The Board beige; fully advised In the premises, decides that the benefit t to property Liable to be assessed for said improvement are e+gval to the Ostimated cost of the same, as reported by t7a,e City Civil Engineer, and thereupon takes final action, on said resolution .as originally adopted, and the same is hereby is all things, ratified, .confirmed and approved, Resolved further, that notices be published on the 24th.. day of May 1923.and on the 31st.4ay of May 1923 in the South Bend News Times and Tribune in said City, statiang that this Board will receive bids for the con- struction of said improvement up to 10:00 A.M, on the 12th. day of June 1923 The Board reserves the right to reject any and all bids. The Board therefore being fully 4dvlsed in the premises decides that 'the benefits to property liable to be assessed for said improvement are equal to the estimated`rcost of the same, as reported by the City Civil Engineer, and thereupoa takes final action on said resolution as originally adopted, and 'the same is hereby in aallLhings, rattled, confirmed and approved. Resolved further, that notices be published on the 24th. day df May 1923 and on the 319t. day of May 1923 in the South Bead Tribune and News Times, in said City, stating that this Board will receive bids for the construct ties of said improvement up to 10:00 A.M. Tuesday June 12th.., 1923. The Board. reserves the right to reject any and all bids. To the Honorable Board of Public Works Of the City of South Bad, Indiana, The Pittsburgh, Cincinnati, Chicago, & St. Louis Railroad Company respectfully petitions and shows to your Honorable Body that it is a common carrier for hire and now owns and operates an hndustrial side track within the eopperate limits ofthe City of South Bend, that is connected with the main lines and switch tracks of this petitioner south of Tutt Street in said City and runs in a general northerly direction along the.west side of the right, Of way of this petitioners across Tutt Street in said City and is marked with an .K on the blue print map attached hereto and made a part of this petition; that said Industrial side track serves the Studebaker Corporation north of Tutt Street and other industries south of Tutt Street; that it is desired to disconne disconnect said industrial side track at the south line of Tutt Street and move the northerly segment of said track to the east as shown on the accompanying blue print by the dotted yellow line, and connect the same on the private right of way of this petitioner with the tracks of this petitioner as shown on the accompanying blue print; that the purpose of this shifting of said: industrial: track i-s to better serve the Studebaker Ctrperatien without being interrupter throught the service of the parties using said Industrial track south of Tutt St 43- kedngsdsy r May 16th. 9 1923, Continue¢;. + - ,YhereFere, this, petitioner asks that it be granted permission "t4 shift said industrial side" •track'a7s herein petitioned and as shown ,on the glue print map hereto attached.
