All members present. ,/Bond and contract for water connections on Marion Street from Leland Avenue to Scott Street, under improvement Resolution No. 289. signed by Thom" Williams as prixiepal and M. F. Callon as surety was approved by the Board. "Contract for pipe sewer on. Suxnysid.e Avenue, under Improvement Resolution No. 251. was awarded to L.H. Webster, Contractor for the sum of ........................ 5162.70 Bond of excavation for One thousand. ($1,000.00)Dollars signed by John Kestler as priniaipal and The Ititle Guaranty & Surety Company as sureties, and was approved by the Board. ✓ Mr. Rice presented petition of 1911 for grade, curb and walk on Dayton Street from Miami Street to Marine and Randolph Streets. The same was placed on file. Petition of July 9th., for a sewer on Blaine Avenue. A resolution wv;,).s ordered prepared on the same. �Engixe r filed assessment roll and final estimate for sewer connections on Kemble .Avenue from Prairie Avenue to Ewing Avenue, under improvement Resolution No. 274. In the City of South Bend, Indiana, Resolved, that notices as to the amounts of assessments be published for six consecutive days in the Soiith Bend Daily News —Times, commencing on the .22nd. day of September 1913 stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 10th., day of October 1913 at 7:45 P.M. Resolved Further, that the entire work under the above contracts be accepted anal approved and the final estimate thereon. allowed. Notice of this resilu— tion shall be published on the 22nd. , day of September 1913 in the South Bend. Daily News —Times, stating that this Board will give a hearing on the acceptance of such work:` at ' its office in the City Hall on the loth. , day of October 1913 at 7:45 P.M. Permission was granted to the Indiana & Michigan Elec. Company to set 19oles as follows: — To reset one pole on the east side of Laurel Street at first alley north of Jefferson. To set two poles on the north side of the first alley north o'f Hastings Street' also two poles on the east side of the alleyRest of ith Street. Also one poke on the east side of the alley west of SmitStreet, Also one pole on the east side of the alley west of Smith Street, just south of the first alley north of Hastings . To set one 351 pole at the N. east corner of the alley at tine rear -of 1111 East Broadway, in place of guy stub now there, and one 35' 120ft. east of same, this to be jointly with Central Union Tel. Company, on north sideof alley. ,/ Communication, received by the Board from C.J.Wkitmer, asking for a permit ,for the construction of a cess pool on his property to be built between the property line and the curb on the street. The same was read and was not granted. Board ordered c6amunication sent to Hoban and Roach and Mr. Hastings, requesting Chet them �to-be :present at the regular meeting, of the Board to be held Tuesday Sept., the 23rd.,1913 at 10:00 A.M. to see about sewer tap. ,/Communicatiox received and read from Miss Theresa R. Albert in regard to debris and dirt on Nineteenth Street. The Clerk was ordered to seat name of Contractor to Miss Albert. - In. the matter of the sewer for East Madison Street from Sunnyside Avenue to Eddy Street. The same was taken up by the Board, but they sustained the recommendations of the City Engineer and deferred all action until 1914. 14 SIDEWALK IMPROVEMENT RESOLUTION NO. 291. RESOLVED BY THE BOARD OF PUBLIC WORKS OF TBE CITY OF SOUTH BEND,ST. JOSEPH OUNTY,STATE OF INDIANA, That it is deemed necessary to improve LINCOLN STREET FROM SAMPLE STREET TO THE GRAND TRUNK WESTERN RAILWAY, as follows,to-wit:- By grading said street from property line to property line, and. constructing cement sidewalk and cement curbs ^n both sides of said Street where not already coxstru cted All as shown on the plans, profiles and detail drawings on file in the office of the Depart- ment of Public Works. And such improvement is now ordered in accordance with the profile, details drawings and specifications on file in the office of the -Department of the Board. of Public Works of said City and such i provematt if' now ordered. Tie cost of said improvement, including the colt oftistreet and alley inter- sections, shall be assessed upon the real estate abutting on said LINCOLN STREET all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled "An. Act Concerning Municipal Corporations," approved. March 691905, and in accordance with and pursuant to the provisions of all amendatory and supl.lemental acts thereto passed. by the General Assembly of the State of Indiana. Asse�srienta, if deferred, are to be paid in ten equal annual installments, with inter st at the rate of Six per cent per annuls A bond or bonds shall be issued to �t contractor n payment of such work, unless he property owners pay said assessment before said bond or bonds are issued. Under no circumstances shall ,the City of South Bend, be, or be held responsible for any sum or sums, due from said property owner or owners, for said work or for the collection of the same, or for the payment of any bondq bonds,°certificate or certificates, issued to said contractor in payment for much work except for such moneys as shall have been actually received by the City from the assessments fo for -such improvement, or such moneys as said City is by said above entitled Act required..,to pay. All proceedings bad, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided fo•r in said above entitled Act and amendments thereto. Notice of this resolution shall be published on the 17th., day of Sept- ember 1913 and on the 24th. , day of September 19139 in the: South Bend Daily News -Times. This Board will give a hearing on this resolution in its office in the City Hall on the loth. , dey of October 1913 at 7:45 P.M. Adopted this 3-6th. , day of September 1913. BOARD OF PUBLIC WORKS. Complaint made by Mr: Rive on a defective walk on Fellows Street on Lot #26 Dubailts First Addition. The same was approved and ordered replaced. )Mr. C. H. Defrees eppeared before the Board in regard to the changing of the kind of ,brick pavement on Dunham Street. The matter was ,referred to the City Attorney. /In the matter on grade on First alley North of Madison. Street, there being no bids received. the same was deferred until Wednesday Sept. 17,1913.
