This being date set for the continued hearing on Condemnation
Resolution No. 73 for the appropriation df a strip of land for (4) feet in width
two (2) feet on each side afx:kka as described in resolution for an easement
for Trunk sewer.

matter until the 5th. day of June 1923 at'10:00 A.M. On the day above named
the Board will either pass on petiiiiens let, said contract or reject all bids.

Concerning the improvement ®,tke roadway of Huey Street
from Wsskington Avenue to Linden Avenue with asphalt, asphaltic conerate, bitulithic
concrete or brick, in pursuance to Resolution NO. 1146 this being the date set for the
making of the premixivary order designating the kind Of pavement, the Board at 10:00
A.M. Tuesday May 22nd.-1923 publicly opened read and considered all bids and then
continued their meeting to Wednesday May 23rd., 1923 at 7:15 P.M.
Now on last named date the Board designated asphaltic concrete as
tke kind of pavement witk-w ieh said street is to be improved with and fixes the
4th. daey.of June 1923 at 10:00 A M. as the time when petitions for eksagixg the
kind of pavement must be filed, and the Board hereby continues this matter until the'
5th. day of June 1923 at 10:00 A.M. on the day above named tke Board will either
Pass on petitions let said contract or reject all bids.

Copy of contract for resurfacing West Colefax Avenue from
Michigan Street to Lafayette Blvd. was submitted by the lauxttt City Engineer for the
White Construction Company for amount. of $109663.10 which was approved by the Board.
Copy of contract for Bowman Street sheet sphalt pavement.frost
Miami Street to Leer Street for the White Construction Co. for $13,375.e4 which was
approved by the Board.
Copy of contract for the resurfacing of South Main Street
from michigan Street to Washington Avenue to Jefferson Street submitted by the City
Engineer forthe White Construction Company at .... $7,634.07 which was approved by the
Board.
The Board ordered that all sidewalk improvements work not
bid on Tuesday May 22ad., 1923 be held up for re-advertisixg until June 26tk.
1923.
The fOliowing waiver was approved by the Board.

TO THE BOARD OF PUBLIC WORKS

WHEREAS, the Board of Public -Works of the City of South Bend, Indiana. did,
on the day of 192 adopt a preliminary resolution for the improvment
Of Edgewater Drive and Harper Court (Browses St ° )
under Improvement Resolution No. in the City of South Bend, Indiana, by construction on {�
pavement as shown- on the plans, and in accordance with- the profiles; detail drawings and specificaticrs
on file in the office of the Department of Public Works.
AND WHEREAS, we the undersigned, are the only persons owning pro-
perty on said street to be improved, and that we alone are affected in any hay by said proposed �
improvement. That we are the sole owners of the _separate parcels of land bordering upon said street
!, proposed to be improved. -
THEREFORE, in consideration that said Board of Pubilc Works proceed
- to improve said, Edgewater Drive and Hager Court (Bronson SU

iIoked .in said .resolution, and for the. further purpose of saving .trine and expense, we the un.
dersrred,to hereby waive all objections on and in .defense to any defectin said. proceedings, and
to any- violation in procedure far the construction, of pavements as fixed by Section 8710 of Burn's
Revised 'Statutes _.of - 1914. We . further waive any right to object to the form of. said resolution. We
further waive any and all objections to the fact that no advertisement for hearing has been published
as required by law, and that no notices were mailed to the owners of property and that no hearing was
held by said Board. F
We also consent that said Board shall proceed to let the contract for do ;
ing said work in following manner;
That they shall notify by mail responsible contractors in the City of South

Bend, ladiana, of said work to be done under said resolution, and that they shall receive bids from
-said contractors for doing of said work, and they shalllet the contract for the doing of slid Hork to`4he
tlowest responsible bidder, and we waive any objection to the action of said Board in letting said con-
tract in a form and manner other than provided by law,
We further consent that the cost of doing said work shall be assessed a-
gainst the different parcels of real estate owend by us as provided by secticus 8710, 87IOa-871 12- r k
8713-8714-8715-8716-8717-8718-8719-8720-8721; and all acts and laws amendatory thereof or: f
supplemental thereto.
- We further agree that notice given by mail shall be sufficient notice cf `tl e
hearing upon the assessments made for said improvement.
