The following'contraot signed and approved. THIS AGREEMENT MADE THE 2616h. day of September tnft in the year Nineteen Hundred and twenty five by and between Ralph Solllitt & Sons ConstR. Co. hereinafter called the Contractor , and 'City of South. Bend, Indiana, by its Board of Public Works hereinafter called the Owner. WITNtSSETH, that the Contractor and the Owner for the consideration hereinafter named agree ors follows:- Aarticle1. The Contractor agrees to provide all the mmterials and to PorforM all the work shown on the drawings and described in the specifications entitled Garage .& Mzrkshop for Street and Engineering Departments , City of South Bend, Indiaft prepowdd by W. D. Teeple, Archt. Engr, and F. J, Anderson, City . Engineer, and Engineer, respectively; mating as, and 'in these Contract Documents entitled the Architect, .and to do everything required by the General Conditions of the contract, the spec if_iostions.. _ ARTICLE 2. The Contractor agrees that the- work-und" this contract shall be substantially completed on or before December. 15th, 1925, sub jeot to shrikes, excessively inclement weather, or other valid cause for, delay, beyong the Contractor's control and accepted by the Architect, ARTICLE 3. The owner agrees to pay the Contraotor in current funds for ''the performance of the Contract.Twenty Thousand, Nine hundred and forty-five and 7100 611ars (200'945.00) Subject to additions and deductions as provided in the General Conditions . o:t the contract and to, mks payments on account thereof as pro- vided therein as follows: On or -about the Tenth day -of each month Eighty-five (Q5 per aent;per cent of 'the value, proportionate tothe amount of the contract, o:r Iabor and materials incorporated in the work as scheduled by Contractor in writing, approved by Architect up th the first day of that month as estimated by the Architect less the agegregate of previous payments. On -substantial completion of the entire work a sum sufficient to increase the total payments, to eighty five (85 per cent)per cent .of tha contract price and tea days thereafter, provided the work be fully completed and the contract fully performed, the balance due under the Contract. And: in addition to the above , $13.50 0 cubic yard of concrete in place, including excavation's and forms, to be hereafter determined and directed in writing by the Architect. ARTICLE 4. The contractor and the Owner agree that the General Condi- tions of the Contract, the specifications and the drawings, together with this agree- ment form of the contract, and that . they are as fully a part of the contract, as if hereto attached or herein repeated; and that the following is an exact enumeration of the Specifications and Dratings: General Specifications as Rer. copy on file in Architect's office. # 'Shoots drawings, (1) survey.
