Before the Board of Publfe Works of the City of South Bend,
Your petitioner would represent and show to your Honorable Board hhat it is a
steam railroad company incorporated and au throfted to do business under the lays
laws of the State of Indiana. It further represents that its railroad tracks
extends through the.City of South Bend in arvd easterly and westerly direction
and crosses Robinson Street, Ernsberger Street, and Caroline Street at grade,
and the same petitioner petitions your Honorable Board that it is permitted
to raise the elevation of its tracks, to the extent of not, more than Ten (10)-
inches above the present level of the tracks as they now cross the above mention:

Before the Board of Public Works ofnthe City of South Bend
comes now the New York Central Railroad Company, and by its written petition ask
asks permission to raise the elevation -of its tracks in the City of South Bend,
where the said tracks cross Caroline, Ernberger and Robinson Streets to and
°elevation of not more than ,Ten (10) inches above the present level of said
tracks as they now cross the above mentioned streets. And this Board being
duly advised in the premises finds that said permission should be granted.
Therefore be it now resolved, that the said New York Central Railroad Company is
hereby authorized to raise the elevation of its tracks where the same cross the
three (3) above nemed streets to an elevation of not more than Ten (10) inches
above the present elevation of said tracks, and provided further that the
approaches to said tracks shall not be more than a five per cent grade except
the approach to the track on the north side of Robinson Street which shall not
be more than a seven per cent grade, and provided further that the New York
Central Railroad Company shall at its own costs and expense take care of all
sidewalk and street approaches to its tracks at said crossings.
And the same shall be repleaced in as good condition as
they are at the present time.
