Tuesday March 17th. , 1914.
Board met in regular session at 10:00 A.M. All Members present.
Bids were received opened and read for grade, curb and walk on Ba;e
Avenue from Dayton. Street to Boirman Street, under improvement Resolut-Lon No. 2F)4
in the City of South Bend. , The same was referred to the City Engineer for tabu—
lation.
Bids were reaceiVesd, opened and read for F;rade, curb and. walk on

Mr. George Ford appeared before the Board and presented a; play, for
the opening of South Scott Street north from Washington Avenue to Colfax Avenue

Permission was -granted the Indiana &- Michigan Electric Compairw to
set t)ie following anchor.
To set one anchor on the south—east corner of the first alley north of
Washington Street, on Taylor, to guy pole No. 2279.
Boxd No. S-9375 for the sum. of Two Thousand ($21000.00) Dollars
✓signed by Fred S. Kale as principal, anal the Aetna Accident and Liability Company of
ljartford'� Conxe.cticu.t; for tre erecting and maintaining of billboards in the City, was
renewed by the Board.
The renewal of the bond -'signed by the_ South Bend Bill Posting Company
,,'as prin.icipal, and the Aetna Accident and Liability Company of Hartford Connecticut
as sureties, for the erecting and maintaining of billboards in trLis City was approved
by the Board.
The City Engineer reported on the Petition for pipe sewer on. Campau
r✓ Street from Walsh St. to First alle-Tr East. Clerk instructed to notify member of the
Park Board to be present at the meeting on Tuesday March 24th., 1914 at 7:45 P.M.

Petition filed with the Board to appropriate the intervening land in line
^rith South Scott Street from Sample Street to the Terre Haute R. R. to the full width of
South Scott Street. The same was read and refrred to the City Engineer for investigation.

Michigan Avenu* to the south end of said street. I beg to report that I have in-
vestigated the same and beg to report that the petition be granted. The cost
Of the intersection will amount to about $650.00.

structed but not grade the roadway..

THIS AGREE 1ENT,Made and entered into at the City of South Bend,
County of St. Joseph, anD State of Indiana, by and between the City of South Bend,
Indiana, by its Board of Public Works, party of the first part, and George W.
Stewart and Samuel Sheets, partners, doing business under tre firm name and style
Of Stewart, Sheets & Company, of the City of Vineennes, State of Indiana, party
of the second part ,WITNESSETH:- r
That, whereas, on the loth., day of 11arch,1914, tl`ie parties of the
seeond part, by their written agreement, contracted with the party of the first pat
part to build and construct a sheer wall for the protection of the Bowman Creek
Trunk sewer at a point on the North side of the Lake Shore & 14ichigan Southern
Railway Coicpany's culvert.
And, w-bereas, the party of the first part desires to have con-
structe -d, as apart of- 4941,id d proveersent described in said. contract executee? March
loth. , 1914, an additional concrete floor or apron to be laid in connection with
said sheer or retaining wall.
Therefore, it is agreed by and between t+.he parties that the parties
of the second part , will construct said concrete floor according to plans and
Specifications drawn by the City.E:a€;sneer oft -he City of South Bead.
And- in consideration of the construction of said Floor, and the dues
performance of this contract, the party of the first part agrees to pay the par-
ties of the second part the suit of Ten (10) cents per square foot.
If is further agreed that all said work shall be constm cted and all
said work be performed within days from the date hereof.

Hof land lying in, .lin.e ,with north end of Frances Street from First alley north of Miner
Street to Soria Street. The same was read and referred to the City Engineer for in-
vestigation..
Excavation bona for the sure of One Thousand ($1,000.00)Dollars signed
by W. W. Sibley Co. as principal and Globe Indemnity Colapany of New -York as sureties was
approved by the Board.
Excavation bond for the sum. of One Thousand ( 1,000.00) Dollars signed
J by Wm . F. Burke as'principal and Globe Inder!nity Company of hTew York as sureties was
approved_ by the Board..
Excavation bond for the suit of One Thousand (91,000.00) Dollars signed
J by Christian. Aichele as principal and The Globe Indemnity Company if New York as sureties
was approved by the Board.
Excavation, bond for the sure of One Thousand ($ 1,000.00)Dollars signed
by Indiana and Michigan Electkie Company as principal and Fred A. Bryan and Fred -L.
Dennis as sureties, was approved by the Board.
Excavation bond for the sure of One Thousand ($1,000.00) Dollars signed_
j by Edward Mahler Sr. and Ernest Mahler as principal and the Souther. Surety Compare as
sureties, was approved by the Board.
A motion, made, s,,econded and unanimously carried to the affect that the
d Street Railway Companies replace the brick placed by tber, on North Main Street and
Colfax Avenue with asphalt, in accordance with Ordinance No. 16751pand Con.traet signed
with.' the Board on. April 28th., 1913.

STREET AND AIaLEY IMPROVEMENT RESOLUTION NO. 300.
BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF,SOUTH BEND,
ST. JOSEPH COUNTY,STATE OF INDIANA, that it is desired and deemed necessary to im-
prove FIRST ALLEY WEST OF PARK_ AVNUE _FROM NAVARRE STREET TO LA MONTE TERRACE as
follows:- to -wit: -
By gradigg; said First alley West of Park Avenue froze. Navarre Htreet
to La Monte Terrace from property line to property lime, and paving the, said ,alley
its full width and six (6) inches in depth with a Portland cement Gravel: Concrete
pavement. Placing the .necessary marginal cement curb and the construction of the
necessary storm water inlets.4 All as shown on the plans, all in accordance with the
profiles, detail drawings and specifications on file in the office of the Depart-
ment of Public Works of said City.
And such improvement is now ordered.
The cost of the improvement herein provided for, except street and
alley intersections, shall be paid by special assessment to be levied upon the pro-
perty specially •benefitted to the amount that the same may be legally assessed there-
for, in accordance with are Act of the General Assembley of the State of Indiana, en-
titled " An Act Concerning Municipal Corporations," approved March 6,1905, and in
accordance with and pursuant to the provisions of,all acts amendatory and supplementd.
thereto.
The cost of all street and alley intersections, including one -calf
of the width of the improve•merlt opposite street and alleys which run into, but do
not cross said roadway herein proposed to be improved and that portion, of sueh street
or alley abutting upon property belonging; to Eaid_ C*t-v or upoia property not sub jeectt
to suers assessment, shall be paid by tne City in cash out of its general fund, if
able to do so, or from a fund created by a special assessment to be levied under the
provisions of Section 109 of the above entitled Act.
Assessments of tell dollars and more .agaist each lot, if deferrecc7
are to be paid in. ten Equal annual installments, with interest at the rate of Six
per cent per annum. A bond or bonds will be i .sued to the contract to the amount
of such deferred assessments in pro rata payment for sued improvement.
Under no circumstances' shall the City of South Bend, be, or be held
responsible for any sum or sums due from said -property owner or owners for said work
or for the collection of the same, or for the payment of any bond, bonds, certi-
ficates, issued to said contractor in payment ('or such work, except for such mdnays
as shall actua,llt been received. by they City from the assessments for such improvement
or such moneys as said City is by said entitled Act and &m.endraents and supplements
thereto required to pay. All proceedings had, and work done in the making of said
improvement€, assess_ent of property, collection of assessments and issuance of
bonds therefor, shall be as provided for in said above entitled Aet, &'nd Acts
amendatory thereof and supllemental thereto.
BE IT FURTHER RESOLVED, That the Boa»d of Public Works fix the
14th., day pf April, A. D. 1914 at the hour of 7:45 P.M. at the office of the Board
of Public Works, of trii.s City, as the time and place for the public consideration
of said proposed improvements, at which said Board of Public Works will hear
all persons interested, or whose property is liable to be assessed for said im-
provement, and will decide whether the benefits' to the property liable to be assessed
for said improvement will equal the estimated cost thereof.
BE IT FURTHER RESOLVED, That notice of the time and pla,ee of such
Public; consideration be published and mailed in the manner provided by law. Notice
of this resolution shall be published on the 19th., day of March 1914 amd on. the 26th
day of March ,1914 in thA South Bend Daily Tribune. -
