RESOLUTION NO. 2836
A RESOLUTION SETTING PROCEDURES
FOR FILING AND CONSIDERATION OF MATTERS
BEFORE THE SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the South Bend Redevelopment Commission (the "Commission") is
the duly constituted and governing body of the South Bend Department of
Redevelopment, pursuant to I.C. 36-7-14; and
WHEREAS, I.C. 36-7-14-8(c) provides that the Redevelopment Commissioners
may adopt the rules and by-laws they consider necessary for the proper conduct of their
proceedings and the carrying out of their duties; and
WHEREAS, the Commission has determined that proper consideration of matters
brought before the Commission requires adequate time to review proposed resolutions
and other actions; and
WHEREAS, the Commission has determined that the regular meetings of the
Commission shall occur on the second and fourth Tuesday of each month, commencing
in February, 2011; and
WHEREAS, the Commission has previously adopted Resolution No. 2428 on the
2nd day of January, 2008, providing for procedures for filing of matters to be considered
by the Commission, which resolution should now be amended.
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission as follows:
All matters to be considered at the regular second or fourth Tuesday
meeting of the Commission, with the exception of the specific items
described in Paragraph 3, below, shall be filed with the Executive Director
of the Commission no later than 5:00 p.m. on the Thursday preceding such
regular meeting and shall be transmitted to Commissioners by electronic
mail, personal delivery, or U.S. mail, as each Commissioner shall prefer,
no later than 2:00 p.m. on the Friday prior to such Commission meeting.
Such filing and transmittal shall contain the proposed Commission agenda
together with the full text, maps, photographs, and renderings of all
matters to be considered by the Commission at such regular meeting.
2. For any special meeting of the Commission, such documents shall be filed
and notice provided to allow the same period of time for consideration by
Commissioners as set forth in the proceeding paragraph, unless such
period of time is changed by the affirmative vote of the Commissioners.
3. The following matters may be filed with the Executive Director of the
Commission no later than Noon on the business day before a Commission
meeting and included on a revised agenda, provided that the text of all
such proposals together with the revised agenda is provided to all
Commissioners, by the preferred method of delivery for each
Commissioner, no later than 5:00 p.m. on the day before the meeting:
a. Proposed contracts for professional engineering services relating to
property owned by the Commission or property in which the
Commission has expressed an interest in purchasing.
b. Proposed contracts for professional title services for property
owned by the Commission or property in which the Commission
has expressed an interest in purchasing.
c. Proposed contracts for survey services for property owned by the
Commission or property in which the Commission has expressed
an interest in purchasing.
d. Proposals for Phase I environmental services for property owned
by the Commission or property in which the Commission has
expressed an interest in purchasing.
e. Proposals for appraisal services for property owned by the
Commission or property in which the Commission has expressed
an interest in purchasing.
4. Matters which are not filed with the Executive Director and transmitted to
the Commissioners as provided in this Resolution may be considered at
the discretion of the Executive Director only with the concurrence of the
Commissioner designated to act as President at the meeting during which
the matter is to be considered, unless the above provisions are waived by a
concurrence of at least three of the Commissioners.
5. The Executive Director of the Commission is authorized and directed to
implement the provisions contained in this Resolution.
6. This Resolution shall be in full force and effect after its adoption.
