GRADE, CURB AND SIDEWALK IMPROVEhIENT RESOLUTION NO.194. Resolved by the Boa-rd of Public works of the City of South Bend, St. V/Joseph County, State of Indiana, That it is deemed n,eeaessary to improve DALE AVENUE FROM DAYTON STREET TO BOWMAN STREET. By grading said street from property line to property line, and con— structing cement sidewalk and cement curb on both sides of said Dale Avenue wrere not already constructed. All as shorn on plans, profiles and detail drawings on file i_1 the Office of Public Works. And such improvement is now ordered in accordance wit the praft le, details, drawings and specifications on file in the office of they Department of the Board of Public Works of said City; and such improvement is now ordered. The cost of said. improvement, including the cost of street and all%r, intersections .,shall be assessed upon the real estate abutting on sE idDALE AVENUE, all ac— cording to the method snd manner provided for in an Act of the General Assembly of the State Of Indiana., entitled,"An Act Concerning Municipal Corporations,"approved March 6th.,1905, and in, accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds sha, 1 be issued to the contractor in payment of such vork,unless the property oAmers pay said assessment- before said bond or bonds are issued.. Under no air— cumstan-ces shall the City of South Bengt, be , or be held responsible for any sur or sums, due from said property owner or -owners for. said work or for -tne collection of the same, or for the payment of any bond, boh.ds, certifieatee or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the . City from the assessments for such improvel�ent, or such moneys as said City is by said above entitled Act required to pay. Resolved by the Board of Public Works of the City of South Bend, County of St. Joseph, State of Inditana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon and not intended or adapted for receiving Sewerage from collateral el.rains, be and the sLne is, hereby ordered in and along CLEVELAND tSVE NE FROM BAN BURET STREET TO VASSAR AS FOLLOWS, to@wit:O Beginning at the center of Van Buren Street' end Clevelnad Avenue thence north along h-he center line of Cleveland Avenue to the center of Quincy Street with a 15 inch vitrified pipe sewer, thence still north along the enter of said Cleveland Avenue to the center of Vassar Avenue witri a 12 inch vitrified`:pip.e sewer, Together with the necessary manholes, inlets and house conneeet1ens to the curb line along the line of said improvement. All as shown on the plans, profiles and detail drawings on file in the office of the Department of Public; Works. And such improvement i now ordered and said sewer, with all its appur- tenances shall be con;structeei i7h accordance with the profile and specifications now on file in the office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property h6l- ders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all accovdixg to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled , "Ax Act Concern- ing Municipal Corporations," approved Mareeh 6`11905.
