Zoning and Annexation Committee Meeting

The April 2, 2007 meeting of the Zoning and Annexation Committee of the South Bend
Common Council was called to order by its Council President Timothy A. Rouse at 4:27
p.m. in the Council's Informal Meeting Roam.
Persons in attendance included Council Members Rouse, Kelly, and Puzzello; Mayor
Assistant City Attorney Ann-Carol Nash; Building Commissioner Mark Lyons, Robert
Nemeth, Larry Magliozzi and Kathleen Cekanski-Farrand, Council Attorney.
Council President Rouse noted that since no committee members were present he
would go forward with the meeting for informational purposes.
Pro osed Text Amendments to the South Bend Zonin Ordinance:
Larry P. Magliozzi, Assistant Director of the Area Plan Commission then reviewed the
draft ordinance which would amend Chapter 21 of the South Bend Municipal Code
dated March 2$, 2007 {copy attached}.lt was noted that this is the 6~" ordinance to
clarify the master zoning ordinance since it was recently passed by the Council. Mr.
Magliozzi highlighted the following proposed changes:
Section I: Addresses corner lots
Section II: Addresses capacity of garages (would go from 3 to 4 vehicles)
Section 111: Would prohibit security wiring except for non-residential uses located in
residential districts
In response to a question from Council Member Puzzello, Mr. Fozo stated that a
resident could seek a variance fior a higher fence, rather than use security
wiring on a residential property.
Section IV: Addresses OB Office Buffer Districts which act as buffers and would
remedy integrated center language currently included
Section V: Addresses accessory building development standards far OB Office Buffer
Districts
Section Vl: Addresses MU Mixed Use

At this point in the meeting Council Member Kirisits joined the Committee meeting. He
apologized for being late, noting that he had a plumbing emergency at his
home. He then chaired the rest of the Committee meeting.
Mr. Fozo noted by example that he did not believe it was the intent of the Council to
have establishments like CiCi's Pizza Place to be considered a controlled
use.
Section VII & Section VIII: Addresses the consistency of terms used in the Chapter.
Section IX: Addresses fencing and would address the consistency of terms used.
Section X: Addresses Light Industrial Districts Hated that the language which has been
cross-thru would be permitted once the ordinance is passed.
Section XI & Section XII: Address Light Industrial and General Industrial respectively
and would add amusement center and amusement park to each section.
Section XIII. Section XIV & Section XV: Address signs and would remove OB so that
integrated centers would not be permitted.
Section XVI: Addresses the 1,000 foot restriction language
Section XVII: Would update definitions
Section XVIII: Would amend by requiring a minimum side yard of 5' instead of 10'
Section XIX: Would amend CommerciallMixed Use Districts and CB Community
Business District minimum side yard requirements.
Mr. Fozo noted that examples would be the Erskine developments.
In response to a question from Council Member Puzzello, Mr. Fazo stated that PUD are
being recommended for town houses.
Mr. Magliozzi provided atwo-page handout and reviewed the chart addressing Special
Regulations for Controller Uses {copy attached}. stated that he would like
to file the draft ordinance with the Clerk by Wednesday which would result
in the Council having 1St reading on the Bill on Monday, April 9th.
In response to questions from Council Member Kirsits, it was noted that many of the
proposed amendments were the result of dealing with the current
ordinance and many resulted from dealing with developers.

There being no further business to come before the Committee meeting, Council
Member Kirsits adjourned the meeting at 4:55 p.m.
