The Central Union. Telehpone Company filed Blue Print and the some was approved subject to replacing of same with .a more accurate print on completion of work. Permit ordered to be given. to the Company as per blue print as approved. And that the Central Union Telephone Company pay the time of an inspeetor for to see that lawn of property owners be replaced. The following petition was received rind. placed on file. Honorable Body to establish a grade on this Ave. (not grade the same), so I may know how to finish up extensive grading improvements I am now making to my land. Also, to set stakes showing an established grade on, South Main St. fro�a. Chippewa Ave, South past my 746.6 feet frontage as per sty communication to the City Engineer of yesterday Also, when this grade is established on South Main St., I a.sk for your per— mission to remove the ground where it may be too high *at the north end, which ground I can use in filling on my adjacent land. Headley as principal and A.G. Harlin and C. H. De Frees as sureties, was approved by the Board. v/Bind and contract far grade, curband walk on Man Buren Street from Howard Avenue to Saneome Avenue, under improvement Resolution No. 234, signed by C. L. Headley as prinieipal and A. G. Harlin and C. H. De Frees, as sureties, was approved by the Board. Bids on water connections on. Howard Street from Leeper Avenue to Niles Avenue under improvement Resolution" No. 252. The awarding of same was deferred until June loth. 1913 Awarding of bids for water conneetion.s en Ottowa Court from Vistula Avenue to L.S.&M.S.Ry. under Improvement Resolution No. 253. was deferred until June 10th.,1913. ,/Permission was granted the Central Union. Telephone Company to set one pole in alley at rear of No. 224 South Notre Dame- AVeaue. The pole was approve d as followings, To be placed on the - same side Bf. the alley as the other Central Union. In the above. matter no remonstrators appeared and no further remen- stra,nces were filed. The Board therefore find in each and every ease in said improve- ments that the benefits to the property and to the City of South Bend are equal to the estimated cost <,f said improvement and the same are hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the 31st., day of May, 1913 and on the 7th.1 day of June,1913 in the South Bend Daily Times, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. on the 18th. , day of June.1913. The Board reserves the right to reject any or all b1d.s. 28 STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 275. / Be It Resolved by the Board of Public Works of the City of South Bend, St. Joseph Counter, State of Indiana that it is desired and deemed necessary to im- prove ry m prove North Shore Drive from Lafayette Street to the East line of Iroquois Street. By grading the said street from curb line to curb line and construct- ing a 6 inch macadam pavement, placing the necessary storm water inlets and margin- al curbs. All as shown on detail.plan.s and in accordance with plans, -profiles and speeifieations on file in the office of the Department of Public Works of said City. And such improvement is now ordered. The cost of the improvement herein provided ofr, except street and alley intersections, shall be paid by special assessment to be levied, upon the pro- perty specially benefitted, to the mount that the same may be legally assessed therefor, in accordance with an Act of the General Assembly of the State of Indiana, entitled !An Act Concerning Municipal Corporations," approved March 6,1905m and in accordance with and pursuant to the provisions of all _acts amendatory and sup- plemental thereto. The cost of all street and alley intersections, including one-half of the width of the improvement oposite street and alleys which run into, but do not cross said roadway herein proposed to be improved and _that portion of such street or alley abutting upon property belonging to said City, or -upon property not subject tosueh assessment, shall be paid by the City in cash out of its general fund, if abe ible to do so, or from a fund created by a special assessment to be levied under the provisions of Seetion -109 Of the above .enitlted Act. Assessments of tea dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Sig per cent per annum. A bond or bonds, will be issued to the contractor to the amount .of such deferred assessments in pro rats payment for such improvement. Under n,o-eireua-stanees shall the City of South Bead, be or be held responsible ffr any suss or sums due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such owrk, except for such moneys as shall have actually been received -by the City from the assessments fro such improvement, or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection Of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act, and ' Acts amendatory thereof and supplemental thereto* BE IT FURTHER RESOLVED, That the Board Of Publie Works fix the llthe day of J1421913 A.D. at the hour of 7:45 P.M. at the office of the Board of Public Works, of this City, as the -time and place for the public eonsideration of said proposed -improvement, at which s&i.d Board of Public Works will hear all persons interested, or whose property is liable to be assessed for said improvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the estimated Bost thereof. Be IT FURTHER RESOLVED, That notiee of the, time and place of such public consideration be published and nailed in the manner provided by law. Notice of this resolution shall be published on. the 31st., day of May 1913 and on. the 7th. , day of Jun.e,1913, in the South Bend Daily Times. Adopted this 28t h. , day of May ,1913. Transferring Board of Public Works? authority over St. Louis Street,from the south sdde Of of East Madison Street to South Bend Avenue,unto the Board of Pork Commissioners; full eoiitrel over said street for boulevard purposes. BE IT RESOLVED by the Beard of Public Works of the City of South Bend, Indiana, that it is deemed and desired n.eeessary that St. Louis Street, from the south side of East Madison Street to South Bend Avenue, in the City of South Bend, ,Indiana, be under the control and supervision of the Board of Park Commissioners of said City, and converted by said Board into a pleasure drive —way and boulevard amd made a part of the boulevard system of said City. And Be It Further Resolved that the Board of Public Works do now hereby transfer to said Board of Park Commissioners full authority, central and supervision over said Street and renounce in favor of said Board of Park Commissioners, all its power *ever and to said Street fort he purposes herein ab eve set out. Reserving, however, unto this Board of Public Works the right to lay, conneet, and order to be laid and sonneeted,, a,ll pipes, sewers, conduits and other -underground work, retaining hereby for such last named purposes all the power which this Board originally had in and to said street.
