The Board. ordered City Engineer to make a, report ex the measurements. -,"The following contract.for street lighting was ratified by the Common Council OR Monday October 13th.,1913. This AGREEMENT, made this llth., day of April,A.D.1913, by and between the City Of South Bend, by and through its Board of Public Works, of St. Joseph County -State of Indiana, party of the First part, and the Welsbaeh Street Ligatixg Company of Axeriea', a corpo'ratiox created under and pursuant to the laws of the State of Illinois, party of the second part: WITNESSETH. That the said parties hereto, in consideration of the prolfi- ises and a,greeTnen.ts herein mutually entered into, do for themselves and their successors a-vid assigns, prorise and agree to a,nd with each other as Follows:-- The said party of the second part liereby agrees to furnish to the party of the first part Improved Welsbach. Street Lights along the mains of the Gas Cor:- pany as they now exist or may be extended during the term of this agreeitent; and to maintain the same 6n accordance with the Specifications c,ntain.ed herein5 for the period of five years commencing May First ,19139 and ending midnight April 30th.2191a; EQUIPMENT AND SERVICE. VV ----------- The said party of the second part further agrees to furnish and erect, at its own cost and expense, where not already erected, along the mains of the Gas Company as they now exist or may be extended during the term of this agreement, first class Iron Lamp,Posts and Boulevard Lanterns, equipped with the Improved Attachments for the Welsbach System of Street Lighting. The saffid party of the second part fur- ther agrees to furnish, at its own cost and expense, all illuminant, mantles and materials necessary for properly lighting, extdnguishing, cleaning and repairing said lamps and equipment. It is understood and agreed that all posts, lanterns and equ?pmn.nt fur- nished by the said party of the second part shall at all tries be and remain the property of the said. party �of the second part and may be removed by it at the tent- ination of this coot -Tact. The lights to be furnished by the said party o1' the second part shall be those now being furnished and operated by said party of the second part (30 in numbet in what was formerly the Town of River Park, County of St. Joseph and State of Indiau Indiana; said lights being located as follows: 1-7th. and Pleasant Sts. 2-6t.z. St r. and Mishawaka Ave. 3-6th. Str. and Pleasant Str. 4-7th. Str. and Mishawaka Ave. 5-8th. Above lights to be standard sixty (60) candle power We1_sbach.-; The party of the second part to furnish name, sites for all lamps. LIGHTING SCHEDULE The lamps shall be li,ghted :every.: -night Ix ea-ch month, and shall burn from dusk to 12 o'clock midnight, and said party of the first part shall, if it be required, that said lamps remain burning a greater number of hours per sight, pay therefor to said party of the second part a sum in addition to and the same rate as the compensation here- inafter provided for. COMPENSATION. ---------------- In. consideration of the furnishing of said lights and for the faithful) performance of and compliAnce with all and singular the terms and sttnpulations of this contract in every particular by the said party of the second part, as aforesaid, the s id party of the first part covenants and agrees trat it will pay for the number of lighte above specified at the rate of Sixteen Dollars ( 16.00)per light per year, the,,payment therefor to be made monthly at the €.te of One Dollar and thirty-three and one-third cents ($1.33-1-3) per light per month at the end of the motnh for which the servie e has been rendered. It is agreed and understood, howeverri that said party of the first part magi order an additional lamp or lamps at any time, and said party of the second part will properly place and equip the same within a reasonable time after- receiving ouch order, it 'being understood that all lamps after being installed are to remain in service until the termin.atiox of this agreement. The compensation to the said party of the second part for such additional lamps to be at the .rate of 016.00 per year for each lamp, payment to be wade as specified above. Said party d1f the first part is to ha furnish and pay a man to light, extinguish, clean and care for above lamps, said man to be under the supervision of the party of the second part. This contract executed in triplicate shall not be binding until ratified by the Common Council of said City of South Bend.
