DATE: 10 April 2018 Please find attached a copy of the request for the release of easements, the vacation ordinances, and a highlighted map indicating the specific location of the easements. The easements are located in multiple areas adjacent to Eddy St., between Napoleon Blvd. and Howard St. The highlighted map includes a letter - based label for each vacated Right -of -,Way (R.O.W.), and will be referred to by that designation within this memorandum. The City of South Bend does not have any existing utilities in the following vacated R.O.W.s and recommends the Board approve the release of the reserve easements: I . Vacated R.O.W. B: Inst. #8617818 (Alley east of Frances Street from St. Vincent Street to the alley north of St. Vincent Street) 2. Vacated R.O.W. D: (Portion of an alley extending east and west from North Eddy Street and North Frances Street and lying between Napoleon Boulevard and St. Vincent Street) 3. Vacated R.O.W. E: Inst. #8617818 (The first north -south alley east of Eddy St., running north from St., Vincent St., to the intersecting east -west alley for a distance of 360 feet) 4. Vacated R.O.W. F: Inst. #1717818 (The northwest corner of Howard Street and Eddy Street including excess right-of-way from former Howard Street alignment) The City of South Bend does have existing utilities in the following vacated Right - of -Ways and recommends the Board reject at this time the release of the reserve easements: 5. The right-of-way vacations occurred at various points between 1965 and 2017. As you know, utility companies and the City hold reserve rights and easements under all of these vacations "unless such rights are released by the individual utilities." The following instrument numbers appear to cover areas that do not have City water or sewer facilities 1) Vacation resolution 3152 (1965), recorded in Miscellaneous Book 221, page 522 2) Vacation resolution 7242-83, recorded as Instrument #8350761 3) Vacation resolution 7642-86, recorded as Instrument #8617818 (including the cast half of the north -south alley west of Eddy Street and north of Saint. Vincent. 4) Vacation resolution 9123-00, recorded as Instrument 40049585 5) Vacation resolution 10519-17, recorded as Instrument #1717818 6) Vacation resolution 10521-17, recorded as Instrument #1717816 Copies of each document, along with a map showing the affected areas, are attached with this letter. Please review and confirm that the City does not have facilities in the noted areas.
