All materials are guaranteed to be as specified. All work to be completed in a satisfactory manner according to standard practices, Any alteration or deviation from the above specifications or involving extra costs will be executed only upon written orders and will become an extra chairge over and above this proposal. All agreements are contingent upon strikes, accidents, or delays beyond our control. The Owner will carry fire, tornado, and other necessary insurance. Our workers are fully covered by Worker's Compensation Insurance, This proposal is valid for 30 days from issue date. Conflict of Interest: The Organization hereby certifies and agrees that no member, officer, or employee of the City, or its designees or agents, and no member of the governing body of the City of South Bend or the Organization (and no one with whom there is a family or business tie) who exercises any functions or responsibilities with respect to the receipt and use of City funds during his or her tenure or for one year thereafter, shall have any financial benefit, direct or indirect, in any contract or subcontract, or the proceeds thereof, for workto be performed in connection with the Program, To the extent the Program involves the awarding of a contract or grant, the Organization shall not award the same to a person or entity that creates a conflict of interest described in Indiana Code § 5-16-11-5.5 ACCEPTANCE OF PROPOSAL The above prices, specifications, and conditions are satisfactory and are hereby accepted, SWIM, Inc. is authorized to do the work as specified. The expansion will encompass parts of Western Avenue. This effort is a facet of a broader City initiative aimed towards addressing the digital divide in South Bend, working towards digital inclusion. The Office of Innovation and Technology team has reviewed the quote and gives favorable recommendation as well. The not to exceed cost of $3,500.00 is to provide and install conduits and fiber on Western Avenue between South Kaley Street and Dundee street as well as several blocks expanding outwards from these streets.
