brick laid on a six (6) inc rolled gravel foundation, placing the necessa,ry.margin-.
al cement . curb and the construction of the necessary storm water inlets. All as show
shown on the plans, and in accordance with the profiles, detail drawings and speci-
ficiations on file on the office of the Department of Public Works of said City.
And such improvement is now ordered.
The cost of the improvement herein provided for, except street and alley
intersections, shall be paid by -specif ieal assessment to be levied upon the property
specially benefitted, to the amount that the same may be legally assessed therefor,
in acco rdancewith an Act of the General Assembly of the State of Indiana, entitled,
"An Act Concerning Muncipal Corporations," approved March 6,1905, and in accordance
with and pursuant to the provisions of all acts amendatory and, supplemental thereto.
The cost of all street and alley intersections, including one-half of
the width of the improvement opposite street and .alleys which run into, but do not
cross said roadway herein proposed to be improved andthat portion of such street
or alley abutting upon property belonging to said City, or upon property not subject
to such assessment, shall be paid by the City in cash out of its general fund, it
able to do so, o n from a fund created by a special assessment to be levied under the
provisions of Section 109 of the above ent itled Act.
w Assessments of Ten dollars and more aginst each lot, if deferred,are
to be paid in ten equal annual installments, with interest at the rate of Six per
cent per annum. A bond or bonds will be issued to the contractor to the amount
of such deferred- assessments in pro rata payment for such improvement.

sum or suns due from said property owner or owners for said work, or for the c.ol-
r lection of the same, or for the payment of any bond, bonds, certificate ar certi-
ficates, issued to said contractor in payment for suchwork, except for such moneys,
as shall have actually been received by the City From the assessments for such
improvement, or such moneys as said City is by said entitled Act and amendments
and suplilements thereto required to pay. All proceedings had, and work done in
the making --f said improvement, assessment df property, collection of assessments
and issuance of 'Qonds therefor, shall be as provided for in said above entitled
Act and Act amendatory thereof and supplemental thereto.

day of 14ay.1914 at the hour of 7:45 P.14., at the office of the Board of.Public Works,
of this City, as the time and place for the public consideration of said proposed improve -
went, at which said Board of Public Works will. hear all persons interested, or whose- pro—
perty is liable to 'be assessed for said improvement,, and will decide whether the benefits
to the property liable to be assessed for said improvement will equal the estimated cost
thereof.
BE IT rURTHER RESOLVED) That notice of the time and. place of such public
consideration be published and mailed in'the manner provided by law. Notice of this
resolution shall be published on the llth. day of April,1914 and on the l8th., day of
April.1914 in the South Bend Daily Tribune.

BE IT RESOLVED. That said report of said City Engineer be and the
same is hereby adopted.

And be it further Resolved, that it is contemplated by this Board
to imlarove PENNSYLVANIA A VENUE FROM MrCHIGAN STREET TO RIAI4II STREET, all in said City of
South Bend, by construction of a pavemext ,and that it is, and is hereby so declared,
necessary for the Northern Indiana Gas -& Electric Company, which has, and operates under?
a franchise from said City to supply gas to the citizens of said City, to. provide and in—
stall mains, laterals, seSrvice_gipes and connections for gas in said part of said street
of the description., location and number set forth in said report of said City Engineer
which mains, service pipes and connections are hereby declared necessary for the immediate
use of said Company in supplying gas to the owners of property abuttmng upon said part of
said street.
