Board of Public Works met in regula.r session at 10:00 A.M. Mr. Bastian absent. Mr.
F.E. Lambert acting President.

and Michigan Southern Ry. and Mr. E. H. Potter, Agent for same, appeared before the Board
There was we action taken.
Plat of Ida Studebaker ,Kuhns & Helen Studebaker Henderson First Sub. Divisioh,presexted
to the Board. The same was referred to the City Engineer for investigation.
j In the matter of bids on Portage Avenue sewer, under Improvement Resolution No. 263.

KNOW ALL MEN BY THESE PRESENTS, That Indiana & Michigax Electric Com—
pav, a corporation organized under the lags of the State of Ixdiaxa, ( hereafter called
the principal) and the

a corporation created and existing under the laws of the State of Maryland; and whose
principal office isloeated in Baltimore State of Marylaxd,(14ereixafter called tip
surety are held and firmly bound unto the municipal City of South Bend, indiaxa, here-
inafter called the obligee), in the full and just sum of
TWENTY—FIVE THOUSAND ($25,000.00 )DOLLARS,
lawful money of the United States, to the payment of which sum well and truly to be made,
the said prinicipal binds itself, its successors and assigns, and the said surety binds
itself, its successors and assigns, jointly and severally, firmly by these presents, for
and during the term begin.Znixg on the 16th., day of December,1913, at xeox, and eAdixg

WHEREAS, said prinicipal entered into a certain written contract with
the obligee, dated November 24th. ,1913, and ratified, by Ordinance No. 1702, of the
Common. Council 4f said City, on December gth.,1913, for the lighting of the streets,
41leys, boulevards and public places of said City, for the period of Ten (10) years,begini
With January .lst.,1915, and all in accordance with certain plans and specifications provi—
ded thereforby said obligee, which plans and specifications are a part of said contract.
NOW,THEREFORE, the condition of the foregoing obligation, is such that
if the said prinicipal shall well and truly indemnify and save harmless the. said ®bligee
from any pecuniary loss resulting from the breach of any of the terms, covenants and
conditions of the said contract on the part of the said principal to be performed then
this obligation shall be void; otherwise to remain in full farce and effect in law;
PROVIDED, however ,that this band is issued subject to the fallowing conditions and provi—
sions:,
That in case of such default on the part of the principal the surety
shall have the right,if it so desire, to assume and complete or procure the completion of
said contract;.and in case of such default, the surety shall be subrogated and entitled to
11 the rights and properties of the principal arising out of the said contract and
Itherrr'ise,including all securites and indemnities theeetefore received by the obligee..'=
and ail deferred payments, retained percentages and credits due to the principal at the time
of such default, or to become due thereafter by the terms and dates of the contrast.

This Bond may be renewed each year by the execution and delivery by the
obligee of a certificate ael ewledging the receipt of the consideration for an-
other year's liability., and the delivery ofmsaid certificate shall bind the prin'.
cipal and surety hereunder for the term expressed in said certificate in all re-
spects according to the terms and condition of the within band.

be sealed with its corporate seal, attested by the signatures of its duly auhtor-'.
