Petition filed with the Board for, the placing of street Tight at the / i,Itersection of' Lincoln. Street and Michigan Avenue. The same was read and referred to the Street Commissioner for investigation,. Petition filed with the Board for the placing of a street light at the intersection of Blanch Street and Scott Street. Resolved by the Board of Public forks of the City of South Bernd,` St. Zostph County, State of IAdiaxa,, That it is deemed necessary to improve FRANCIS STREET from FIRST A!'jLEY ;SOUTH OF SORIN STREET TO MADISON STREET BY THE CONSTRUCTION1 OF CEMENT SIDEWALKS AND CFJAENT CURB ON BOTH SIDES OF SAID FRATTCIS STREET, where the same is xot already constructed. And Suchimprovement is now ordered, -in accordance withthe profile, de- tails, drawings and sped:ifcations on file in the office of the Department of the Board of Public Works of, said City; and such improvement is now ordered. Be It resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve STCRMAN AVENUE from MICHIGAN AVENUE tO the SOUTH END OF SAID 4. STREET, as follows,to-wit:- By grading and paving the roadway, also grading and paving the roadway of all intersecting and entering streets and alleys, lying within said potion of said Sherman Avenue not included in the roadway to be' improved with Asphalt, Asphaltic Concrete, Bithulithic , Wooden Block or Brick laid do a five inch Portland Cement gravel concrete foadation. Or with brick laid on a six (6) inch rolled gravel foundation, placing the necessary marginal cement curb, curbing the roadway with cement curb where same is not already constructed, also the construction of the necessary storm water inlets. All as shovim on the plans and in accordance with the profiles, detail drawings and specifications on file in the office of the Department of Public Works of said City. And such improvement is now ordered. -The cost of the improvement hereinprovided for, except street and alley intersections, s"aall be paid by special assessment to be le�Tied upon the property specially benefitteJ, to the a_-�ount that the same ray be legally assessed therefor, in accordance with an Act bf the Gheral Asserbly of the Sta-e of Indiana, entitled "An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and pursuant to the provisions of all acts amendatoryandsupplemental thereto. The cost of all street and alley intersections, including one-half of the Width of the improvement opposite street and alleys which run into, but do not cross said roadway herein proposed to be improved and that portion of such street or alley abut- ting upon property belonging to said City ,or upon property not subject to such assess- ment, shall be paid by the City, in casn out of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the provisions of Section 108 of the above entitled Act. Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at- the rate of Six per Gent per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rata payment for such improvement. Under no circumstances shall the City of South Bend, be, or be Held responsible for any sum or sums due from said property owner or owners for said jrrork,or for the collection of the same, or for the payment of ally bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as said City is by said entitled Act and arendements and supplements thereto required to pay. All proceedings had, and work done in the making of said improvement assessment of property , collection of assessments and issuance of bonds therefor,.shall be as provided for in said above e ititled Act, and Acts amendatory thereof and supplemental thereto. Be It Further Resolved, That the Board of Public Works fix the 21st• , day of April 1914 at the hour of 7:45 P.M. at the office of the Board of Public forks, of City, as the time and place for the public consideration of said proposed improvement at which said Board of Public Works will hEar all persons interested, or whose property is liable to be assessed for said improvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the estimated cost thereof. Be It Further Resolved. That notice of the tire and place of such public consideration be published and mailed in the manner provided by law. J Resolved by the Board of Public Works of the City of South Bend,, - St. Joseph County; -State of Indiana, That it is deemed necessary to inprove Meade Street from Washington Street..to Bertrand Street by the construction of cement .sidewalks .and cement curb on both sides of- said Meade Street, where the sar_:e is not already constructed. And such improvement is now ordered, in accordance with the profile details, drawings and speefieatioris on file in the office of the Department of the Public Works of said City; and such improvementsis now` ordered. BOARD OF PUBLIC ?STORKS. 2S7 10 The City Engineer submitted the list of property owners in the matter c/of �he appropriation ofn certain property under condemnation resolution Number 23, which list includes the names-ofthe owners and holders of property and of interests therein sough to be taken or beneficially or injuriously effected, and the description of the. seve"ral pieces of property which is affected by the said approtri:ation proceedings. Thereupon the Board proceeded to award the damages sustained and to asse-ss the benefits accruing to each piece of property upon said list. It was thereupon, upon motion duly made and seconded an unanimously adopted, resolved that said list, together with the'. amounts of benefits and damages and net benefits and net damages therein set forth as to the several parcels of land be adopted and ordered spread upon this record by reference, and that the respective amount of benefits contained in said list be and are hereby assessed against the several tracts of land as specially set forth in said list, and that the respective amounts of damages contained in the said list be and are hereby awarded to the serveal tracts of land as specially set forth in said list, and that the net benefits or net damages`, as the case a�be as to the respective tracts of land, contained in said list are hereby awarded or assessed, as the case may be as to the said several tracts of land. The Board hereby further sets off the benefits and damages each against the 4 other where both .benefits and damages are assessed against the same piece of pro— perty, tract of land or interest, and hereby fixes said respective net benefits as the amount that shall be paid by the respective wwners as benefits, and further hereby fixes the'respective net damages as to -the several tracts as the amount that shall be paid to the , owners of the respective tracts as damages. Thereupon, upon motion duly made and seconded and unanimously adopted, the ^ 5th. , day of May,1914 was fixed as the day on which this Board will receive or hear remonstrances from persons 1 ith regard to the amount of their respective awards or assess— ments2 and the Clerk of this Board was instructed to prepare and cause to be duly and legally given, notices to the owners of each parcel of property, showing the amount of the assessment or award, with a description of the property affected, and the date of said hearing. Hearing given on Improvement Resolution No. 296 for the Pavement on Pennsylvania Avenue from Michigan Street to Miami Street, In the City of South Bend, Indiana. In the above matter remonstrators appeared before the Board, but' no further written remonstrance was filed. The Board therefore after due consideration, decided to defer all action on sane, until Tuesday March 31st.11914 at 7:45 P.M. Hearing given ©n improvement Resolution No. 295 for the Pavement on Cedar Street from Emerick Street to Eddy Street, In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no remonstrances were filed. The Board therefore find in each and every case in said improvement that the benefits to the property and to the City of South Bend are equal to the estimated cost of said improvement, and the same are hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the 31st., day of March 1914 and on the 7th., day of Apri121914 in the South Bend Daily Tribune, stating that this Board will receive bids for the construction of said improvement up to 10:00 A.M. on the 2ldt day of April,1914. Communication received from H. N. Banres asking for the privelege of sub- stituting other kind of brick for the Wabash Brick as part of Resolution No. 293 to be used in the construction of pavement on Ford Street. The Board after considering the matter referred the same to the City Engineer ,who submitted the following recommendation. I recommend Barr Clay be used instead of Wabash providing Barnes will furnish same at $1.40 per sq. yd$ this bid for Wabash . WM. S. MOORE. The Clerk was instructed to informs.
