Wilbur St. to West Right -of -Way of Birdsell St.
Dear Mr. Pollard:
The Board of Public Works, at its April 10, 2018, meeting, reviewed comments by the Engineering
Division, Area Plan Commission, Community Investment, Fire Department, Police Department, and
the Solid Waste Division. Community Investment and Engineering stated the petitioner is not the
owner of record for the property and the vacation would not allow access to the property from Wilbur
Street. Engineering and Community Investment stated the alley width is insufficient for a driveway,
The Legal Department confirmed Indiana Local Ordinance and Indiana Code require the petitioner of
an alley or street to be the legal owner of record contingent or adjacent to the alley or street. Based on
tax records, you are not the legal owner of the properties adjacent or contingent to this alley.
Therefore, the Board of Public Works rejected your application, noting the petition has no legal
standing. The Board noted it is not a valid petition and even if it were, it received unfavorable
recommendations.
