The Board of Public Safety met in the Public Agenda Session at 8:05 a.m. on Wednesday,
December 8, 2010 with Board Members Patrick Cottrell, Bruce BonDurant, Laura Vasquez, and
Eddie Miller present. Board President Juanita Dempsey was absent. Also present were Board
Attorney Thomas Bodnar, Police Chief Darryl Boykins, and Fire Chief Howard Buchanan.
The meeting was held in the Board of Public Works Meeting Room, 13th Floor, County City
Building, South Bend, Indiana.
Board members discussed the following items:
- Additions to the Agenda
Board Attorney Thomas Bodnar noted the addition of six (b) items to the agenda. The
Police Department added Resolution No. 81 -2010, a donation, Monthly Statistical
Analysis, and Findings of Fact for Charges 201007 and Charges 2010 -08. The Fire
Department added Resolution No. 82 -2010. Mr. Bodnar stated that due to all of the
additions and the length of the agenda, the Board should do the Swearing In of the
officers first so the public doesn't have to sit through the entire meeting.
- Police Selection Panel Recommendation — Police
Police Chief Daryl Boykins informed the Board that Brandon Martin was being sworn in
today to replace a retiring officer. He noted that Brandon has a background in law
enforcement and holds a criminal justice degree.
- Resolution No. 81 -2010 — Reorganizing the Ranks of the South Bend Police Department
Mr. Bodnar informed the Board that during negotiations over the last two (2) years, there
have been discussions regarding eliminating the rank of Corporal, and replacing it with
the rank of Patrolman 1" Class. He noted that the salary for Patrolman 1St Class has been
raised per the most recent salary ordinance passed by the Common Council, to that of the
Corporal salary. Therefore, the rank of Corporal is being replaced. Chief Boykins stated
new badges will not be purchased at this time, but may be purchased at a later time. He
noted cloth badges are sufficient.
- Findings of Fact — Charges 2010 -07 and Charges 2010 -08
Mr. Bodnar stated a letter dated November 17, 2010, was served by the Police
Department from the Clerk of the Board of Safety on Sergeant Charles Flanagan and
Lieutenant Rick McGee, advising them of their rights regarding the discipline
recommendation by Police Chief Boykins. In the letter they were advised of the right to
request a Hearing within five (5) days. Neither officer responded requesting a Hearing.
Subsequently, the Board is being asked to approve the Findings of Fact, approving the
recommended discipline of Chief Boykins.
- Approve Hiring of Probationary Firefighter --- Fire Department
Mr. Bodnar stated that Stephen Harmon, being sworn in today, comes from the
Chesterton Fire Department. He noted the Board is authorized by Statute to allow officers
to transfer from one department to another providing that the requirements set by the
statutes have been met and the officer completes the training required by the new
department. Fire Chief Buchanon stated it was necessary to transfer him before his
birthday to allow him to continue his eligibility for PERF. He stated if the Department
waited thirty (30) days, Mr. Harmon would have lost his eligibility for membership in
PERF.
- Approve Resolution No. 82 -2010 — Reorganization of the Ranks of the South Bend Fire
Department
Mr. Bodnar stated that this reorganization will eliminate the rank of Engineer effective
January 1, 2011, and replace it with the rank of Firefighter 1St Class. He noted the salaries
are the same; there is no change other than rank.
- Approve Contract with Memorial Hospital for Ambulance Staffing
Mr. Bodnar informed the Board this will be a two (2) year contract, effective 2011 and
2012.
Resolution No. 80 -2010 — Establishing the 2011 Holiday Schedule for the South Bend Fire
Department
Mr. Bodnar stated this schedule is the same as 2010, except Veteran's Day has been
added as a critical duty day. Officers on duty that day will receive time and a half pay.
ADJOURNMENT
There being no further business to come before the Board, President Dempsey declared the
meeting adjourned at 8:25 a.m.

POLICE SELECTION PANEL DECEMBER 8 2010
The Police Selection Panel met at 8:30 a.m. on Wednesday, December 8, 2010 in the Board of
Public Works Meeting Room, 13h Floor, County City Building, South Bend, Indiana, for the
purpose of formulating a recommendation to be made to the Board of Public Safety. Present
were Police Chief Darryl Boykins, Board Attorney Thomas Bodnar, and Board Member Patrick
Cottrell. Upon a motion by Mr. Cottrell, seconded by Chief Daryl Boykins and carried, the
recommendation from Police Chief Boykins to appoint Brandon Jacob Martin to the South Bend
Police Department as a probationary employee for a period of one (1) year was approved. The
Police Selection Panel adjourned at 8:32 a.m.
EXECUTIVE SESSION DECEMBER 8, 2010
The Board of Public Safety met in the Executive Session on December 8, 2010, at 8:40 a.m. The
meeting was held in the Mayor's Conference Room, 14th Floor County City Building, South
Bend, Indiana, for the purposes specified in I.C. 5- 14- 1.5 -6.1 (b) (2) (A) and (b) (6) (A) and
I.C.5- 14- 1.5- 6.1(b)(7). Board Members Bruce BonDurant, Patrick Cottrell, Laura Vasquez, and
Eddie Miller were present. Board President Juanita Dempsey was absent. Also present were
Board Attorney Thomas Bodnar, Police Chief Darryl Boykins, and Fire Chief Howard
Buchanan. Board members did not discuss any subject matter other than the subject matter as
specified in the Public Notice. The meeting adjourned at 9 :08 a.m.

The Board of Public Safety met in the regular meeting at 9:15 a.m. on Wednesday, December 8,
2010, with Board Members Bruce BonDurant, Patrick Cottrell, Laura Vasquez, and Eddie Miller
present. Board President Juanita Dempsey was absent. Also present' were Police Chief Darryl
Boykins, Fire Chief Howard Buchanon, and Board Attorney Thomas Bodnar.
The meeting was held in the Common Council Chambers, 4 1 Floor, County -City Building,
South Bend, Indiana.
ACCEPT MINUTES OF PREVIOUS MEETING
Mr. Cottrell stated that since there were no objections, the Minutes of the October 29, 2010
Special Meeting and the November 17, 2010 meeting would be accepted as presented.
POLICE DEPARTMENT
POLICE SELECTION PANEL RECOMMENDATION
Upon a motion by Mr. BonDurant, seconded by Mr. Miller and carried, the recommendation
from Chief Darryl Boykins in his letter dated December 8, 2010, to hire Brandon Jacob Martin,
was accepted and approved.
SWEARING IN OF POLICE OFFICER
- Brandon Jacob Martin
Chief Darryl Boykins recommended that Brandon Jacob Martin be accepted for employment on
a probationary basis with the South Bend Police Department effective December 8, 2010. He
has met the requirements of the application process of the South ',Bend Police Department.
Brandon Jacob Martin will be attending the Indiana Law Enforcement Academy in Plainfield,
Indiana from January 3, 2011, to April 15, 2011. Upon a motion 'made by Mr. BonDurant,
seconded by Mr. Miller and carried, the recommendation was approved.
Mr. John Voorde, City Clerk, was present. Mr. Voorde administered', the Oath of Office to Mr.
Martin. The Board wished him well in his endeavors with the South Bend Police Department.

HOLIDAY SCHEDULE FOR THE SOUTH BEND POLICE
Upon a motion made by Mr. BonDurant, seconded by Mr. Miller and carried, the following
Resolution was adopted by the Board of Public Works:
RESOLUTION NO. 78 -2010
A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH
BEND, INDIANA ESTABLISHING THE 2011 HOLIDAY SCHEDULE FOR THE
SOUTH BEND POLICE DEPARTMENT
WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is
empowered by law to establish rules and regulations for the South Bend Police Department; and
WHEREAS, it is in the interest of the City of South Bend that the Police Department
holidays be set with certainty.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety of the City of
South Bend:
SECTION I. That for all sworn police officers who are assigned to work as their regular
schedule, 5 on and 2 off, Monday through Friday, the following holidays shall apply:

Corporation for its clerical employees. Officers so assigned shall be eligible for Critical Duty
Day pay only if assigned to the Uniform Division and otherwise eligible.

ADOPT RESOLUTION NO. 81 -2010 - A RESOLUTION OF THE BOARD OF PUBLIC
SAFETY OF THE CITY OF SOUTH BEND INDIANA REORGANIZING THE RANKS OF
THE SOUTH BEND POLICE DEPARTMENT
Upon a motion by Mr. BonDurant, seconded by Mr. Miller and carried, the following Resolution
was approved by the Board of Public Safety:
RESOLUTION NO. 81-2010
A RESOLUTION OF THE BOARD OF PUBLIC SAFETY REORGANIZING THE
RANKS OF THE SOUTH BEND POLICE DEPARTMENT
WHEREAS, in the months of June through September, 2009, the Board of Public Safety
through its appointed agent, Charles Leone, and other members of the City's Advisory
Negotiating Team negotiated a new one year wage package and Working Agreement with the
Fraternal Order of Police Lodge No. 36, the representative of the sworn members of South Bend
Police Department excluding the ranks of Captain and above; and
WHEREAS, during the negotiations the parties agreed that there should be a
restructuring of the ranks so that eventually the highest non - supervisory rank in the South Bend
Police Department will be Patrolman First Class and the rank of Corporal will be phased out; and
WHEREAS, the financial constraints upon the City at this time required that this full
restructuring take place over a number of years but that the intent is to benefit pensioners and not
to provide an interim windfall raise to some current sworn members; and
WHEREAS, the Board of Public Safety on December 16, 2009 passed Resolution 61-
2009 which addressed and partially accomplished the reorganization; and
WHEREAS, on September 30, 2010, the South Bend Common Council passed the Salary

Ordinance #10042 -10 which covered the salaries for the members of the South Bend Police
Department in the years 2011 and 2012, and which ordinance did not provide any salary for the
rank of Corporal; and
WHEREAS, the Board of Public Safety is the appropriate body pursuant to its powers
under I.C. 36 -8 -3 to restructure the ranks of the South Bend Police Department, and to create job
descriptions and promotion requirements for the ranks within the South Bend Police Department,
NOW, THEREFORE, THE BOARD OF PUBLIC SAFETY makes the following
changes in the rank structure of the South Bend Police Department to be effective at 12:00
midnight, January 1, 2011:
1. The rank of Corporal shall be abolished and any sworn members holding that
position shall be assigned the rank of First Class Patrolman;
2. The rank of First Class Police Officer is abolished, and any sworn members
holding that position shall be assigned the rank of First Class Patrolman;
3. The rank of Second Class Police Officer is abolished and any sworn members
holding that position shall be assigned the rank Second Class Patrolman; and
4. The rank of Third Class Police Officer is abolished and any sworn members
holding that position shall be assigned the rank of Third Class Patrolman.
5. The rank structure of the South Bend Police Department shall not be otherwise
changed by this Resolution.

ACCEPT AND FILE DONATION TO SOUTH BEND POLICE DEPARTMENT
Chief Boykins, Police Department, advised the Board of a generous donation in the amount of
$150.00 made to the South Bend Police Department Boxing Program by the University of Notre
Dame. There being no further discussion, Mr. Cottrell stated the donation would be accepted and
filed.
FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — NOVEMBER 2010
Mr. Cottrell indicated that unless there were questions or objections by members of the Board,
the statistical analysis report for the month of November 2010, as submitted by the Police
Department, would be accepted for filing. There being no objections, the following report was

APPROVE FINDINGS OF FACT - CHARGE 2010 -07 — CHARLES FLANAGAN
In a Memorandum to the Board, Mr. Bodnar stated that on November 17, 2010, Sergeant
Flanagan was served a letter from the Clerk of the Board of Public Safety with a copy of a letter
of recommended discipline from Police Chief Darryl Boykins. Ms. Martin's letter advised
Sergeant Flanagan of his rights including his right to request, within five (5) days, a Hearing
before the Board of Safety. Sergeant Flanagan did not respond to the letter, and the five (5) days
passed. In his letter, Chief Boykins recommended that for his actions that violated the South
Bend Police Department Duty Manual Sections 302.00(A)(1)(9)(46) and (51), failure to secure
evidence in accordance with Department procedures, Sergeant Flanagan receive a three (3) day
suspension without pay and be demoted to the rank of Corporal. Upon a motion by Mr.
BonDurant, seconded by Mr. Miller and carried, the Findings of Fact were approved and signed.
APPROVE FINDINGS OF FACT - CHARGE 2010 -08 — RICK MCGEE
In a Memorandum to the Board, Mr. Bodnar stated that on November 17, 2010, Lieutenant Rick
McGee was served a letter from the Clerk of the Board of Public Safety with a copy of a letter of
recommended discipline from Police Chief Darryl Boykins. Ms. Martin's letter advised
Lieutenant McGee of his rights including his right to request, within five (5) days, a Hearing
before the Board of Safety. Lieutenant McGee did not respond to the letter, and the five (5) days
passed. In his letter, Chief Boykins recommended that for his actions that violated the South
Bend Police Department Duty Manual Section 302.00(20), entitled Rules of Conduct, Lieutenant
McGee receive a five (5) day suspension without pay and be demoted to the rank of Corporal.
Upon a motion by Mr. BonDurant, seconded by Mr. Miller and carried, the Findings of Fact
were approved and signed.
FIRE DEPARTMENT
APPROVE RECOMMENDATIO TO HIRE FIRE DEPARTMENT APPLICANT — STEPHEN
HARMON
Chief Howard Buchanon submitted to the Board a letter requesting permission to hire one (1)
Fire Recruit as a probationary firefighter. Mr. Harmon will attend the recruit class scheduled to
begin on November 30, 2010, for a period of approximately twenty (20) weeks with an effective
date of hire as Firefighter of December 8, 2010. Therefore, Ms. Vasquez made a motion that the
recommendation be approved. Mr. Miller seconded the motion which carried.

recommendation was approved.

In a letter to the Board, Chief Buchanon recommended the above listed individuals be approved
for the list of candidates eligible for promotion from the rank of of 2 Class Firefighter to the
rank of Engineer, effective November 26, 2010, Chief Buchanon noted that the list is in
compliance with the 1994 Salary Ordinance which states that the rank of Engineer is a
promotable rank. Upon a motion made by Ms. Vasquez, seconded by Mr. Miller and carried, the
above list of candidates eligible for promotion to Engineer was accepted and approved.

THE SOUTH BEND FIRE DEPARTMENT
Upon a motion by Ms. Vasquez, seconded by Mr. Miller and carried, the following Resolution
was approved by the Board of Public Safety:

ACCEPT AND APPROVE RETIREMENT — CAPTAIN JAMES BRIEN
President Dempsey advised that Chief Howard Buchanon has submitted to the Board the

Application and Declaration for Retirement for Captain James Brien effective December 1, 2010.
Chief Buchanon noted that Captain Brien has served the Department with loyalty and distinction
during the last thirty -eight (38) years, and one (1) month. Chief Buchanon joined the Board in
thanking him for his commitment, dedication and years of distinguished service to the South
Bend Fire Department and the citizens of South Bend. Members also wished him a long and
happy retirement. Upon a motion made by Ms. Vasquez, seconded by Mr. Miller and carried, the
retirement was accepted and approved.
APPROVE AGREEMENT WITH MEMORIAL HOSPITAL FOR CHILDREN'S
AMBULANCE STAFFING FOR 201 IAND 2012
Mr. Bodnar presented the Board with the above contract for approval. He noted this year's
contract will extend two years, through 2012. Upon a motion by Ms. Vasquez, seconded by Mr.
Miller and carried, the Children's Hospital /Medflight Ambulance Staffing Agreement was
approved.
ADOPT RESOLUTION NO. 80 -2010 — A RESOLUTION OF THE BOARD OF PUBLIC
SAFETY OF THE CITY OF SOUTH BEND INDIANA ESTABLISHING THE 2011
HOLIDAY SCHEDULE FOR THE SOUTH BEND FIRE DEPARTMENT
Upon a motion made by Ms. Vasquez, seconded by Mr. Miller and carried, the following
Resolution was adopted by the Board of Public Works:

set forth in Article 25 of the Collective Bargaining Agreement for the year 2010, which is in
force in 2011 per Article 33 of the Agreement.
SECTION III. That all firefighters who are assigned to work a four or five day work
week, shall have 80 office hours of holidays, and the following holidays shall apply:

FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — OCTOBER 2010
Chief Howard Buchanon submitted to the Board the monthly report for the month of September,
2010, compiled by the Prevention/Inspection Bureau of the Fire Department. Mr. Cottrell stated
if there were no objections, the Board would accept the report for filing as presented.

PRIVILEGE OF THE FLOOR
Mr. Todd Skwarcan, Vice President, Local Union 362, informed the Board that the Fire
Department Union has ratified their Collective Bargaining Agreement and was hoping it would
be on this Board of Safety agenda so it could be distributed before the end of the year. Mr.
Cottrell stated he was informed that it was ratified, but the Board will need the contract prior to
their meeting to review it. He noted there is one more Board of Safety meeting on December 29,
2010 and if they can get the contract to the Board before that, it can be addressed at that meeting.
ADJOURNMENT
There being no further business to come before the Board, Mr. Cottrell declared the meeting
adjourned at 9:38 a.m.
