Regular Meeting held by the Board of Public Safety, -Monday, July 31,
1933.
Meeting called to order by jr. C. A. Budd, President, at 9 -10 A. M.

The following communication received by the Board from John B. Kuespert,
Chief of Police:
"July 31. 1933
The Honorable Board of
Public Safety,
South Banc';, Indiana.
Gentlemmen:
I her transmit to you a communication received by me from the
Mayor. The ?purported resignation was given to the i before my,
incumbency in office.
I call your attention to the fact that the :`Mayor of the City is not the
proper person to receive and act upon any resignation of its chief of
police. That is a perogative of the department of Public Safety. I
am advised that any instrument purporting to be a resignation given
to be held even.by the appointing power for use at its pleasure is
contrary to public policy and void.
Consequently subject to your jurisdiction as to the duration of my tenure,
I am continuin as Chief of Police.
Yours Respectfully
John B. Kuespert, Chief of Police."
The communication attached to the above letter is the same as the letter
attached to Mayor's letter as shown below:

Hinkle:
"July 28, 1933
Hoard of Public Safety,
City of South Bend, Indiana.

I have this date, accepted the resignation of4r. John B. Kuespert,
the copy of chich is attached hereto.
Until a man qualified to fill th's position has been found, I v�;ill
not make an appointment. In the meantime, the AssistanA'Chief oan

The copy of letter attached to the above letter is as follows:

City Hall,
South Bend, Indiana.
" July 28' 1933.
Dear Mir. Kuespert:
I hereby accept your resignation, effective today.., July 28, 1933, given .
to me at the time of your appointment and signed on the date you have
stated in the public press, which resignation reads as follows:
tHonorable 'qlliam Rily' Hinkle,
Mayor of the City of South B Indiana.
I hereby tender my resignation as Chief of Police
of the City of South Bend, the same to take effect
at your pleasure.

Chief.'
I have forwarded a letter to the Board of Public Safety and am attaching
a copy :of your resignation thereto. I` have also instructed the City
Controller, on proper affidavit, to pay you to and including today.

The Board ordered the above communications placed on file.
_ Chief of Police John B. Kuespert, appeared before the Board and reported.
the activities of the Police Department for the past week.
FIRE DEPARTMENT
Fire Chief, Roy Knoblock, reported the activities of his department for
the past week.
ELECTRICAL DEPART I T
Supterindendent William F. Qualls, was present and reported the activities
of<,.his department for the past week.
#EIGHTS AND MEASURES
Weekly report of City Sealer, Charles J. Burns, was examined and approved
and ordered placed on file.
Meeting adjourned at 12 o'clock noon.
