This being the.date set for the public hearing on .the contract between the City of South Bend,, Indiana and the Chicago, S®uth.Bend & Northern Indiana Railway Company in regard to running busses on certain streets as per copy of contract si--ned by the Board and on pages 430 and 431 of this record of the Board, And Whereas according to Law publications were given in the South Bend News Times and South Bend Tribune on the- 25th, day of July 1923 and on the 1st, day of August 1923 and were posted according to Law, and a hearing set for this 9th. day of August 1923 at .7:15 P.M. at which time no objectors appeared and no written remenstenace was filed and proofs of publication and post ngs were filed by Attorney A. Gilliom. fit, R.. Smith, Gen'l. Mgr, and Attorney A, Gilliom representing the Chicago, South Bend & Northern Indiana Railway Company appeared for said celitract and,the hearing was then held and no objeetdrs appearing and no remonstrance filed the Board thereupon takes final action on said Chicago, South Bend & Northern Indiana Railway Company Bus contract by confirming the same as adopted xxvlx under date of July 1 7th., 1923 and referred the same to the Common Council for their ratification. The following proofs presented on this 9th. day of August 1923 were aimrlmad recorded as follows: STATE OF INDIANA ) ST. JOSEPff COUNTY ) SS o PROOF OF PUBLICATION AND POSTTNG OF - - NOTICE OF PROPOSED.CONTRACT. Raymond R. Smith, being first duly sworn on his oath, says that he is Vice president and.General Manager of the Chicago, South Bend & Northern Indiana Railway Company, and that he makes this affidavit on behalf of said Company; that said Company, 'at its own expense, published the proposed contract between said Company and the City of South Bend, by and through its Board of Public Works, relative to the operation of motor busses in said City, and also a notice of the time and place of a public hearing on said prrposed contract; that said publications were made in the South Bend News Times and in the South Bend Tribune, as shown by Exhibits A and B, attached hereto and.made a part hereof. Affiant further says that on, to -wit: the 25th. day of July , 19239 the said Company posted a notice of said hearing and a copy of said proposed contract at ten public planes in the City of South Bend, township of Portage and County of St. Joseph, ;Indiana, at they following locations, to, -wit:- At the intersee-tion of La Salle Avenue and Lincoln Way West; La Salle Avenue and Michigan Street; La Salle Avenue and Hill Street; Refferson Avenue and Hill Street; Carrell Street and Lincoln Way East; Michigan Street and Division Street; Lafayette Street and Siuih Street; Lafayette Street and Jefferson Avenue; Michigan Street and Sample Street; and at Lincoln Way East and Bronson Street; that a espy of the said notice and the contract so posted at each of said places at said time is marked Exhibit C, is attached hereto and made_a part hereof.
