petition, like any ether part, of the streets of the Cite,wis within the control
of the Board Of Public Works. The grade of said', Street is established by the -
.erection of the Colfax, Avenue Bridge. It is entirely competent for the Board of
Public Works to order the construction of the sidewalk along the south side of
said street at the same grade, or the Board may permit the abutting property
owners to constrict said sigewalk, w
Theseis no- obligation,resting upon the' -Board to keep this driveway
roterred to, and which is not at the=same grade as. the street, open -for the bean`
fit of :property owners in thart..Vicinity. The. fact that .t,hese property owners
have used the same for more than twenty years is net material.
