Board net in speeial session at 5:00 P.M. All members present.
The following contract for the Street Lighting in the City of South Bend, Indiana
was adopted by the unanimous consent of the Board and was referred to the Cotmon
Council for ratification.
CONTRACT FOR LIGHTING.
in Triplicate
THIS INDENTURE Made in the City of South Bend, County of St. Joseph. and
'State of Indiana, this 24 day of November.1913, WTTNESSETH an AGREEMENT made by and
between the said Ci_t r of South Bend, by and through its Board of Public Works,party
of the first pant., and the Indiana and Michigan Electric Company, a corporation,of
said City or South Bend, party of the second part, �),s follows,tdtwit: That,

Whereas, the contract for the lighting of the streets galleys, boulevards,
parks and public places of said City,expires on the first day of January,1915,and
Whereas, the said Board of Public Works did, in conformity to the laws
relating to the letting of contracts for public lighting, duly give notice that it
would receive sealed bids at its office in the City Hall of said City on or before
10 o'clock A.M. of the 8th. day of Noveyber,1913, for the furnishing of artificial
lighting for the public plaees_of said City, according to plans and specifications on
file in the offs ce' of said Board of Public Works, a copy of which plans and speci-
fications are attahed hereto, marked Exhibit "A", and hereby made a part of this con-
tract, and would at said place and on said day and hour, open all bids received;and
Whereas, the said Board of Public Works did, pursuant to said noticE at
its said office on said Eth. day of November 21913, open all bids received, and

Whereas the said Indiana and Michigan Electric Company submitted its
-critter proposal or bid to do and perform the work and furnish the materials and
light advertisedfor, which bid is hereto attached, hereby. made a part of this con-,
tract and marked Exhibit "B", and which bid was the lowest and the best bid therefor,
NOW TUIS WITNESSETH: That for and in Conjideration of the premises and
of the mutual premises each to the other made as here contained, said party of the
first part sloes enntraet with said party df the second part for said party of the
second part to do and perforiv the work and furnish the material and lamps and do the
Lighting, and said party of the second part contracts end' agrees to do and perform
all the work and furnish all the materials and laps and do tr3e lighting for said
City and do and perform, and furnish all in accordance with the terms of said specs-
fieiations, Proposal and the provisions of this contract, for the period of ten years
beginning with. January.1,1915 and ending January 1,1925, at noon, and by, with and
thru the electric lamps hereinbelow specified, towit: Four Hundred (400) are lamps
and One Hundred (100) lamps of the kind known as "100 Watt,Standard Tungston incandee
cent lamp".
It is agreed that said party of the first part shall pay to said party
of the second part, and said party of the second part will accept as payment in
full for all such work and labor done and td be done hereunder, and the material and
light furnished and to be furnished hereunder, the following compensation per year,
towit:
1. For each arc lamp suspended in center of street
in overhead district..........................$60.75
2. For each arc lamp on iron pole in the under-
ground district..............................J-k72.00
3. For each "100 Watt,Standard Tungston,incandes-
cent lamp ... ................... ............. ..$25.00
It is agreed and understood that said are lamps both for overhead
and underground shall each be a four ampere luminous,direct current,seventy-five
(75) to eighty (80) volts and consuming from three Hundrdd (300) to three Hundred
and twenty (320) watts at the light terminal, with clear globe.
It is nderstood and agreed that this contra t rovides hat, said four
Hundred are lamps shall be in the proportion of overhead an u idergroun which said
party of the First party may designate.
It is understood and agreed that said party of the first part may re-
quest at any time during the life of this contract the placing of additional lamps of
any of the kinds hereinabove named, and said party of the second part shall forwith
place the saxie at the port or points designated by said party of the first part a d
there maintain .the same and the compensation therefor shall be the same each as for
each of like kind hereinabove provided for per annun, from and after such placing and
service,and the terms for which the same shall be used shall be for the unexpired
period of this contract.

It is further understood and agreed that a.11 larps herein provided for shall
be placed by said party of the second part as and where directed by said part,,j of the first
part and that said party of the first part may direct the change of location of any such
lamp or lamps or the change of one of said kinds for another at any time during the life of
this contract, and said party of the second part sl-all forthwith make all such changes with-
out.extra compensation. It is understood and agreed that the compensation hereinabove
provided for the respective kinds of lamps per year shall be paid in twelve equal install-
ments payable between the first and s eventh- days of each and every rionth for the lighting
during the preceding month by such lamp but from each such monthly installment of one -
twelfth of the said yearly price shall be deducted for the outage of such lamp for said
preceding nonth, if any, It is further agreed that in the event party of the second, part
dails to furnish the proper voltage.towit: 75 to 90, and the proper wattage,,towit:300 to
320, then and in that event said party of the second part shall, not be entitled to com-
pensation for such light while such failure continues. If any additional lamp or lamps are
directed to be placed during the term of tkis contract such lamp or lamps shall be charged
for only from the time the skine give service, and at the price -herein contracted for for that
kind of lamp., and all as per the terms of this contract.
Said party of the second part agrees to have all its different kinds of
lights herein provided for as well as all its lighting system and all parts and accessories
thereof fully adjusted, installed and completed and ready for operation on the said first

day of January,,1915, and will on that day begin tLhe lighting of said City as herein provided
and under this contract.
Said party of the second part shall furnish bond within fifteen days of
the execution of this contract, in the sum in said specifications set out, payable to said
City, providing for the faithful performance of said secbn&� partyls part of this ,.contract.

proposal are hereby declared rejected.
This contract shall not be binding until ratified by the Common Council
of the said City of South Bend. I
