Board met in regular session at 7:15 P.M. All members present,.
Deferred hearing had on roll of awards of damages and assessments d'
of benefits for the vacation of alley:lying between Lot 95-and lots 124,125,126
and -127 Kauffman Place 'Addition extending from College Street to Ely. line of
right of way to C. I. & S. R. R. under Vacation Resolution Ile. 95. -

stranae was filed. The Board decided to defer hearing until. Wednedday Sept. 30T
1925 at 7:15 P.M.
Permissi'an granted the Indiana Bell Telephorie'Company to place a tsar
two multiple' clay tile contdu:it at a depth• of 40 Inches under the tracks- of the
New York Central R6ilPoad Company and -,place two-4nchors to existing poles'on
Robinson Street.
The City Engineer fined the list of'property. owners in the matter d
of the Widening of -La Salle Avenue from Sunnyside Xaima Avenue to west line of
Sunnyside- Milner' Acdd`ition, also Widt n.ing from West line of Sunnyside Manor Add.
to: €�. point, -18• feet east of West line- Lot 52 Sunnyside Manor Addition under
c ' Aemnstion Re solution. No., 91. Which list includes the names of the owners
and holders of property and its interests the.roin sought,to be tkkan or bene-•
fically or injuriou"sly affected, And'the description of the several pieces of
property which is effected by the.,saki appropriation proceedings.
Thereupon the Board proceeded,to award the damages sustained and
to assess the ]enefits aecru.ing to each pleoe of property upon said list.
It was ,thereupon, upon motion duly made and seconded and unan-
imously adopted, resolved that said list, together with the amounts_of benefits
and damages and net, benefits and `net damages therein set forth as to the several
parcels ,of land be adopted and that the respective amount of benefits contained
in said list be and are hereby assessed against -the several tracts of,land as
specifically set -forth in said list,, and that the respective amounts of damages
contained in the said list be and are hereby awarded to the several tracts of

damages, as the case, Wray be as to t-he respective tracts of land, contained in
said list are hereby awarded or assessed, as the case may be -as to the several
tracts of land.
The Board hereby further sets off the;benefits 01nd damages each
against- the other where both benefits and damages are assesse d, against the same
piece of propertym tract of; land or interests, and hereby fixes the said
respective net benefits as the amount that shall be paid by the respective
owners as benefits; and further hereby fixes the respective net damages As to
the several traets'ns the amount that shall be paid to the owners,of the red
spective tracts as damages..
There upon, upon motion duly made and seconded unanimously Adopt$
the day of October 1925 at 7:15 P.M. was fixed as the clay on which this
Board,will receive pr hear remonstrances from persons with regard to the amount,
cif: their respective awards or assessments, and the Clerk of this Board was in-
structed to prepare and cause to be duly an6 legally given, notices to the owner
of em eh parcel of property, showing the amount of the assessments or awards,
With a. deseriptio:n of .the,, property, affected, and the date of said hearing.
The City Engineer submitted the list of property owners in the
m%tter.of;the Opening of Elmer Street from north line of Marquette Heights Addi-
tion to Wilson Avenue, under Improvement Resolution No. 87.
Which list includes.the n,!mes of the owners and holders of
property and its interests therein sought to be taken or beneficially or in-
juriously affected, and the description of the several pieces of property which
is affected by the said appropriation proceedings.
Thereupon the Board proceeded to award the damages sustained and
to assess the benefits accruing to eReh piece of property upon said list.

respective awards or assessments, and the Clerk of this Board was instructed to
prepare and cause to be duty and legally given, notice to the owners of each parcel
of property, showing the amount of the assessments or awa�rds,with a description
of the property affected, and the date of said hearing.
The following resolution adopted;

Resolved 'by the Board ' of Public Works of the City'of South Bv44;
Indiana; That it is desirable to vacate the following: -
Angle Street from the west line' of Rush Street to the South line of
Sample Sheet as follows, to -wit: -
Beginning at the intersection of the west'line- of
Ruth Street and the southerly line of Angle Street,.thence north along tke west line
of Rush Street produced north to the northerly line of Angle Street, thence north--
westerly along said line to the south line of Sample Street, thence west along the
south line of Sample Street to°the east line, produced north, of the alley west of
Rush Street; thence south along the east line of said alley produced north, to the
northwest corner of lot 5 in Wenger & KrIoghbaum's Addition; thence southeasterly
along the southerly line of Angle Street to the place of beginning.
The following property may be injuriously or
beneficially affected by such vacation: Lots 5,6,7,12,13,14,15 and 16 in Wenger and
Kreighbaum's 1st. Addition.
Notice of this resolution shall be published on the
lst. day of • October 1925 and on the 8th. day of October 1925 in the South Bend
Daily Tribune and South Bend News times.
