• .1 ORDINANCE No. Passed by the Common Council of the City of South Bend, Indiana, January 13. 19 97 Attest: Attest: 8750-97 City Clerk Presented by me to the Mayor of the City of South Bend, Indiana January 14, President of Common Council 19 97 City Clerk Approved and signed by me /~ 19 ~_ Mayor `~ ORDINANCE NO . ~ ~~~ ~ ~~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 14 OF THE SOUTH BEND MUNICIPAL CODE BY THE ADDITION OF NEW SECTION 2-170.6 ENTITLED "RECREATION DEPARTMENT NON-REVERTING FUND" STATEMENT OF PIIRPOSE AND INTENT The Common Council recognizes that pursuant to Indiana Code §36- 10-4-16(g), it has the authority to establish by Ordinance special non-reverting operating funds and special non-reverting capital funds. In each instance, the establishment of such funds are to be requested by the Board of Park Commissioners. The Board of Park Commissioners of the City of South Bend at its meeting of December 16, 1996, requested that the Common Council establish a non-reverting fund. The funding mechanism for the new fund would be user fees and charges associated with certain self supporting activities of the South Bend Recreation Department approved by the Park Board at its meeting of December 16, 1996, including the aquatics and athletic programs, recreation centers, and general administrative and programming, as well as other self supporting Recreation Department programs as the Park Department may designate from time to time. The Park Board has determined that in order to provide and make available to the public, quality recreational activities, the selected fees should be deposited into a separate non-reverting fund. Accordingly, fees generated by certain designated Recreation Department activities will be deposited into the Recreation Department Non-Reverting Fund. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section 1. Chapter 2, Article 14, of the South Bend Municipal Code is hereby amended by the addition of new Section 2-170.6 which shall read in its entirety as follows: Sec. 2-170.6 Recreation Department Non-Reverting Fund. (a) The Recreation Department Non-Reverting Fund is established pursuant to I.C. 36-10-4-16. (b) All charges for participation in designated and self supporting Recreation Department activities and programs and/or use of Recreation Department facilities shall be deposited into this special fund. (c) Funds may only be expended for capital improvements or activities directly related to Recreation Department activities, programs and facilities upon passage of a proper appropriation ordinance by the Common Council: Provided, however, that subject to the deposit into the Recreation Department Non-Reverting Fund of the sufficient revenues to support the same, the Park Department may, throughout each fiscal year, make such budget adjustments as may be necessary to operate the indicated programs and facilities . (d) Any and all interest earned on the monies deposited in this special fund shall remain a part of the Recreation Department Non-Reverting Fund. Section 2.
