Oliver Plow Minor Subdivision

The attached Professional Services Agreement is a proposal from Danch, Harner &
Associates to do the necessary planning and surveying work to create a minor subdivision
of Proposed Lot 8 (Lot 8) in the Oliver Plow Industrial Park.
Lot 8 is a 7.84 acre parcel on the north side of Oliver Plow Court, east of the new location of
Underground Pipe & Valve. There is an interested party who may relocate their business to
the eastern portion of Lot 8. The land area needed for their new location is approximately
4.64 acres of Lot 8.
To accommodate the sale of this 4.64 acre section of Lot 8, it needs to be subdivided into
two parcels. This proposal from Danch Harner is to do the necessary work for this to be
completed.
Project services cost is $3,850, plus possible review fees of $325. Staff requests a not -to-
exceed amount of $4,175, in the event any review work would be required.
Staff requests approval of this Professional Services Agreement, to allow Lot 8 to be
subdivided and ultimately sold for new development.

Please accept this letter as our written cost quote to provide you with
Planning and Surveying services to create a Two (2) Lot Minor Subdivision for a
proposed user locating to the property on the Northwest corner of Chapin Street
and Oliver Plow Court, South Bend, Indiana.
After our discussion of the project today, I would suggest the following as
our scope of work for this project:
Part I: Pre aration of a Two 12 )'Lot Minor Subdivision for project site):
Z). Preparation of a Two (2) Lot Minor Subdivision Plat as required by the
City of South Bend Subdivision standards for the project site including
Application forms, property owners list for owners within 300 ft, of
subdivision, a Primary/ Secondary Plat, filing fees.
2). Staking of lot corners.
3). Field verify the location of the recently constructed storm sewer line so
that an easement can be created on the subdivision plat for the sewer line.
Cost for this project would be $ 3,850 plus any review fees for the
subdivision, which would be approximately $ 3251

We have also attached a copy of our hourly costs for any requested additional
work or any requested revisions by review agencies.
We would plan to submit the subdivision for approval to Area plan
Commission by January 10�h for approval by February 17th.
In order to begin the above work we will need a copy of the recorded deeds
showing the parcel to be subdivided.

SCHEDULE OF HOURLY RATES AND DIRECT EXPENSES
`Note: Copies include 81/2 x 11, 81/2 x 14, or I 1 x 17 size sheets.
Other direct expenses may include cost to obtain copies of documents such as deeds or plats, maps, or other items
purchased as a direct result of employment on the project, NOTE THAT MILEAGE IS NOT CHARGED FOR
PROJECTS WITHIN ST. JOSEPH COUNTY, INDIANA OR BERRIEN COUNTY, MICHIGAN.
STANDARD TERMS AND CONDITIONS
I. I Vl E AND PAYMENT PROCEDURES• Danch, Hamer & Associates shall submit invoices, once a
month, at a minimum, to the OWNER for Services accomplished during each calendar month.
The OWNER, as OWNER or authorized agent for the OWNER hereby agrees that payment will be made for said
Services within thirty (30) days from the date of the invoice: and, in default of such payment, hereby agrees to pay
all cost of collection, including reasonable attorney's fees, regardless of whether legal action is initiated. The
OWNER hereby acknowledges that unpaid invoices shall accrue interest at 24 percent per annum after they have
been outstanding for over thirty (30) days. If an invoice remains unpaid sixty (60) days after the date of the invoice,
